This ordinsmce shall constitute the Fire Prevention Code of the City of Bakersfield ond may be cited as such. The Fire Prevention Code establishes a Bureau of Fire Prevention which shall enforce the provisions of this code. The Fire Prevention Code contemplates the general ~pervls~on of contortions and equxpment which aid in the control of fire, conditions constituting fire hazards or danger to life or property and the abatement or minimizing of such fire hazards or dangerous conditions in all structures, alleys or yards with- in the corporate limits of the City of Bakersfield. Section 109. "BUILDI[iG CODE" or"ZONING CODE". ¥,~ere~ver "Building Code" or "Zoning Code" are referred to in this ordinance they shall mean the Uniform Building Code or the Zoning Code of the City of Bakersfield. Section 110. '"CHIEF OF THE FIRE DEP~;RT[~NT" shall mean the head of the Fire Department or aH~i~'~uiarly authorized representative. Section 111. "COI~BUSTIBLE FIBRES". The term combustible fibres shall include Cotton, sida[, henequen, ixtle, jute, hemp, tow, cocoa fibre, oakum, baled waste, kapok, hay, straw, spanish moss and excelsior. Section 112. "CO~BUSTIBLE'[?~ATERIAL" shall mean material ~,~hich will ignite at a tempe~rature of 1000 degrees Fahrenheit or less. Section 113. (a) "CO[~USTIBLE RUBBISH" shall include and mean paper, psste-~ board, carpets, rags, clothing, books, boots, shoes, straw, packing barrels, boxes, oily rags, oily w~ste, furniture, sawdust, shavings and other similar articles that will cinerate through contact with flames of ordinary tempera~ tu~e. (b) "ASIIES" shall include and mean the residue of materials burned. Section .~14. "CONSTRUCTION" shall mean construction in whole or in part as required by. the Uniform Building .Code adopted by the City of Bakersfield. Section 115~. "CONVALESCENT HO~" shall mean a privately operated establishment devoted to the care of persons during the recuperative stage of an illness~.~ or in ~¥hich persons may be cared for during an illness. This definition shall no-t ~ !. l~e construed to imply or permit the practi¢'e of general hospital func- tions such as major surgical operations, or the rendering of service beyond nursing care. Section I1S. "DI~TRICT" shall mean any zone or zones as established by Ordinance of the City of Bakersf~elao Section 117. "DISTRIBUTING PL~NT" shall mean ~any location where fls~mable liquids are stored in bulk for resale or re-distribution. Section 118. "DRA~¥ING OFF" shall mean the ~?emoval of any flammable liquid from any container when flammable vapors escape during such removal. Section 119. "DRUL~" shall me-an any closed container having a capacity not less than five ~allons nor more than sixty-one gallons. Section 120. "ELECTRICAL EQUIP~AENT" s~all mean any motor, lig t, generator, wir].ng, switch or other appliance or device which uses, controls or is opera, ted ~ .electricit~, and s~a. ll ~e installed in accordance to the~ National Electrical Code. ~ Section 121. "EXPLOSION PROOF" shall mean free from the hazard of explosion as determined .by the Fire Chief. Equipment bearing the label of approval of the Underwriters Laboratories, Inc., for use in a hazardous area will be acceptable. Section 12~."EXPLOSIVE OR EXPLOSIVES" shall mean and include any che.mical compound or mechanical mixture, that is commonly used~ or intended for the purpose of producing a~ explosion, that contains any oxidizing and combust- ible units~ or other ingredients, in such pro.portion;, quantities or packing that an ignition by fire, by friction~ or concussion, by percussion or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the re~sultant gaseous pressures are capable of producing destructive effects on contiguous objects or of destroy- ing life or limb. Section 123. "FIRE DISTRICT" shall mean those fire districts in the City of Bakersfield established by ordinance. Section 124."FIRE DOOR" shall mean a type of fire-resistive door as defined in the building code. SeCtion 125. "FIRE RESISTIVE CONSTRUCTION" shall mean that type of construct- ion require~d by the Building Code of the City of Bakersfield. Section 126. "FL~2~iABLE LIQUID" shall be classified in accordance with the standards promulgated by the National Board of Fire Underwriters and/or the National Fire Protective Association. Section 127. "HO~E FOR THE AGED" shall be deemed to mean an establishment devoted to the general care and maintenance of old people. ~uch establish- ments may also suppty inmates with the type of service rendered by the con- valescent home. ~s?