HomeMy WebLinkAboutORD NO 563AN ORDINANCE GRANTING TO TEE SOUTHERN PACIFIC COMPANY, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, A PEHMIT TO LAY D0V~N, CONSTRUCT, MAINTAIN AND OPERATE A RAILROAD TRACK OF STANDARD GAUGE ACROSS 24TH STREET, LOCATED IN THE CITY OF B~RSFIELD, COUNTY OF KERN, STATE OF CALIFORNIA, FOR THE PURPOSE OF SERVING SMART & FINAL COMPANY, LTD., WITH A RAILROAD TRACK. BE IT ORDAINED BY THE COUNCIL OF TEE CITY OF BAKERSFIELD, as follows: SECTION 1. SECTION 2. The Council of the City of Bakersfield hereby grants to the Southern Pacific Company, a corporation organized-and incor- porated under the laws of the State of Kentucky, its successors and assigns, a permit to lay down, construct, maintain and operate a railroad track of standard gauge across 24th Street, located in the City of Bakersfield, County of Kern, State of California, for the purpose. of serving Smart & Final Company, Ltd., with a railroad track, the particular description of said railroad track necessary for the purpose as aforesaid being as follows: Description of Center Line of Track to be Constructed. Commencing at a point on the m~rth line of 24th Street distant 120 feet, more or less, east of the east line of R Street as shown on the offi- cial map of the City of'Bakersfield; thence southeasterly a distance of 85 feet, more or less, to a point in the south line of said 24th Street distant 139 feet, more or less, from said east line of R Street. That said permit and privilege is granted subject: (a) To such regulations and conditions as may be prescribed from time to time by the Council of the City of Bakersfield. (b) To the use of said railroad track for the transporta- tion of freight for hire. (c) That said railroad track must be laid to conform to the grade of the street over which it passes, and the work must be done to the satisfaction of the City Engineer of the City of Bakersfield, and must be kept and maintained in good condition and repair to the satisfaction of said City Engineer. (d) That it must be operated under Such restrictions as not to interfere with the use of said street by the public. (e) That this permit shall be revocable at the pleasure of the City Council of the City of Bakersfield, and (f) To the provisions of the Charter of the City of Bakersfield.
