HomeMy WebLinkAboutORD NO 615 E~RGENCY ORDINANCE NO. ~/'"'~'~EW SERIES AN E~RGENCY ORDINANCE PROHIBITING PERSONS FROM BEING UPON CERTAIN PORTIONS OF BUILD- INGS WITHIN THE CITY OF BAKERSFIELD, AND PROVIDING A PENALTY FOR VIOLATION HEREOF. WHEREAS, a dangerous condition has arisen by reason of the fact that certain persons are climbing upon roofs and window- sills to view street parades and other street demonstrations, thereby placing themselves in perilous positions, AND WH~_~REAS, extensive damage to walls and roofs has resulted from such acts by said persons, AND WHEREAS, the City Council hereby declares that an emergency exists for the immediate preservation of the public property, peace, safety and welfare, which requires the passage of an emergency ordinance prohibiting the foregoing, NOW, THEREFORE, BE IT ORDAII~D BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: SECTI0~ l_~. It shall be unlawful for any person or persons to climb upon, enter~ or be upon any roof, windowsill, or any other exterior portion of any building within the City of Bakersfield, which roof, windowsill or exterior portion of a building is not designed and intended for the use and accommodation of the public, without the permission or consent of the owner, agent or occupant of said building. SECTION 2__.. A violation of this ordinance shall be punishable by a fine not to exceed Fifty Dollars ($50.00), or by imprisonment in the County Jail for a period not exceeding thirty (30) days, or by both such fine and imprisonment. SECTIO~L. This ordinance is hereby declared to be an emergency measure within the meaning of Section 24 of the Charter of the City -1- of Bakersfi~td~ State of California~ and necessary for the immediate preservation of the public property~'peace~ safety and welfare~ and sha-ll take effect immediately upon its passage. ........... o0o ...........