~all me~m any incinerator construct- Section 128. "INCINERATOR" (a)~'Ciass one ed so as to be a part of any building or as an independent structure covering a ground area of more than 25 sq. ft. (b) "Class two'~shall mean any incinerator other than a"class once'incinerator. Section 129. "JOBBERS PLANT" shall mean any premises where flammable liquids are sold at wholesale. Sect-io~ 130. "ID~DING R __ .~mu any system of piping ma~ntazned a~d use~ for transferring flamm~Bie liquids from pipe lines or tanks to vehicles for wholes.~le distribution. ~ ~ ~ ~ Section 131. "~NUFACTURING PLiaNT" shall mean any location where any flammable liquid, other than in a sealed container~is handled or used in any manufactur- ing process. Section 132. "NURSERY" shall mean an establishment where children under 6 years of age are kept during the daytime while parent or parents are at work or otherwise engaged or when 4 or more children under 6 years of age are lb'al.genii at a stipulated rate of pay. Such an establishment may be privately operated and supported by fees charged for the service, or it may be an establishment owned and operated by the municipality. Section 133.' "PERSON" shall mean any individual, firm, corporation, company, association~partnership, employee or the agent of any of the aforesaid. Section 132+. "PORTABLE" shall mean movable, or not attached to real property. Section 135. "PROPER VENTILATION" or. '!PROPERLY VENTILATED" or "PROPERLY VENTED" shall mean ventilation, either natural or artificially forced, that will cause the space to be ventilated to be free from combustible or explosive'?apors or gases. Section 136. "PUBLIC GARAGE" shall mean any place where motor vehicles are sold, repaired, cleaned, serviced, painted, parked, kept, stored or rented as, or in connection with a business enterprise. Section 137. "PYROTECHNICS" shall mean any sparkler, squib, rocket, fire- cracker, roman candle, signal lights, railroad track torpedo, flashlight compositian, fireworks or other de.vices or composition used to obtain visible or audible pyrotechnic display, and shall include fire ballons of a type which have burning material of any kind attached thereto. Section 138. "PYROXYLIN PLASTIC" shall mean and include any plastic substance, material or compound, other than nitrocellulose film as provided for in the film storage regulati6ns, having soluble cotton or similar nitrocellulose as a base, including celluloid, fiberloid, pyralin, viscoloid, zylonite and and similar.products~, materials, and compounds by whatever name know, m, when in the form of blocks, slabs, sheets, tubes or fabricated shapes. Section 139. "PLaiCE' Off PUBLIC ~SSE~LAGE" shall mean any building, portion of a building, structure or tent in which seventy five (75) or more people may gather for any purpose whatsoever. Se~,t.ion~l%0. "REFUSE" shall mean.all rubbish, garbage as hereinafte~ def'~ned, leavings, waste ~aper, fiber, rags, trash, a~i~es, lawn trimmings, tree and shrubbery~tri~-aings, leaves, debris~ and all worthless, useless, unnsed,~ rejected and cast-off materials produced by and as the result of human habitation and the trm~saction of business within the City, excepting dead animals. Section 141. "B~,TAIL STORE" shall mean any location, other than an auto- mobile service station or public garage, where any flammable liquid is sold directly to the consumer. Section 142. "S.,~ETY CONTAINER" shall mean any container corked, capped or .otherwise closed so that neither liquids nor vapors can escape therefrom. Section 143. "SEAl.ED CONTAINER" shall mean any container corked, capped or otherwise closed so that neither liquids nor vapors cm~ escape therefrom. Section 144. "S~IALL ~JR~,~ ~/I[./~UNITIION'! shall mean any shotgun, rifle, pistol or revolver cartridges. Section 145. "SPRAY BOOTH" shall mean any space enclosed on at least three sides within a room or building in which such space flammable liquids are applied by a pressure spray method. Section 146. "STORE or STORAGE" shall mean to have present or the presence of a~.y flammable liquid on any premises. (a~)~ "~JS0~'E GROUND STORAGE" ~ shall mean storage other than underground storage. (b) "'INSIDE STORAGE" shall mean' Storage within any building. (c) "OUTSIDE STORAGE"SHall mean storage other than inside storage or underground storage. (d) "UNDERGROUND STOR~GE" shall mean storage in tanks buried underground. Section 147. "TANK" shall mean any non-portable container with a capacity in excess of sixty-one gallons. Section 148. "TENTS" shall mean any structure or enclosure cons2ructeddof canvas or other combustible fabric, or of any other material which is ..more conducive to the rapid spread of fire the~ one inch nominal thiclaness of Oregon 'Pine wood. Sec.tion "TANK TRUCKo, TANK ?RAIi',~,RS AND TANK SE,~I-~RAILER,~. ustd for the transportaion of flammable liquids, shall mean the following: (a-) "T['~NK TRUCK" shall mean.