HomeMy WebLinkAboutORD NO 494 ORDINanCE N0.~NEW SERIES AN ORDINANCE PROVIDING FOR THE LICENSING OF BICYCLES, REGULATING THEIR USE, AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. BE IT 0RDAINED BY THE COUNCIL OF Tiie CITY 0ij BAI~ESFIELD, as follows: SECTION 1. License Required. No person shall ride or propel a bicycle upon any street or other public highway, or upon any part thereof, within the cor- porate limits of the City of Bakersfield without having first secured and attached to such bicycle a proper license tag as herein- after provided. SECTION 2. Procedure. Application for the.registration of all bicycles shall be made to the Police Department upon a form to be approved by the City Manager. The application shall be accompanied by a fee of fifty (50) cents, to be paid into the City Treasury upon the granting of a lic- ense. Upon receipt of such fee and the application in proper form the City License Collector shall provide, at the expense of the City, a proper tag which shall be attached to the frame of the bicycle in a substantial manner. The removal of any such tag, except by the proper authority, shall be a violation of this ordinance. Upon change of ownership, notice of such change of ownership shall be given to the Police Department within ten (lO) days thereafter. The above mentioned license tag shall be valid only for the year or that remaining portion of the year in which it has been issued. All such license tags shall be voided the 15th day of September of each year. SECTION 3. Conditions of License. Every license issued hereunder shall be deemed to be granted subject to the following conditions: (a) No person shall ride or propel a bicycle on a street or other public high~vay of the City when such bicycle is occupied by anyone other than the operator of such bicycle. (b) No bicycle shall be ridden faster than is reasonable and proper, but every bicycle shall be operated with reasonable regard to the safety of the operator and other persons upon the sidewalks, streets and other public highways of the City. (c) Persons riding bicycles shall observe all traffic signs and stop at all boulevard stop signs. (d) No bicycle shall be permitted on any sidewalk, street or other public highway of the City between thirty minutes after sunset and thirty minutes before sunrise, without a headlight visible under noH~al atmospheric conditions from the front thereof a distance of not less than three hundred (300) feet, indicating the approach or presence of the bicycle, fiHaly attached to such bicycle and properly lighted, or without a red light or reflector attached to the rear thereof and visible for a distance of not less than two hundred (200) feet.to the rear thereof. The said headlight shall give a.clear white light. (e) No person shall ride or propel a bicycle upon any street or other public high~vay in the city abreast of more than one other person riding or propelling a bicycle. (f) Every person riding or propelling a bicycle upon any street or other public highway in the city shall observe all traffic rules and regulations applicable thereto, and shall turn only at intersections, signal for all turns, ride at the right hand side of the sidewalk, street or highway, pass to the left when passing over- taken vehicles and individuals, and shall pass vehicles to the right when meeting. (g) No person shall ride any bicycle upon any sidewalk within any business district, as defined in Section 89 of the California Vehicle Code. (h) Every person riding or propelling a bicycle upon the sidewalk in a residential section, as defined in Section 90 of the California Vehicle Code~ shall yield the free use of said sidewalk to any pedestrian using such sidewalk. SECTION 4. DefacinE License Number - Taking Bicycle Without Permission. No person shall alter, deface or mutilate or remove a lic- ense tag placed upon any bicycle, nor shall any person take any bicycle for the purpose of riding or propelling the same upon the street or other public highway without the consent of the owner, or with the intent to deprive the said owner of the lawful possession of said bicycle. SECTION 8. Penalty. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed one hundred ($100.00) dollars, or by imprisonment in the county jail for not to exceed fifty days; provided that in case of any violations of the provisions of Section 3 the Court may, in lieu of, or in addition to the penalty provided herein, suspend the license of any person, granted hereunder, for a period of not more than ten (10) days for the first offense, and for any subsequent conviction for not less than thirty (30) days, nor more than one hundred and eighty (180) days; or, at the discretion of the Court, the bicycle of any violator, upon conviction, may be impounded for a period of not to exceed one hundred and eighty (180) days. Any violator having his bicycle so impounded shall not ride any other bicycle during such period of impoundment. SECTION 8. RepealinE Ordinances.
