W~REAS~ the health~ safety and welfare of Zhe City of Bakers-
fmeld requires the passage of an emergency ordinance providing for the
separation Of tin cans from other rubbish~ regulating the burning of
refuse and· prohibiting the burning of garbage in the City of Bakersfield.
NOW~ TITEREFORE~ BE IT ORDAIB~D BY T~ COUNCIL OF Tile CITY OF
B~H(ERSFIELD, as follows:
SECTION 1.
That Subdivision (c) of Section 2 of Ordinance No. ~21 New
Series of the City of Bakersfield~ entitled "AN ORDINANCE REGULATING
T~] COLLECTION A}[D DISPOSAL OF REFUSE., GARBAGE AiD RUBBISH IN T~ CiTY
OF BAKERSFIELD~ FIXING RATES TO BE CHARGED FOR SUCH COLLECTION~ AD'THOR-

same is hereby amended to read as follows:
SECTION 2, Subdivision (c) Non-q_ombustible Rubbish:--It shall
be unlawful to keep~ accumulate or permit to be kept or accumulated
any n0n-~.ombustib!e rubb~"_H'as the same is defined in this Ordinance
unless the same be kept in a suitable receptacle within the meaning of
this 0rdinance; and it shall likewise be uXawful to place~ keep~ ac-
cumuiate or permit to be kept or accumulated any tin cans or tin scraps
of any kind in or with other non-combustible rubbish~ and all tin cans

of every kind shall be kept in a separate con'tainer~
-- separate, and
apart from other non-combu:stible rubbish. Such tin cans and
scraps as so kept and accumulated shall be placed in 'such separate,,'
container by the house-holder where his rubbish is required to be-]
placed by this Ordinance for collection by the contract agent
t~ned over and delivered at such place to the official contract agent
for collection at such times as may be prescribed bythe City Sanitarian
but not less than once each month. :
SECTION 2
That Section 9 of Ordinance No. %21 New Series~ be and ~e
same is hereby amended to read as follows:
SECTIO~ 9.. ~.rni.~n~ Refu~e.--It shall be m~lavful to burn or bury
garbage, as garbage is defined in this'0rdinance~ within the Cit~
Limits of the City of Bakersfield at any time; provided~ however~
that combustible rubbish~'as defined in this Ordinance~ may be burned
as provided for in Ordinance No. 339 New Series of the City of Bakers-
field.
SECTION 3
.This ordinance is hereby declared to be an emergency ordinance
uithin the'meaning of Section 2~ of the .Charter of the City of Bakers-
field~ State of California~ an~ necessary for the immediate preserva-
tion of the public peace~ safety and welfare~ and shall take effect
i~maediately.