~any vehicle' used for the transportaien of~ fla.,~mable h luzes, and which for such purpose is provided with a .tank or tanks mounted on the frame or chassis of such vehicle. · ~, . raotor power (b) "TANK TRAILER" shall mean any vehicle, w~t:.out its o~e but drawn bY a motor'vehicle, used for the transportation of flammable .~ .... ~...,.',~l~qulas, and which for such purpose is prowaed with a tank or tanks mounted thereon. (c) "TANK. SE~iI-TRAILER:" shall mean any 9..~hicle of the trailer type hav- ing One or more axles and two or more wheels, so designed and used in conjunction with a motor vehicle that some part of its o~:m weight and that of its own load rests upon or is carried by another vehicle; used for the transportation of fla:mmable liquids and for which purpose is provided with a tank or tanks mounted thereon. Section 150. "USE" shall mean mix, process, Spray, dip, or apply. Section 151. "VAPOR PROOF'' shall mea, n free from the hazard of ignited vapor or gas as determined by the Chief." Equipment bearing the label of approval of the Unaer~r~ter's Laboratories, Inc. for use in a hazardous area will be acceptable. Section 152. "ZONE"shall mean any zone established by the zoning code of the City of Bakersfield. Section ] ~."BUFFING I'~ACHINE" shall mean any machine mechanically operated gn~d Used' fn the construction or repair of Automobile tires, Shoes, ,tand,. etc. iLD~INISTRATION Section 2Ol, The chief of the Fire~ Department shall detail, any officer or member of the Fire Department as the'head of the~F~re Prevention BUreau who shall be knawn .as the Fire Narshal, ~ne Chief of the Fire .Department .shall detail such number of members of the Fire Department -aS from time to time Shall be deemed necessary to -enforce the provisions of this code,- Sect{on 202. DUTIES A~D POWERS OF THE OFFICERS. It shall be the duty of the Fire Marshal to enforce the provisions of this code and the laws and r~gulations of the State of California. The Fire ~arshal, and his assist- ants, shall have the powers of a police officer of the City of Bakersfield. Section 203. RIGHT TO ENTER BUILDINGS. The Chief of the Fire Department, or any member of the Fire ~epart.~ent, shall have t~e right and authority to enter any building, structure, or premises within the corporate limits of the City of Bake_sI~el~ for the purpose of making inspections or investigat- ions at all reasonable hours; provided, that except in cases of emergency, the right and authority conferred by this section shall not apply to the entry of a~private residence unless written notice is served on the occupant thereof. Such written notice shall contain a statement of the time that inspection will be made and shall also contain a statement of the purpose of .such inspection or investigation. Section 204. INVESTIGATION OF FIPuES. The Chief of the Fire Department shall investigate promptly the cause, origin and circumstances of each smd every fire occuring in the city by which property has been destroyed or damaged, and if it appears to the officer maling investigation that such fire is of suspicious origin, he shall then take immediate charge of the physica% evidence and notify the proper authorities designated by law to make the investigation of such matters and shall further cooperate with them in the collecting of the evidence and in the prosecution of the case. Section 205. ELI~INATION OF HAZARDS. Whenever any member of the Fire Department shall find in any b~lc~ng, or upon any premises or other place combustible or explosive material or dangerous accumulations of rubbish or unneccessary accumulation of waste paper, boxes, or highly flammable sub- stances likely to burn and which is so situated as to endanger property or shall find obstacles toor on fire escapes, stairs, passageways, doors or windows likely to interfere with the.operations of the Fire Department or 'the egress of occupants in case of fire, or shall find any violations of this code, he shall notify the Bureau of Fire Prevention, which shall order in writing that the same be remedied or removed within a specified time. This order shall be complied with by the o~er or occupant of such premises or buildings within the time specified in said order. Section. 2d5' (a) BOARD OF EX~J~iNERS~ ~'~D APPEALS In order to determine the suitability of alternate materials and types of construction and to provide for reasonable interpretaions of the provisions Of this Ordinance, there shall be and is hereby created'a Board of E~aminers and Appeals, consisting of five members, who are qualified by exp.erience and training to pass upon matters pertaining to Fire Prevention. The Fire Chief shall be an eX-officio member and shall act'as Secretary to shall be appointed by the the Boa.r~ Th~. Boar~ of,Examine~s and~oeals ]a~~~ The Board shall adopt reason- able. rules and regulations xor conauct~ng ~ts investigations and shall render all decisions and findings in writing to the Fire Chief with a duplicate copy to.the appelant and may recommend to the City Council such new~legi21ation as is consistent therewith.. 