SECTION 1.
ORDINANCE N0. ~~ NEW SERIES
AN ORDINANCE REGULATING VACATIONS, SICK LEAVE
TI~, AND OTHER LEAVES OF ABSENCE FOR OFFICERS
ANDEMPLOYEES OF THE CITY OF BAKERSFIELD, AND
REPEALING ORDINANCE N0. 549 NEW SERIES AND
ORDINANCE N0. 572 NEW SERIES.
BE IT 0RDAiNED BY THE COUNCIL OF THE CITY OF BAKERSFIELD,
Every person who shall have been in the service of the City
of Bakersfield continuously for at least one year shall be allowed an
annual vacation of twelve working days on full pay. In computing
vacations every Saturday included shall be considered one-half work-
ing day. Annual vacations shall be taken during each calendar year
and shall not be cumulative except when specifically allowed by the
head of the department in which the person serves. All vacations
shall be taken at such time as shall be designated by the head of
the department in which the person entitled thereto is employed.
SECTION 2.
Every person, except members of the Fire Department, who
has held a permanent position in the service of the City of Bakers-
field for one year or more immediately preceding any illness or
injury, and is compelled to be absent from duty on account of such
illness or injury, other than injury arising out of or in the course
of his employment shall receive full compensation for the time lost
on account of such illness or injury, to the extent of one day for

injury leave exceed forty-eight working days on full pay. In computing
sick leave time each Saturday included shall be considered one-half
working day.
SECTION 3.
Every member of the Fire Department of the City of Bakers-
field who has held a permanent position therein for one year or more

immediately preceding any illness or injury, and is compelled to be
absent from duty on account of such illness or injury, other than
injury arising out of or in the course of his employment, shall
receive full compensation for the time lost on account of such
illness or injury, to the extent of seven workin~ shifts per year,
but in no case shall cumulated sick or injury leave exceed twenty-
eight working shifts.
SECTION 4.
Leaves of absence other than those provided for in
Sections 1, 2, 3 and 6 hereof may be granted as follows:.
(a) Leaves of absence not to exceed forty-eight (48) hours
duration may be granted to any officer or employee by the City Manager
for cause which he may deem good and sufficient.
(b) Time off to make up for overtime worked, or for extra
service rendered, shall not be considered as time lost nor as a leave
of absence, and may be granted at the discretion of department heads
or the City Manager.
(c) An emergency leave of absence may be granted to a head
of a department of the City Government by the City Manager, .for a
period of time not to extend past the next regular meeting of the City
Council~ provided, however, that only the first forty-eight (48)
hours of such leave may be with pay.
(d) A leave of absence without pay may be granted to any
department.head by the City Council, or by the City Manager with the
approval of the City Council.
(e) In the absence of the City Manager, an emergency leave
of absence may be granted to an officer or employee, by his or her
department head, not to exceed forty-eight (48) hours duration.
(f) A leave of absence without pay may be granted to an
officer or employee by his or her department head after such leave
has been approved by the City Manager.
(g) In computing the periods of time set forth and called

for in Sections 1, 2 and 3 of this ordinance, no credit shall be
given for periods of time during which leaves of absence without
pay have been granted.
(~) The City Council.may, in its discretion, upon due
cause shoE, give leaves of absence other than as provided for
herein, with or without pay.
SECTION ~.
Absence of any officer or employee of the City, excepting
Councilmen, from his office or employment, except as authorized or
otherwise provided for in this ordinance, shall be without pay or
compensation; and a deduction from the salary or wages of any officer
or employee shall be made for such unauthorized absence, which shall bear
the same relation to the total salary or wages for the month during
which suCh unauthorized absence occurs as the time lost by reason of
such unauthorized absence bears to the total working time in such month.
The head of each department shall furnish a report to the
City Auditor on the last working day of each month, specifying all time
lost by persons in his department during said month, and specifying the
reasons therefor and-how the same was authorized.
No warrant for salary or wages shall be drawn for payment
of any salary or wages in any department by the Auditor until such
report for the department shall have been filed in his office.
The City Auditor shall prepare and furnish the head of
each department with forms for such reports.
SECTION 6.
Leave of absence is hereby granted to any officer or
employee of the City of Bakersfield now or hereafter rendering
service in the armed forces of the State of California or of the
United States, including Reserve Officers' Training Corps, professional,
businessmen and other civilian military training camps, under State
or Federal orders, or instructions, whether by voluntary enlistment
or otherwise, for the period of such service. Should such officer

or employee remain on such duty or service under orders for periods
in excess of one year, written application to the Council of the City
of Bakersfield for such extension in each successive year shall be made
to the Council, and such leave shall be granted if it shall satisfactorily
appear to the Council that such person is still in such service in the
armed forces. In all cases such leave shall terminate when such
employee returns to duty with the City; provided, that such leave
shall not extend beyond ninety days after such officer or employee
is discharged or released from the armed forces. All such leaves of
absence shall be without pay except as otherwise provided by Charter
or Ordinance.
SECTION 7.
Ordinance No. ~49 New Series, Ordinance No. ~72 New Series,
and all other ordinances or parts of ordinances in conflict herewith
are hereby expressly repealed.
