HomeMy WebLinkAboutORD NO 579ORDINANCE NO.~___TNEWSERIES AN ORDINANCE GRANTING TO THE SOUTHERN PACIFIC COMPANY, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, A PERMIT TO LAY DOWN, CONSTRUCT, MAINTAIN AND OpERATE A RAILROAD TRACK OF STANDARD GAUGE ACROSS BAKER STREET, LOCATED IN THE CITY OF BAN~.RSFIELD, COUNTY OF KERN, STATE OF CALIFORNIA, IN CONNECTION WITH REMODEL- ING AND IMPROVING THE PASSENGER STATION BUILDING. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: SECTION 1. The Council of the City of Bakersfield hereby grants to the Southern Pacific Company, a corporation organized and incorporated under the laws of the State of Kentucky, its successors and assigns, a permit to lay down, construct, maintain and operate a railroad track of standard gauge across Baker Street, located in the City of Bakers- field, County of Kern, State of California, in connection with remodel- ing and improving the passenger station building, new track to be con- structed in lieu of two existing tracks to be removed, center line descriptions for all of which are as follows: Description of Center Line of Track to be Constructed. Beginnin at a point in the west line of Baker Street 1~4 feet north of the north line of Sumner Street; thence east 80 feet to a point in the east line of Baker Street 164 feet north of said north line of S,,mner Street. Descriptions of Center Lines of Tracks to be Removed. (1) Beginning at a point in the west line of Baker Street 1~3 feet north of the north line of Sumner Street; thence east 80 feet to a point in the east line of Baker Street 15B feet north of said north line of Sumner Street. (2) Beginning at a point in the west line of Baker Street 166 feet north of the north line of Sumner Street; thence east 80 feet to a point in the east line of Baker Street 166 feet north of said north line of Sumner Street. SECTION 2. That said permit and privilege is granted subject: (a) To such regulations and conditions as may be prescribed from time to time by the Council of the City of Bakersfield. (b) To the use of said railroad track for transportation for hire.' (c) That said railroad track must be laid to conform to the grade of the street over which it passes, and the work must be done to the satisfaction of the City Engineer of the City of Bakersfield, and must be kept and maintained in good condition and repair to the satisfaction of said City Engineer. (d) That it must be operated under such restrictions as not to interfere with the use of said street by the public. (e) That this permit shall be revocable at the pleasure of the City Council of the City of Bakersfield, and (f) To the provisions of the Charter of the City of Bakers- field.