'Provided, however, that the authority and powers o£ the Board of Examiners and Appeals shall not extend to the. State Laws referred to herein or to provisions o£ this Ordinance pertaining to Public Assemblsge or Public Safety. ~ (a,) I~E~THOD O~AL. (b) Each premise or structure, except private residence in the o~tly~ng districts at least twice a year smd each building or premise, except private dwellings in the closely built up portions of the city at least four times each year for the purpose of ascertaining ~d causing to be corrected any conditions 'liable to cause fire or ~y violations of the provisions or intent of ~y ordin~ce of the ci~yaffecting the fire hazard. Section 207. RECORDS. The Chief of the Fire Department shall keep, in the office of ~he Bureau of Fire Prevention, a record of all fires ~d of all the facts concerning the same, including statist~6s~as to the extent of such fires ~d tile .damage caused thereby, ~d whether such losses were covered by insurance, ~d if so, ~n what amo~t. Such records shall be made daily from the reports made by the Inspectors ~der the provisions of this 0rd- '~ffn~.nce. All~ such records shall be public. ~ tzon 2~8.~Rrs. Thes~ reports shall contain all ~roce~dings under this ordinance, with such statistics as the Chief of the Fire Department may wish to include therein. The Chief of the Fire Departmemt sh~ll also recommend any amendments to %he ordinances which, in his judgment, shall be desirable. Section 209. S~ETY IN ~ANDLIN~ OF D~GEROUS ~r~RI~L~. The intent of this ordinance is to safeguard and restrict the storage, .handling and use of dangerous and hazardous materials to a reasonable degree with respect to injury to persons and destruction of property. Installation, construction and safeguards shall be provided in a standard, modern and approved manner. Compliance with Standards of the ~ational Board of Fire Underwriters shall be prima facie evidence of such approved manner. The Fire ~arshal shall .~maintain a public file of the Standardsof the National Boardof Fire Under- writers, which shall be deemed as advisory requirements to this ordinance insofar as Lhey can be applied to each particular installation for which a permit is required. ~' The Chief of the Fire Department shall have power to modify any of the provisions of this ordinance upon application in writing by the o~mer or lessee,-or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of this ordinance, provided tn~t the spirit of tn~ ordinance shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Chief of the Fire Department shall be entered upon the records of the department and a signed copy shall be furnished the applicant. Section 210. PER~ITS AND CERTIFICATES OF APPROVAL. The Chief of the Fire Department or any officer or member of the Fire'Department designated by the Chief of the Fire Department, is hereby authorized and empowered to issue any written permit or certificate of approval required by this code, unless otherwise required by the Building Code. Section 21~[ INSPECTION PRIOR TO ISSUANCE OF PERI, ITS. Before permits may be issued, the Fire ~arshal, or his assistants, shall inspect and approve the receptacles, vehicles, buildings, appliances, installations, equipment or storage places to be used. Section 212. APPLICATION FOR PER~iITS. Ail applications for permits required by this ordinance shall be made 'to the Bureau of Fire Prevention in such form and detail as it shall prescribe. Section 213. PERIOD OF PER~ITS.~ Every permit granted by the Bureau of Fire Prevention ~mder the provisions of this ordinance shall be for such period as the Fire ~arshal may determine. However such permits sh~ll not be trans- ferable. Such permit must at all times be kept on the premises designated ~he~i~ and shall at all times be subject to inspection by any officer of the Fire Department or Police Department. Sect{on 2~4.. REV©CA~'~N PERi, ITS. The' Chief ~hall .revoke. anytperffi]t issued .und~ qh~ terms of this chapter when h~' finds either: (a) That said permit is being used by ~y person other than the person ~. to vhom it was issued; ~ ~. ~ ~ (b) That the conditions or limitations set forth in said,permit have been violated; or (c) That violations set forth in any written notice served upon a permittee by the Chieff have not been corrected within the time requ[r- . ed 'by said notice; or ., .'