AN ORDINANCE APPROVING .AI. Ix~.XATION OF A
PARC?~L OF UNInhABITED TEBRITORY TO THE
CITY OF BAI.~CRSFI~.'.D, CALIFORNIA.
%~tlEAS, a petition was filed with the Council of the City
of Bakersfield on the 17th day of December, 1945, requesting that
certain uninhabited territory therein described be annexed and
included within the incorporated limits of the City of Bakersfield~
and
~tEREAS, said petition was signed by the o?mers of not less
than one-fourth of the area of the land in such territory, and
representing not less than one-fourth of the assessed value of such
territory according to the last preceding equalized assessment roll
of the County of Xern; and
~j~REAS, the Council of the City of Bakersfield did on the
26th day of December, 194~, pass a resolution in compliance with the
provisions of the Uninhabited Territory .Act of 1939, Statutes of
1939, Chapter 297, specifically describing the boundaries of the
territory so proposed to be annexed to the City of Bakersfield, and
designating such territory by an appropriate identification, and
setting Monday, the 14th day of January, 1946, at the hour of 8 o'clock
P. M., at the Council Chambers in the City Hall in the City of Bakers-
field, State of California, as the day, hour and place when and where
any person owning real property within such territory so proposed
to be annexed and having any objections to the proposed annexation
may appear before the legislative body and show cause why such
territory should not be so annexed; and
~'~HEREAS, said resolution was published for at least once a
week for two successive weeks prior to said hearing in the The
Bakersfield Californian, a newspaper of general circulation published
in the City of Bakersfield, the municipal corporation to which it
is proposed to annex such territory; and
%~FA~EAS, no written protests were filed against the proposed
annexation by any owner of property within the territory proposed
to be annexed.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
BAI~RSFImT.D, as follows:
SECTION 1.
That the Council of the City of Bakersfield hereby approves
the annexation and inclusion within the incorporated limits of the
City of Bakersfield, that certain uninhabited territory designated
as a parcel of land lying on the North of the southerly line of
Bernard Street and East of the proposed extension of l~agnolia Street,
being more specifically described as follows:
A portion of Lots ~6 and 35 and Cypress .Avenue and
Lemon .Avenue vacated adjoining same in the Ardizzi-
Olcese Company Annex to Kern City, in the County of
Kern, State o~ California, as per Map recorded July 16,
1907, in Book 1, Page 102 of ~Aaps, in the office of
the County Recorder of said County, described as follows:
Starting at the intersection of the Northerly line of
Bernard Street with the Northerly extension of the
Westerly line of .Alta Vista Drive, as said streets
are shown on the Nap of Alta Vista Tract recorded
January 29~ 1923, in Book 3, Pages 71 and 72 Of ~aps,
in the office of the County Recorder of said County;
thence North 89' 59' 45" ~jest along said Northerl~
line of Bernard Street 476.7~ feet to the true point
of beginning; thence continuing North 89~ 59' ¢5" l~st
along said Northerly line 195.00 feet; thence North
0· 00' 15" East 60.99 feet to the be inning of a curve,
whence the radius point bears South ~ '

2S0.00 feet; thence along said curve 207.05 feet to
the end of same, whence the radius point bears south

of beginning. Together with all that portion of
Bernard Street lying immediately South of the above
described property.

and adopted by the Council of the City of Bakersfields at a
regular meeting thereof held on the 14th day of January, 1946,
by the following vote:
