HomeMy WebLinkAboutORD NO 557ORDINANCE N0. 557 NEW SERIES AN ORDINANCE ADOPTING A UNIFORM BUILDING CODE FOR THE CITY OF BAKERSFIELD, CALIFORNIA, AND REPEALING ORDINANCE NO. 152 NEW SERIES AND ALL AMENDMENTS TENT0. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as followsa SECTION 1. That the Uniform Building Code, 1937 Edition, as adopted by the Pacific Coast Building Officials' Conference at the 6th Annual Meeting, October, 1927, with Revisions and Additions approved at the 14th Annual Meeting, October, 1936, as published in April, 1937, printing of'July, 1939, as the same now reads, be and the same iS hereby adopted, except as to Sections 104 and 203, which shall read as follows: Section 104, The following specified requirements shall apply to exist- ing buildings which for any reason whatsoever do not conform to the requirements of this Code for new buildings: (a) Major Alterations and Renairs. If alterations and/or repairs in excess of 50 per cent of the value of an existing building are made to such building within any period of 12 months, the entire building shall be made to conform with the requirements given herein for new buildings. Any existing building which for any reason whatso- ever, requires repairs, at any one time, in excess of 50 per cent of the value thereof, not deducting from such value any loss caused by fire or any other reason, shall be made to conform to the requirements of this Code or shall be demolished, except as specified in Section 1602. (b) Chan~ed ~se, If the existing use or occupancy of an existing building is changed to a use or occupancy which would not be permitted in a similar building hereafter erected, the entire building shall be made to conform with the requirements given herein for new buildings; provided, however, that if the use or occupancy of only a portion or portions of an existing building is changed and such portion or -1- portions are segregated as specified in Section ~0-~ of this Code th~.n ,, ,~ only such portion or poiotions of the building need to be made to comply ~.;itb. said ~equirements; ~:nd p~'ovided, further, that the Bui!:J.- i:~g Ir, spectof is he..'eby given authority to approve any change in tl?.e use ox~ occupm~cy of any existing building within any one Group of Occupancy as specified in Part III, even tl~ough such building is not made to fully conform to the requirements of this Code, '..~:hen it is obvious that such a change in t~:e use or occupanc~ of ~he existing building Fill not exte~.~d or increase a.~3.y existing non-conformity or hazard of the building. (d) Minor Alterations an__Jd. Repairs. Every alteration or repair to ar~y structural part or portion of an existi'qg building shall, when deemed necessary in the opinion of the Building Inspector, be made to conform to the x'equis~emsnts of thls Code foi'- ne~;.~ buil,liDgs. Minor alterations, repairs and. ci'mnges not covered by the preceding pax'agraphs (a), (b) and (c) may be made with the same ma.~erials of which the building is constructed; provided, that not more than P~ per cent of the roof covering of any building shall be replaced in any period of 12 months unless the entire roof covering is made to conform to the requirements of this Coc~e for new buildings. No building used for residence or apartment house purposes shall be moved from one location to another until the consent of the owners. of a majority of the property frontage on both sides of the street in the'block in which said building is to be located shall have been obtained. Section 20~A Any person desiring a building permit shall, at the time of filing an application therefor, as provided in Section 201 of this Code,' pay to the Building Inspector a fee as required in this section: For a total valuation'of $25.00 or less, no fee. For a total valuation from $25.00 to and including $300.00, a $1.00 fee. For a total valuation from $300.00 to and including $1,000.00, a $2.50 fee. An additional fee of $1.50 for each additional $1,000.00 or fraction thereof of total valuation to and including $15,000.00. An additional fee of $1.00 for each additional $1,000.00 or fraction thereof of total valuation from $15,000.00 to and including $~0,000.00. An additional fee of 50¢ for each additional $1,000.00 or fraction thereof of total valuation exceeding $40,000.00. The city, county, state, or the United States of America shall be exempt from the paying of any fee as provided in this ordinance. Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees above specified shall be doubledr but the payment of such double fee shall not relieve any persons from fully complying with the require- ments of this Code in the execution of the work nor from any other penalties prescribed herein. The Building Inspector shall keep a permanent, accurate account of all fees and other monies collected and received under this Code and give the names of the persons upon whose account the same were paid, the date and amount thereof, together with the location of the building or premises to which they relate. -3- ............. oOo ..............