(d) That said permit is being used for any premises or location other than that for which it was issued. $eqtion 215. BUI~ING PERMITS. ~enever the Building Inspector has reason to believe that ~y building, plumbing or electrical permit is to be issued for any premises for which a permit is required under this Chapter, or such Permit will involve a change of occupancy, installation of fire prevention or fire extinguishing apparatus, storage of volatile or ffla~mable liquids or installation of exit facilities, he shall forward a copy of the application fOr such building, plumbing or electrical permit to the Chief of the Fire Department within twenty four hours of the receipt thereof. The Chief of the Fire Department shall within forty eight (48) hours certify his approval or denial in writing to the Building Inspector. Section 216. ~QUIRED NU~f~ER OF PER~,~ITS. One permit only shall be required by retail establishments dealing in, or manufacturing plants using, two or more fla~able, combustible or explosive materials to be kept in the estab- lishment at anyone time. Section 217. Section 303. ROOM OR SEATING C~ACITY. The room or seating capacity off. any piece of public assembl~oe snail be in accordance with the requirements and deffinitions of the build~ng code. Section 304. REQUIE~D 'rYPES OF CONSTRUCTION. Types of construction as required for all places of public assemblage, such as schools, theatres, dance halls etc., shall be in accordance with requirements off pertinent chapters ~d sect- ions off the building code. Section 305. FL~PROOFING OF DRIES, DECORATIONS AND SCENERY. The flame- prooffing of drapes, decorations, scenery or other ffla~maole maoer~als in places of public assemblage shall be as required by pertinent sections of the Health ~d Safety code off the State of Califfornia, rules and regulations of the State Fire ~arshal ~d pertinent sections off the Uniform building Code, or as the Chief-of the f'ire Department may order amd direct. Section 306. FIRE EXITS. No person shall at any time place an encumbrance of any kind whatsoever before or upon any fire escape, balcony or ladder intended as a means off escape from fire. It shall be the duty off every member of the fire department who shall discover ~y fire escapes encumbered in ~y memner to forthwith report to the Bureau off Fire Prevention and the said Bureau shall i~ediately notiffy the owner and the tenant to remove such enc umbr anc e. at' Required exit ways shall be kept ade'quately lighted all times when the building served thereby is occupied. Section 308. ~TERNITY HO~S, HOSPITALS, CHILDRENS' HO[~ES, CONV~[~ESCENT OR REST HO~AE~, OLD PEOPLES' HOlliES, PRIVATE [~ENTAL INSTITUTIONS, REQgIRE~E~ FOR Housing exits, electric wiring, first aid appliances and housekeeping for such occupancies shall not be less than that required by the building code and State laws or published regulations of the State Fire Marshal. Section 309. STANDING IN PASSAGE1.~Y~. It shall be unlawful for any person, except a policeman, fireman or employee to remain standing in any aisle passageway or stairway of any theatre or other place of public assemblage, while such place in open to the public. Section 310. PLACING OF OBSTRUCTIONS PROHIBITED. It shall be unlawful for any person to 'obstruct any aisle, passageway, corridor or stairway of say church, assembly hall, lodge hall, theatre or other public building within the corporate limits of the City of ~a~ers~ez , used for the purpose of worship, instruction, entertainment or public assemblages, by placing therein any chair, settee, camp stool or Other obstruction during or preparatory to anY service, performance, exhibition, lecture,' concert, ball or other public gathering. Section 311.PER[~ITTING OBSTRUCTIONS, VIOL~_TiO~. It shall be unlawful for any lessee, manager, o~er, or person[%harge of any church, assembly hall, lodge hall, theatre or other public building within said city to allow or permit any aisle, passageway, corridor or stai~rway to be obstructed or blocked ~n any manner except as provided in Section 309 of this code. Section 312. WHEELi CH~IRS, ~OVA23LE OBJECTS PROHIBITED. It shall be unlawful to place, cause or permit to be placed, any wheel chair or any readily movable object in 'say foyer, lobby, or entrance of any building used by any occupancy as provided in Sections 310 and 311 of this code. Section 313. LOCKED DOORS zROHIBITmD. It shall be unlawful for the lessee, manager, owner, or person in charge of any church, assembly hall, lodge hall, theatre, or other public building within said city, to permit any exit door to be locked or fastened immediately preceding, during or immediately after any service, performance, lecture exh~o~t~ n, concer~, ball, or other public gathering. 