RAILWAY COMPANY MIGHT .REMOVE THE STREET CAR RAILS
OF ITS RAILWAY LINE ON PORTIONS 0F. BAi~_~R STREET,
19TH STREET AND F'STREET IN THE CITY OF BAKERS-
FIELD, CALIFORNIA.
WHEREAS~ on or about the 12th day of January, 1942,
Emergency Ordinance Number 610 New Series entitled "AN EI~RGENCY
ORDINANCE FIXING ARD DEFINING TkME OBLIGATIONS 0F~THE BAKERSFIELD
A~[D KERN ELECTRIC RAILWAY COMPANY UPON ABAI~DO~EEI~Ff OF ITS STREET
RAILWAY LINE UPON BAIqER STREET, 19TH STREET AND F STREET, IN THE
CITY OF BAtGERSFIELD, CALIFORNIA" was duly and' regularly enacted
by the Council of the City of Bakersfield,
AND WHEREAS, in the said ordinance it was provided that
the Bakersfield and Kern Electric Railway Company should pay to
the City of Bakersfield the sum of six thousand, one hundred and
two dollars and fifty-nine cents ($6,102.59), and might remove
from the streets therein designated its rails, within six (6)
months from and after the discontinuance of street car service,
which discontinuance took place on or about the 28th day of
February, 1942, and that said sum of money should be used by the
City of Bakersfield to defray the expenses of resurfacing said
streets,
AND ~[HEREAS, said sum of money has been paid to the City
of Bakersfield by the Bakersfield and Kern Electric Railway Company,
and it is deemed by the Council of the City of Bakersfield to be
for. the best interests of said City and the inhabitants thereof,
AND WHEREAS, the City Council hereby declares that an
emergency exists for the immediate preservation of the public
property, safety and welfare of the inhabitants of the City of
Baker s field,
NOW, THF=.REFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF BAtCERSF!ELD,-as follows:
SECTION 1.
That the Bakersfield and Kern Electric Railway Company
shall have to and including the 30th day of November, 1942, to
remove or cause to be removed all of the rails belonging to said
company, and presently located on portions of Baker Street, 19th
/Street, and F Street, in the City of Bakersfield~ State of Calif-
ornia.
SECTION 2.
In the event that said company does not remove, or cause
to be removed, the rails upon the portions of said streets
enumerated in Section I above, then the City of Bakersfield shall
have, and hereby reserves the right to cover said rails and to re-
surface said streets in any manner deemed proper by said City; and
in that event the Bakersfield and Kern Electric Railway Company
shall have no further right to remove any of said rails that have
not been removed by the 30th day of November, 1942.
SECTION 3.
This ordinance is hereby declared to be an emergency
measure within the meaning of Section 24 of the Charter of the
City of Bakersfield, State of California, and necessary for the
immediate preservation of the public property, safety and welfare
of the inhabitants of the City of Bakersfield, and shall take effect
immediately upon its passage

I HEREBY CERTIFY that the foregoing Emergency Ordinance
was passed and adopted by the Council of the City of Bakersfield,
