AN ORDINANCE CALLING A SPECIAL Fr.~CTION TO BE HELD
IN THE CITY OF BAEERSFIELD ON TUESDAY, THE 30TH
DAY OF AUGUST, 1938, FOR THE PURPOSE OF SUBMITTING
TO THE ~UALIFIED VOTES OF SAID CITY THE FOLLOWING
PROPOSITIONS: (1) OF INCURRING A BONDED INDEBTED-
NESS IN THE SUM OF ONE HUNDRED ELEVEN THOUSAND
DOLLARS ($111,000) FOR THE ACQUISITION AND CONSTRUC-
TION OF A MUNICIPAL I~ROVEMENT, TO-WIT: A SANITARY

MENT PLANT; (2) OF INCURRING A BONDED INDEBTEDNESS

IMPROVEMENT, TO-WIT: A FIRE STATION BUILDING,

AND NAMING ELECTION OFFICIALS THEREFOR, AND PROVIDING
FOR NOTICE THEREOF.
WHEREAS, the Council of the City of Bakersfield at a
special meeting of said Council, duly and regularly called and
held in the Council Chambers of said City Council in the City Hall
at Bakersfield, California, at two o'clock Pc Me, Friday, ~uly
1938, for the purpose of considering the advisability of adopting
and approving a resolution pertaining to the proposed construction
of a sanitarymain sewer, sewage pumping station and sewage treat-
ment plant, and the construction of a fire station building with
the necessary furniture, fixtures and equipment, and the acquisi-
tion of the necessary land for same and the construction of the
necessary sidewalks and driveways for same, did, by a vote of more
than two-thirds of all the members of said City Council, pass and
adopt a resolution in the words and figures as follows, to-wit:

BE.IT RESOLVED ANDDETERMINEDBYTtIE COUNCIL OP THE CITY
OF BAKERSFIELD that the public interest and necessity demand the
acquisition, construction and completion of certain municipal
improvements, to-wit:
1· The acquisition and construction of a sanitary main
sewer, sewage pumpin~ station and sewage treatment plant, and that
the estimated cost of said municipal improvements to be expended
by the City of Bakersfield is the sum of One Hunted and eleven
thousand dollars ($111,000·00);
2e The acquisition and construction of a fire station
building, equipping the same with necessary furniture, fixtures
and equipment, the acquisition of the necessalV land for same and
the construction of sidewalks and d~iveways pertinent to same,
and that the estimated cost of said municipal improvements to be
e_~pended by the City of Bakersfield is Sixty six thousand dollars
(S66,000;00) ·
AND BE IT FURTHER RESOLVEDthat the cost of. sala.public
improvements will be too great to be paid out of the ordinary annual
income and revenue of the City of Bakersfield, and it will be
necessary to incur a bonded indebtedness for the purposes set forth
in this resolution·

OF BAKERSFIELD, as follows:
Section 1
That the Council of the Oity of Bakersfield does hereby
order the submission of two propositions of incurring bonded in-
debtedness for the purposes set forth in said foregoing Resolution,
as follows, to-wit: Proposition Noe I of incurring a bonded in-
debtedness in the sum of one hundred and eleven thousand dollars
($111,000) for the acquisition and construction of a sanitary main

sewer, sewage pumping station and sewage treatment plant; and
Proposition No. ~, of incurring a bonded indebtedness in the sum
of Sixty six thousand dollars ($66,000) for the acquisition and con-
strutrich of a fire station building, equipping the same with the
necessaxTfu~niture, fixtures and equipment, the acquisition of
the necessary land for same and the construction of sidewalks and
driveways pertinent to same, to the qualified voters of the City of
Bakersfield at a special municipal election, which said municipal
election be, and the same is hereby called to be held in the Oity
of Bakersfield on the 3Orb day of August, 1938, for the objects
and purposes of submitting to the qualified voters of said city the
two propositions of incurring bonded indebtedness fop the purposes
set forth in said resolution and hereinafter statede
Section 2e
That the objects and purposes for which said bonded In-
debtedness in the sum of One hundred and eleven thousand dollars
($111,000) under Proposition No. 1 is proposed to be incurred are
as follows: The acquisition and construction of a sanitary main
sewer, sewage pumping station and sewage t~eatment plante

That the objects and pu~oses for which said bonded in-
debtedness in the sum of Sixty six thousand dollars ($66,000) under
Proposition Noo 2 is proposed to be incurred are as follows: The
acquisition and construction of a fire station building, equipping
the same with the necessary furniture, fixtures and equipment, the
acquisition of the necessary land for same and the construction of
sidewalks and driVeways pertinent to samee
Section 4e
That the estimated cost of the proposed public improve-
ment consisting'of the acquisition and construction of a sanitary
main sewer, sewage pumping station and sewage treatment plant is
the sum of Two hundred and two thousand dollars ($202,000) and such
cost will be' and is too great to be paid out of the ordinary annual
lncome and revenue of sald city end sald improvement ls necessaz-y
and convenient to carry out the objects, purposes and powers of

Sectlon 5,
That the estimated cost of the proposed publlc Improve-
ment consisting of the acquisition and construction of a flre

same and the construction of sidewalks and driveways pertinent to
same, ls the sum of One hundred twenty thousand dollars
and such cost wtll be too great to be patd out of'the annual income