12. ~S.~c, tip~.314.. S~v~O~KING. It shari be %nlawful ~or any pers. on to smoke any cigar, pipe, or cigarette, or tb smoke or burn tobacco in any form in any theatre, o.~rv~oyifl~?.~cture theatre except' in open air theatres, and except- lng, also,in the retiring rooms, s~oking rooms, balconies, and galteries~ of tNpe~11~'~h~tres~or in any. other place where sig~s containing the words "NO S[~OKING" have been posted pursuant to an order of the Chief of the Fire Department, made as provided herein. The Chief of the Fire Department shall order such signs to ]oe erected in any place of public assemblage where in his opinion smoking would constitute a menace to life or property. This section shall not be deemed to make it unlawful for a performer to smoke upon the stage during and as a part of any theatrical production, o~ for any person to smoke in smoking rooms designated as such and approved by the Chief of the Department. It shall be unlawful for .any person, firm or corporation owning, managing or controlling any theatre, or any 9ther place of public assemblage where smoking is prohibited, to, allow or permit such smoking. It shall be unlawful for any person to ignite, place or permit to remain ignited 'in any enclosure or room in which any moving picture machine is operated any open fize, or a~y cigar, cigarette or pipe. Section 315. TENTS, in Fire Districts. It shall be unlawful for any person to erect, maintain or occupy any tent, canvas house or movable structure of any kind whatsoever, within the limits of Fire Districts number ]~ 2, or 3 in the City of Bakersfield as the same are now fixed and may be hereafter fixed within the City of Bakersfield, without first securing a written permit from the City 2anager of the City of Bakersfield to so erect, maintai: or occupy. Provided that no permit shall be issued by said City Manager for 'a period ~'t to exceed 15 days. Provided, also that no tent, canvas house or movable structure, of any kind, shall be erected, maintained or occupied within the limits of Fire Districts number 1, 2, or 3 as the same are fixed or may hereafter be fixed, except that the said tent, canvas house or movable structure be erected, maintained or accupied for the purpose of holding ezd~ibitions, public speaking, religious gathering or Chatauqua meetings or other public gatherings. Provided, further, that no aforementioned permit shall be issued until the Fire Chief shall have certified in writing to the City ~anager that' such tent has complied with fire resiStive tests and other requirements which shall in no part be less exacting thah pertinent State Laws or Regulations of the State Fire ~,larshal. ~ec%~onc 316.- ..--LA PROOFING. All combust~le materials, fabrics and woodworm used as draperies or scenery on a stage, and all draperies in the assembly portion~of Gr~oup A,B,C, Division .! and 2 occupancies shall be made flame-p~oof to such 'an eXtent that ~vhen contabt~itb~ a Bunsen burner or gas flame t[~ey shall not show signs o5' fire, glow or smoldering nor will they communicate flame. The materials to beflam~-prooi shall be impregnated and shall not be sprayed except as permitted by pertinent chapters and sections o5. the Building Code. PnRT IV REQUIRE~[ENTS PERTAINING TO FLAVOr, ABLE LIQUIDS. Section 401. INSTALLATION & CONTAINERS FOR STORAGE. The installation of containers for storage and handling of flammable liquids shall be in accordance with the "Standards of the National Board of Fire Underwriters for the Install- ation of Containers for storing and Handling of Fla~able Liquids", edition of 1938 and all subsequent editions and mmendments. Also to be in accordance with the regulations as found in the "Suggested Ordinance", regulating the use, Handling, Storage and Sale of F!a.~aable Liquids and the products thereof as adopted by the National Fire Protection Association in 1935 and all subsequent. editions and amendments thereto. Section 402. OIL' BURNING EQUIP~[ENT. The installation for Oil Burning Equipment shall be in accordance with the "Standards of the National Board of Fire Under- writers for the Installation of Oil Burning Equipment" edition of April .1938 and all subsequent editions and amendments. ~ection 7+03. PAINT SPRAY BOOTHS. The installation and maintenance of paint spraying booths shall be in accordance with the "Standards of the National Board of Fire Underwriters for paint spraying and spraying booths using flammable liqu{ds", edition of 1938 and all subsequent editions and amendments, except as detailed herein. Section 404. LIQUEFIED PETROLEU~ GASES. The design, installation and construct- ion of containers and pertinent equipment for the storage and handling of