HomeMy WebLinkAboutORD NO 462as follows: SECTION 1. ORDINANCE NO.~~EW SERIES AN ORDINANCE OF THE CITY OF BAKERSFIELD PROHIBITING THE SALE, GIFT, STORING OR TRANS- PORTATION OF TE~XITE INFECTED WOOD. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAKERSFI~.LD, It shall be unlawful for any person, fix~m or corporation to sell, offer for sale, give away or store within the City of Bak- ersfield any wood, lumber, logs, poles, sawdust or other material infested with termites or white ants. SECTION 2. It shall be unlawful for any person, firm or corporation to transport within the City of Bakersfield any wood, lumber, logs, poles, sawdust or other material infested with termites or white an~ unless wood, lumber, logs, poles, sawdust or other material infested with termites or white ants is being transported to the City Dump or other approved place for burning. SECTION 5. The provisions of this ordinance are hereby specifically declared to apply to, govern and control the various departments and officers of the City of Bakersfield, any School District, School Board, Board of Education or any public, quasi public or political corporation or body, their aSents or representatives, except the United States of America, within the City of Bakersfield. SECTION 4. Any person, firm or corporation, who as principal,agent, contractor, sub-contractor, officer, servant or employee, for him- self or itself or for any other person, or for any firm or corpora- tion, or for any officer or department of the City of Bakersfield, OP for any School District, Sc~l~ol Board, Board of Education, or -1- or public, quasi public or political corporation or body, except the United States of America, or who by agent, contractor, sub- contractor, servant or employee shall violate or refuse to comply with any of the provisions of this ordinance, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed Five Hundred ($800) dollars or.by imprisonment in the County Jail not to exceed six (6) months, or by both such fine and imprisonment. SECTION S. Every such person, firm or corporation shall be guilty of a separate offense for each and every day during which any vio- lation of any of the provisions hereof is cont~'nued or permitted to exist, and shall be punishable therefor as herein provided. SECTION 6. If any section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section and sub-section thereof respective of the fact that any one or more of the sections, sub- sectionS, sentences, clauses, or phrases be declared unconstitutfonal or invalid. ..... o0o .....
