HomeMy WebLinkAboutORD NO 610ENERGENCY ORDINANCE N0.~/O NEW SERIES AN ENERGENCY ORDINANCE FIXING AND DEFINING THE OBLIGATIONS OF THE BAKERSFIELD AND KERN IELECTRIC RAILWAY COMPANY UPON ABANDONNLENT OF ITS STREET RAILWAY LINE UPON BAKER STREET, 19TH STREET AND F STREET, IN THE CITY OF BAKERSFIELD, CALIFORNIA. WHEREAS, the City Council hereby declares that an emergency exists for the immediate preservation of the public property, safety and welfare of the inhabitants of the City of Bakersfield~ AND WHEREAS, the Bakersfield and Kern Electric Railway' Company has applied to the City of. Bakersfield for permission to abandon its remaining street car service now in use on the follow- ing described streets, to-wit: Baker Street, 19th Street and F Street, AND WHEREAS, it is the intention of said street car company to apply to the Railroad Commission of the State of California, for permission to abandon said street car service and to substitute there- for bus service on said streets in the City of Bakersfield, ANDWH~EREAS, it is believed to be advantageousto the City of Bakersfield that'said bus service be established in lieu of the / present street car service~ AND V~]EREAS, the Bakersfield and Kern Electric Railway Company may leave their rails in the streets to be resurfaced and covered over, or it may remove same.within six months from the time of discontinuance of the street car service, AND WHEREAS, it has been determined by the City Engineer that the cost to the City of Bakersfield of materials and labor in connection with the work of resurfacing those~ portions of said streets used by the Bakersfield and Kern Electric Railway Company as its right- of-waY~is the-sum-o~-six-thousa-nd~ one-hundnred .and~ t~o-dolla~s-and._~ .... fifty-nine cents ($6,102.~9), NOW, THEREFORE, BE IT 0RDAI~D BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: -1- SECTION 1. That the Bakersfield and Kern Electric Railway Company shall, upon the~abandonment of that certain line'of railway on Baker Street from the Southern Pacific Railway Tracks to 19th Street, on 19th Street'from Baker Street'~to F Street, and on F Street from 19th Street to 15th Street, at its own cost and expense, but without paYment~by said railway company to the City, remove from the streets of the City of Bakersfield all poles, wires and overhead trolleyl system used in connection with. the operation of said railway system to be abandoned; provided, however, that said railway company shall not remove any pole of such overhead trolley system to which any portion of the city fire alarm system or any police call box, or any other city-owned property or service is attached, nor shall said railway company remove any pole which is in use by any public utility. SECTION 2. If said Bakersfield and Kern Electric Railway'Company so elects it may remove all or part of the rails of said railway from the aforementioned streets of said City, and in that event said Bakersfield and Kern Electric Railway Company, within six months from the abandonment of said street car service, shall pay to the City Treasurer of the City of Bakersfield the estimated cost of resurfacing those portions of the said streets which have been used by the Bakersfield and Kern Electric Railway Company as its right,of-way, with the materials and to the extent required by the City Engineer of the City of Bakersfield, which cost has been found to be and has been fixed at six thousand, one hundred and two dollars and fifty-nine cents ('$6,102.~9), for the entire street railway line as above described. SECTIO~ ~.. - This ordinance is hereby declared to be an emergency measure within the meaning of Section 24 of the Charter of the City of Bakersfield, State of California, and necessary for the immediate preservation of the public property, safety and welfare of the inhabitants of the City of Bakersfield, and shall take effect immediately upon its passage. -2~ I HEREBY CERTIFY that the foregoing Emergency Ordinance was passed and adopted by the Council of the City of Bakersfield, at a regular meetingsthereof held on the/~day of January, 1942, by the following vote: City C erk of the Council of the City of Bakersfield-.