liquefied petroleum gases shall be in accordance with the pertinent standards promulgated by the National Board of Fire Underwri%ers edition of 197+4 and all subsequent editions and amendments thereto. Section 7+05. DRY CLEANING PLANTS. Permits for construction and operation of Dry Cleaning Plants shall be in accordance with pertinent provisions of the building code and State of California Act Regulating Clothes cleaning establish- ments, as approved by the Governor of the State of California June 22, 1937 and all subsequent editions and amendments. Section 406. SPOTTING SPONGING AND ~RE~o~N~ EST~BLISH~[ENTS. The operation of the foregoing establishments shall be in accordance with the building code and the ~tate law~ regulating Spotting~Spo~ging & Pressing establist-~ents. ~ , Section 407. EXTI~GUISHERS REQUIRED. Where flammable liquids are kept, used o~r handled a quantity of loose non-combustible absorbents, such as dry sand or ashes, together with pails or scoops; and chemical extinguishers or other ext- inguishing devices or materials shall be provided in such quantities as may be directed by the Fire ~¥~arshal. Every marketing station, wholesale, sad other property where flammable liquids are stored in quantities in aboveground tanks shall, as a minimum requirement, be provided with adequate portable foam fire extinguishing equipment. Section 408. QUANTITY fLLO~.¥ED. It shall be unlawful~ for any person to have in excess of one (1) gallon of gasoline, naphtha, kerosene or other flammable liquid at any place within the City of Bakersfield, except as may be permitted by this Ordinance or any applicable State Law. This section shall not apply to any gasoline or other combustible liquids to be used to operate motor vehicles and which is kept in tanks or other receptacles normally attached to such vehicles, when such tanks or other receptacles are so attached. Section 409..S~OKI~G PROHIBITED ~T ALL GASOLINE SERVICE STATIONS. In all rooms or parts of buildings which contain flammable liquids in open containers or in which vapors from fla.~mmable liqu~ids are present, or in which fla?mable liquids are sold or used in any manufacturing prpcess, the carrying of matches is prohibited and smoking shall be s~mi~s'd~me~mo~.Suitable "NO S~OKING" signs with red letters at least four inches (4) high and one half (~)~ ifl~c~ wide on white background~ shall be displayed. Section 410. T~J~K TRUcK~.. The constructi6n and operation of Tank Trucks shall be, in accordance with the~ Suggested Ordinance regulating the Construction and Operation of Automobile Tank Trucks and Tank Trailers as adopted by the American Petroleum Institute, the National Board of Fire Underwriters and the National Fire Protection Association~Edition of 1933 and all subsequent Editions and ~.mendments thereto. Ail trucks used for the transportation of flammable liquids in bulk quantity exceeding 100 gallons shall be inspected by the Fire Chief, and unless certified by h~m as to their compliance with this ordinance they shall not be operated on the streets of the City of Bakersfield provided that this certification shall not be required for trucks bearing the license or approval of the Interstate Commerce Co:remission; or the license of approval of the State Hi-way Department or to trucks transporting flammable liquids in drums, cans and other containers off less thsm 60 gallons individual capacity. No trucks transporting flammable liquids in bulk shall be left unattended on any street, highway, avenue or alley. 6ti: 410 be on count. It shall be lawful to mix ingredients sad to paint or spray portions of automobiles for minor re- pairs or refinishing ~y place within ~y properly ventilated public garage not within twenty-ffive (25) feet from ~ open flame, provided that containers of such ingredients shall not exceed one gallon capacity. All such containers must be sealed when not in use. Ail portable combustible material shall be removed to a distance of at least ten feet from the location off such mixing, painting or .spraying. (a) ~CATION. Finishing ~hops in buildings off wooden con2truction or in buildings used in whole or in part for hum~ habitation or in connection with stsr'e's shall be suitably cut offf by fire partitidns or fire walls from other portions of the building, ~d shall be equipped with an automatic sprin~ler system. (b) STORAGE OF FLA~,~~ FINIS~S IN FINISHING SHOPS. The storage off ffla~able finishes inside of ginishing shops shall be restricted as follows: 1. Not to exceed 20 gallons, with no container exceeding t gallon in capacity, may be stored on a substantial shelff at least 4 feet above ~'~ the floor ~d with suitable guard strips to prevent containers from falling. 