wn)2u~AS, the health, safety and welfare of the inhabitants of
the City of Bakersfield requires the passage of an emergency ordinance
prohibiting persons under the age of eighteen (18) years from being
upon the public streets of the City of B_~ersfield or in places of
amusement or entertainment or in other public places in said City
between the hours of 10 o 'clock P. M., and ~ o'clock A. M., of any day,
NOW, THEREFOHE, BE IT ORDAII~ED BY THE COUNCIL OF THE CITY OF
BAF~.RSFIELD, as follows:
SECTION 1.
It shall be unlawful for any person under the age of eighteen
(18) years to loiter upon the streets in the City of Bakersfield, or
be in places of amusement or entertainment or in other public places
in said City, between the hours of 10 o 'clock P. M., and ~ o 'clock
A. M., of any day, unless such person is accompanied by a parent,
guardian or other adult person having control or charge of such person
under the age of eighteen (18) years; or unless such person under the
age of eighteen (18) years shall have gone to a place of entertainment
or amusement, other than one at which liquor is sold or served, prior
to 8 o 'clock P. M., where a regular program or eveni~g's entertainment
shall have commenced or been arranged for the occasion to commence
prior to 8 o 'clock P. M., and shall have held over or been continued
beyond 10 o 'clock P. M., or such person shall have left a place of
employment or social call after 10 o'clock P. M., and such person is
thereafter returning directly to his home or place of residence not
later than 12 o'clock m~dnight.
SECTIOIq 2.
It shall be unlawful for any parent, guardian or any adult'
le
person havin~ the control~ custody or charge of any. person under the
age of eighteen (18) years~ to permit~ allow or let said person loiter
upon the streets of the City of Bakersfield 6r in places of amusement
or entertainment or in other public places in .said City between 'the
hours of 10 o 'clock P. M. ~ and ~ o 'clock A.-M. ~ of ~_n~v day~ unless
said minor is lawfully upon said streets or public places or places
/of amusement as permitted by the preceding section of this ordinance.
SECTION 3-
· violation of this ordinance shell be punishable for the first
o~fense by a fine not to exceed Ten ($10.00) Dollars or by imprison-
ment in the County =all not exceeding five (g) days. For each
subsequent offense~ by a fine of not less than Ten ($10.00) Dollars
or more than Fifty ($~0.00) Dollars~ or imprisonment in the County ~ail
of not less than five (~) days or not more than twenty-five (2~) days~
or by both such fine and imprisonment.
SECTION 4.
Emergency Ordinance No. 641 and all other ordinances or parts
of ordinances in conflict herewith are hereby expressly repealed.
SECTION ~.
This ordinance is hereby declared to be an emergency ordinance
within the meaning of Section 24 of the Charter of the City of Bakers-
field~ State of California~ and necessary for the immediate preservation
of the public healthy safety and welfare~ ~n~d shall take effect im-
mediately.
The facts constituting such emergency are as' follows:
That there is a growiD~ tendency amoD4 persons under the age of
eighteen (18) years to be upon the streets and to frequent public
places and places of amusement in said City at late hours of the night
and at early hours in the morning to the detriment of the morels~ safety
and welfare of said persons and the inhabitants of the City of Bakersfield.

passed a~ adopted by the Council of the City of Bakersfield at a
regular meeting thereof held oh the 10th day of May, 1943, by the
following vote:
