REPEALING OHDINANCE N0.3~8 ANEW SERIES
OF THE CITY OF BAKERSFIELD, CALIFORNIA.
V~tEBEAS, the health, safe.ty and welfare of the inhabitants
of the City of Bakersfield requires the passage of an ordinance
regulating the burning of refuse in the City of Bakersfield.
NO~, THEREFORE, BE IT 0RDAII~ED BY THE COUNCIL OF THE CITY OF
BAKERSi,'IELD, as follows:
" SECTION 1.
That Section 20 of Ordinance No. ~9, New Series of the City

be and the same is hereby amended to read as follows, to-wit: .'.
Section 20. It shall be unlawful for any person or persons
to burn straw, lumber, trash, rubbish, leaves or other combustible
material, in any public street or alley in the City of Bakersfield at
any time. Strays, lumber, trash, rubbish, leaves or other combustible
material may be burned on any lot or premises outside the prescribed
fire limits of the City of Bakersfield, between the hours of 6:00 .A.M.,
and 6:00 P.M., provided that no such combustible material shall be burned
within 1~ feet of any fence or building; and no such combustible
material shall be burned except v~hen reasonable precautions shall be
taken to prevent the spread of such fire; provided, however, the
Fire I'-~arshal of the City of Bakersfield~ may, in his discretion, issue
written permits for the burning of such straw, lumber, trash, rubbish,
leaves or other combustible materials at hours other than those above

SECTION 3.
This ordinance is hereby declared to be an emergency. measure
within the meaning of Section 24 of the Charter of the City of
'Bakersfield, State of California, and necessary for the immediate
preservation of the public property, safety and welfare, and shall
take effect immediately upon its passage.
