DEFI?IITIONS (~) Contract A~ent: - The general term "Contract Agent" shall include and mean, for the p~~rpose of this ordinance, an agent or employee of the City of Bakersfield, or any person, firm, corporation or association, or the agents or employees thereof with. v~hom the City of Bakersfield s]~all have duly contracted under the terms hereinafter set out in this ordinance, and under the provisions of the Charter of the City of Bakersfield, with amend- ments thereto, to collect, transport through the streets, alleys or public ~;ays of said City, and dispose of refuse, garbage and rubbish produced within the limits of said City. (b) Ashes: - Shall include and mean the residue of all materials burned. (c) Combustible Rubbish: - The term "Combustible Rubbish" shall include and mean paper, pasteboard, carpets, rags, clothing, trimmings from lawns and flower gardens, tree trimmings, books, straw, packing, barrel's, boxes, oily rags, oily waste, furniture, sawdust, shavings and other similar articles that will cinerate through contact with flames of ordinary temperature. -1- (d) Dump Grounds: - The term "Dump Grounds" and/or "City Dump" and/or "Dump" shall include and mean any property the City of Bakersfield shall designate at any time to be used for the dis- posal of any or all refuse, garbage, rubbish or other waste material that may accumulate within the said City. (e) Garbag.e~ - The term "Garbage shall include and mean kitchen and table refuse and offal. Also, every accumulation of animal, vegetable or other matter that attends the preparation, consumption, decay or dealing in or storage of meats, fish, fowls, birds, fruits or vegetables, saving and excepting dead animals and offal of slaughter houses. (f).Incinerators: - The term"Lncinerator" shall include and mean fire proof receptacles to be used for disposing of com- bustible rubbish on private premises~ (g) Night Soil: - The term "Night Soil" shall include and mean the contents of privy vaults, cesspools, dr~ells, and sinks. (h) Non-Gombustible Rubbish: - The teen "Non-Combustible Rubbish" shall include and be held to mean broken crockery, broken bottles, broken brick, tin vessels, ashes, natural soil, street sweepings, earth and stone, obsolete or abandoned motor vehicles and non-combustible waste matter. (i) Rubbish: - The term "Rubbish" shall include and mean all combustible and non-combustible waste and refuse ~atter, ex- cepting garbage ordinarily accu~ulating in and about residences, flats, buildings, aDart~.ent houses, lodging houses, hotels, restaurants, eating houses, stores, shops, offices and other public buildings. Among other things it shall include tree trimmings, grass cuttings, dead plants and weeds, but shall not include brick, mortar, or other debris incident to the construction or demolition of buildings. -~- !i)__R.~! - T~e general term "Refuse" shall include and mean all matter and materials v~hich are rejected by the owners or producers thereof as offensive or useless, and w~ich by their presence or accumulation may injuriously affect the health, comfort, or safety of the commun~.ty by increasing disease or hazard by fire. (k__)_ ~plk~se Collector: - The term ~'Refuse Collector" as used in this ordinance shall include and mean the same as hereto- fore defined for the term "'Contract Agent". (1) Semi-Combustible Rubbish: - The term "Semi-Combustible Rubbish" shall include and mean boots, shoes, dead flowers, feathers, yard scrapings and similar articles of waste or rejected ~'~atter of any kind that will inci.~erate, though not readily, through contact with flames of ord~.nary temperature. SECTION B. REGv~LATIONS FOR ACCU~XLATTON. It shall be 'unlawful for any person, firm or corporation to deposit, keep, accumulate or permit, cause or suffer any rubbish or garbage to be deposited, kept or accumulated upon any lot or par- cel of land, o~ on any p~hlic or private place, street, lane, alley or drive, unless the same shall be kept, deposited or allowed to ac- cumulate as hereinafter provided. (a) Combustible Eubbish. It shall be unlawful for any person, firm or corporation to keep, deposit or allow to accumulate any "Combustible Rubbish" uoon any lot or parcel of land or on any public or private place, street, lane, alley or drive, unless the same shall be kept in a metal receptacle provided with handles and said receptacle shall not have a larger capacity than 80 gallons, said receptacle to be provided with a close-fitting. metal lid or coveE~bich shall be kept closed at all times except w~en necessarily opened to permit combustible rubbish to be taken therefrom or deposited therein. -3- ( b ) Gar_ba__ge: - It shall be unla;~fuL for any pearson, firm or Corporation to keep, accumulate or operas. it to be kept or acc~aulated any ~Garbage" upon a'.