Sectlon 6.
That the amount of the principal of the Indebtedness to
be incurred under the sald Proposition No. 1 for the.acquisition
and const~uctlon of a sanitary maln sewer, sewage pumptn~ station
and sewage treatment plant is the sum of One hundred and eleven
thousand dollars .($111,000) a~ the rate of interest to be paid on
such Indebtedness shall not exceed four and one half (4½~) per cent
pet annurns pa~able semi-annually. The sum of Twent~ tt~ee thousand
dollars ($23,000) of the principal sum of said Indebtedness shall
be paid one (1) Tear from the date of lssuance of said bonds for
such indebtedness; and the sum of Twenty two thousand dollars
($e2,000) of the principal sum of said Indebtedness shall be paid
annuall=thereafteT, commencing two (e) years from the date of the
lssuance of such bonds, each of said installments of sald Indebted-
ness shall be pa~d on a day a~ date and at a place or places to be
flxed by the Council of the Clty of Bakersfield unt11 the whole amount
of such Indebtedness is paid. Said bonds shall be lssued in such
demomtnattons as the Council of the Ctt~ of Bakersfield my detel~ntne,
except that no bonds shall be of a less denomination than One
hundred dollars ($100.00) nor of a greater denomination than One
thousand dollars ($1,000).
Section Ve
That the amount of the principal of the indebtedness to
be incurred under the said Proposition Noe 2 for the acquisition
and construction of a fire station building, equipping the same
with the necessar7 furniture, fixtures and equipment, the acquisi-
tion of the necessary land for same ami the constriction of side-
walks and driveways pertinent to same, is the sum of Sixty six
thousand dollars ($66,000) and the' rate of interest to be paid on
such indebtedness shall not exceed four and one half (4½%) per cent
per annum, payable semi-annuallye The sum of Fourteen thousand
dollars ($14,000) of the principal sum of said indebtedness shall
be paid one (1) year from the date of issuance of said bonds for
such indebtedness, and the sum of Thirteen thousand dollars ($13,000)

of the principal sum of said indebtedness shall be paid annually
thereafter, commencing two (2) years from the date of the issuance
of such bonds, each of said installments of said indebtedness shall
be paid on a day and date and at a place or places to be fixed by
the Council of the City of Bakersfield until the whole amount of
such indebtedness is paide Said bonds shall be issued in such denomina-
tions as the Council of the City of Bakersfield may determine, ex-
cept that no bonds shall be of a less denomination than One hundred
dollars ($100eO0) nor of a greater denomination than One thousand
dollars ($1,000).
Section 8e
That the manner of holding said election hereby called
and the voting thereat for or against incurring such indebtedness
as set out in Propositions No. 1 and No. 2, shall be as provided
in this ordinance; that in all other particulars not recited herein
said election shall be held as provided by law for the holding of
municipal elections in said city. The polls at the polling places
designated for said election shall be opened at six o'clock A. M.
of said day of election amibe kept open continuously thereafter
until seven o'clock P. M. of said day of election, when the polls
shall be closed (except as provided in Section 1164 of the Politi-
cal Code), and the election officers shall thereupon proceed to
canvass the ballots cast thereat. The returns of said election
shell be made out and signed by the election officers and shell be
by them deposited with the City Clerk and the City Council shell
meet and canvass the returns of said election on Tuesday. the 6th
day of September, 1938, at the hour of eight o'clock P. M., and if
upon such canvass it shall be f6und (a) thet two-thirds of th~
qualified electors of said city voting on said Proposition No. 1
for the acquisition and construction of a sanitary main sewer,
sewage pumping station and sewage treatment plant, vote in favor
thereof, said Proposition No. 1 shell be deemed adopted and bonds
to the amount specified in said Proposition No. 1, to-wit: One
hundred and eleven thousand dollars ($111,000) shall be issued and
sold by the City of Bakersfield according to law for the purposes
herein mentioned; and (b) thet two-thirds of the qualified electors
of said city voting on said Proposition No. 2 for the acquisition
and construction of a fire station building, equipping the same with
the necessary furniture, fixtures and equipment, the acquisition of
the necessary land for same and the construction of sidewalks and
driveways pertinent to same, vote in favor thereof, said Proposition
Nee 2 shell be deemed adopted and bonds to the amount specified in
said Proposition No. 2, to-wit: Sixty six thousand dollars ($66,000)
shall be issued and sold by the City of Bakersfield according to
law for the purposes her, in mentioned. All persons qualified to vote
at municipal elections in said'City of Bakersfield upon the date of
the election herein provided for shall be qualified to vote upon
the two propositions hereby submitted at the special election here-
by called.
Section 9e
Thet for the purpose of paying the principal and interest

of said bonds to be issued under either or both of said Proposi-
tions No. 1 and Noe 2, the Council of said City shall at the time
of fixing the general tax levy, and in the manner for such general
lev~provided, levy and collect annually, beginning with the fiscal
year ending June 30, 1939, and each year thereafter until such
bonds are paid, or until there be a sum in the treasury of said
City set apart for that purpose to meet all sums coming due for the
principal and interest on said bonds, a tax s~fficient to pay the
annual interest on said bonds, and also such part of the principal
thereof as shall become due before the time for fixing the next
general tax levy. Said tax shall be in addition to all other taxes
levied for municipal purposes, and shall be collected at the same
time and in the same manner as other municipal taxes are collected,
and be used for no other purposes than the payment of the principal
a~ interest of bonds to be issued under both PropoSition No. 1
and Proposition' No. 2, or either of theme