~y lot or parcel of land, or on any public or private place, street, lane, alley or drive, unless the same s~'.all be in receptacle provided v~ith handles; ~aid receptacle shall have a capacity of not less than five (O) gallons and not to exceed thirty (30) gallons, said receptacle to be provided ~vith a close- fitting ~-.~etal lid o~ cover v~ich shall be kept clo~ed at all ti~es except v~ben necessarily opened to permit garba~.e to be taken there- from or deposited therein. All garbage accu~'!ulatsd on any private lot or parcel of land, private residence or d~vsllin.~ shall be ro~'~oved by the City of Bakersfield, its agenZs, ei,,.ployees, per~'~ittees or represents.- tives at regular intervals of t-.,ice a week, unless othervziso direct- ed by the City Health Officer of the City of Ba!~orsfield. -5- (d) Rubbish Collection - All rubbis~ accumulated at any store, shop, restaurant, hotel, care, apartment bo~se, tenement, boarding house, private lot or parcel of land, private residence or dwelling shall be removed by the City of Bakersfield, its a~ents, employees, per- mittees, or representatives at regular intervals once a w~ek, or oftcrier w~en directed by the City P~al~h Officer and/or the City Fire ~rshall of the City of BaLersfield. (e) City Health Officer Directs ~emoval. It shall be the duty of any collector en6a~,ed in or conducting the business of collecting garbage and/o~ rubbish by contract with the City of Bakersfield or acting as its a~.ent, permittee, or representative, under this ordinance, when directed by the City Health Officer of the said City of Bakers- field, to immediately call at any premises in t3~e City of Bakers- field to ~icb said rubbish or garbage collector may be directed' by said Health Officer, and where garbage and/or rubbish is ac- cumulated and there collect and remove said garbage and/or rubbish in accordance ~ith tl~s provisions of this ordinance. SECTION 4. RATD~S FOR COLLECTI~T. O0 1.40 1.95 3.60 1.60 2.25 4.20 -6- Where the regular acc~nulation of garbage exceeds sixty (60) gallons per collection the excess garbshe shall be removed at the rate.of ten (10) cents for each ten (10) 8allons or fraction thereof, for one collection each week; for more frequent collections the rate shall incroase at the same ratio as set forth in the above schedule. The above schedule of rates for collection and re~oval of garbage shall ~.nclude the collection, removal and disposal of rubbish where the accumulation of said rubbish does not exceed one (1) barrel of fifty (80) gallons ca~acity per collection. (b) Business Places or Establishments. - For the service of collecting all gsrba~e and rubbish ordinarily produced in and about business places or establishments, but not including dead aninmls, or the refuse from the construction, demolition or alteration of buildings, each separate business place or establishment having refuse containers shall not be required to pay moro than the following rates: Quantity Per Collection Less than l0 gallons ...... For said garbage the Collecto~ must furnish the necessary containers, and said containers shall meet all requirements of the IIoalt~ Depa~t~.2ent as to storiliza- tion and sanitation. Said Collector s~all ~e~ove garbage and r~bisb from places no~7 ~2sed for the p~.rpose of storing such garbage and rubbish, or fro~ such ~lace as ~ay be designated by the City Health Officer, and shall not remove garbage and rubbish from hotels and restaurants between t~e ho~s of 10:30 P. ~. and 6 A.LI. Provided, further, that apart~ents and tenements not producing ten (10) gallons of garbage per day shall~c~iz~ that casedfor the service of collecting all refuse, garbage and/or rubbish ordinarily produced in and about apartments and tene~'.~ents, the rates for the v~hole apart"~ent ~ouse nr tene~:~ent payable in one fee, pay the following fees: 1. For five (5) or less apartments the rate shall not exceed one dollar and thirty-five cents (?1.35) per ~onth for two collections per ~veek. B. For ~ore than five (~) apartments the ~ate for each apartment shall not exceed t~venty-five cents (~5~) per month for two collections per week, forty cents (~0~) per month'for three collections per week, and si::ty-five cents (65~) per month for six (6) collections per ~eek. (c) Office BulldinEs, Places of Business - Fo~ the regular collection, removal and disposal of rubbish from any office building using a co~.t0n container or from -8- any promises or ~lace of business -~roducing said refuse (excepting those premises for which rates are hereinabove specified) the rate per month for said collection shall not exceed the following: Quantity Per Collection 5 or less cubic feet ........ ...... 6 to 15 cubic feet. ............... 16 to 30 cubic feet. ............... (e) Irregular Collections - For the occasional or irregular collection of refuse for which rates are not heroinbefore ?'ixed the refuse collector sly-all be entitled to charge at the rate of one dollar and thirty- five cents (:.)1.35) per cubic yard with a miniu:mn charge of sl;:ty- five cents (65~). It shall be the duty of the refuse collector to make such collections upon being properly notified. S':f, CTI~N 5. DIS'~OSAL. (a) City Dump Grounds - The City of Bakersfield sl-.al! provide a parcel of land known as the City Dump Orottnds, situated without t]-e City Limits of said City. All garbage, r-e. bbish, stable manure, ashes or other refuse collected uitbin t~e City of BaU,-'_ersfield shall be delivered to safi. d City Dump Grounds and dis.posec] of in accordance with the regulations of said Dump Grounds and in accordance with the instruct.~.ons of the Mana-~er or Custodian in charge of said Dump Grounds. (b) Hours of 'Disposal - No garbage or rubbish of any kind v,~t~.atsoever si:all be dumped at the City Du~:~p Gro~nds except bet'.~oen tr.e ~ours of V o'clock A. i.~. and six (8) o'clock P. (c) Custodian of City D~m.D Grounds. - It shall be the duty of any ~Ref~se Collector engaged in or conducti~.g t_hs business of collecting garbage and/or rub:~ish by contract ~vith the City of Bakers:Cield, or acting as its ~n~ent, permittee or representative, ~nder t~is ordi',,~.ance, to ~.aintain at the City Dump Grounds a co~..npete~t e~ployee v.~ho shall be k.'.~o~:~n ~s the Custodian of said Dt~i~p Grounds. Said Custodian sly. all rcmain at said Dump Gn?OUndS at all ti~_es during the ho~.u~s provided by t~is ordinance for the disposal of all gsrb~.ge and/or rubbish. Said Custodian shall have corl~plete charge of said Dtn~p Grounds in accordance i.~ith Rules and Hsgulations as provided in this ordinance, or such other rules and regulatiov~s as may be adopted by the City Council, and _be shall direct the dub_ping and disposal of all garbage and/or rubbish delivered t~o~.er· by the Collectors. SECTION 6. T'.IUCiqS. Every truck used ~n tbs collection and removal of garbage, and/or rubbish, shall be kept well painted, clean inside and out, and in a nrominent place on each truck display the follo~ving sign: GARBAGe.: SERVICE BAtC~.~'j'iELD, CALIF. NO. SECTION V. !~IGHING. The City reserves the right to require the Contractor to send to public scalos all of its loaded trucks carrying rofuse, ga~bage and rubbis~ originatin~ v~ithin the boundaries of the City for a period not oxcoeding ten (lO) days in any one year, for the purpose of v~eighino tT~o samo, at city expense. SEC~:I~0N 14. CONTRACT. For t~.',.e collection and disposal of Refuse, GarbaCe and Hubbish, a Contract for a period not to exceed ten (lO) years may be entered into by the City of Bakersfield, in accordance with and subject to the terms and conditions of this ordinance and the City Charter. Suc~ contract sl~all provide that the Contractor shall collect and dis~pose of the Refuse, Garbage and Rubbish in the City of Bakers?ield, in the ~.an~.er iu tb. is ordi~a~.ce provided, and' shall not charge any av~ounts in excess of the rates sDecified, in this ordinance. Said contr:'~ctor shall be required to furnish a surety bond to the City of B~,.kersfield, in the s~m of Five Thousand Dollars (~'~5,000.00), coy.~.ditioned upon the faithful per- formance of the contract and the provisions of t].~is ordinance. Such contractor shall hc. vo the sole and exclusive ri~ht~ except as in this ordi~.ance otl~orv~iss provided, to collect all refuse, ~arbage and rubbish in the City of Bakersfield, and transport the same thro~gh the streets and public ~vays of said .?ity. Said contract shall further provide that s~.id contractor shall be required to dispose of all ~uch refuse or ~.arbage and rubbish at the said City D~p as prove. tied in t~'is ordf.~ance, and provided., further, that such dis~osal st the City ~u~p shall hove 'the approval of the County Health 0f?icer and the St~=e Board of Health.