2. Not over 50 gallons with no container exceedin~ 5 gallons capacity may be stored in a cabinet, entirely enclosed ~d made of suitably stiffened sheet iron of at least 18 U.S. ~auge in thic~ess, and double walled with 1~ inch air space or equivalent construction. Doors shall be of construction equivalent, to the walls of the cabinets, be provided with 3 point lock, fit closely, and be kept closed when not in use. Door sills shall be raised at least 2 inches above the bottom of the cabinet. 3. Quantities in excess of those given ~der (t) and (2~) shall be in suitable storage and mixing rooms as specified in section 401. (c) ~IXING. 1. Mixing operations shall be carried on only in storage rooms as outlined in Section 403 or in special mixing rooms of equivalent construct- ion; provided that containers of a total capacity exceeding 2 gallons may be ~ened ~d their contents mixed in the finishing room durihg such times as the ventilating system is in operation. 2. Receptacles containing flammable finishes shall be keep tightly covered. Se~tion'4t3 Cont.~-~ ~ (d) CONTAINERS. /All containers of ~tammable ~inishes shall be o~ metal suitably 9onstructed to pr~v~t leakage; I.C.C. containers shall be accept- able ~or storage· 2. Containers used as part metal, except that glass containers not exceeding 1 pint capacity, also containers with glass inner linings of not more th~ 1 gallon capacity (protected with a metal holder or guard perm~ently fixed arouad the container) may be used. (e) VENTI~TION. 1. Unless suitable ventilated spray booths are Used ~or all ~inishing operations, finishing rooms shall be continuously vent- ilated during operation· Ventilation shall be such as to effect at least one complete change o~ air every three minutes. 2. Emhaust outlets in finishing rooms shall be located not over 5 ~eet above the ~loor and shall discharge directly outside ~uilding. Stacks and ducts shall be of substantial construction with joints riveted ~d soldered or otherwise made tight. They shall extend as directly as possible to the outside air s~d prefer- ably not through other rooms, smd be so arr~ged that the discharge of vapor and residue or fire therefrom will not endanger property. They shall not be connected to other ventilating or collecting s~stems. (~) LIGHTING AND ~CTRICAL EQUIPmeNT. Artificial lighting shall be by electricity only· Ail electrical wirin~ and equipment in ~n~s~ng shops shall be in accord with the National Electrical Code rules for Hazardous Locations~ ~also the el$~ct~cal aafe~ cod~ issued ~y ~th~ S~ate of ~ali~Ornia. ¥~he~ spr~yin~ii~] done~,~ ~roperly arranged spray booths, portions the room more than 20 feet from a booth need not be considered Hazardous Locations under the National Electrical Code ~less such portions are so classified as the result of other operations. In the area within 20 feet properly arranged spray booths the National Electrical Code rules for Hazardous~ocation may be modified to allow motors of the totally enclosed type or of the open induction type having no brushes, make or break contacts, colleotors or other a~cing or sparking parts, and to allow lamps of the enclosed vaportight type. 1. (g) HOUSE~EPING./Eini~hing shops shall be kept ~ree ~rom all ~necessary combustible materials aha re~use. 2. Floors of finishing shops, drain bo~rds and the interior of spra~ boo~hs shall be ~horoughly clean'ed at least once a day and all fans, ducts~ side walls and ceilings kept as clean as may be practicable at all times. In cleaning, care shall be taken use implements which will not create sparks. ~herever practicable surfaces to be cle~ued shall be sprayed or otherwise wet do~a with water before cleaning. Sweepings or deposits ~rom spray booths or rooms, duct or stacks shall be i~mediately removed from the building ~d safely disposed o~. Section ~.13, ~(g) 'v~ont. : ~ . '~ ~ ~ ~ ~ '3~ il~iStal waste cans with self-closing covers whsl! be pro~vided~for ,~ all waste and rags which have come in contact with paints, varnishes, and other finishing ~ compounas. (h) ~'~OKI,~G. Smoking shall be prohibited in any room used for .the storage of fla~mmable finishes .~.nd in any f~n~sn~n~= room. Suitable "NO S~OKING" signs shall be prominently displayed. Section 414. DIP TANKS. Dip tanks having an area in excess of 10 square feet sn~ll be prowaed with approved covers arranged to close automatically in case of fire and also arransed so that they can be closed manually. Smaller dip tanks shall be provided with suitab, le covers or with asoe~tos blankets which can be placed over the tanks. If dip tanks are protected by an approved automatic fire extinguishing system employing a fire retardant chemical or gas or water spray the covers specified above may be omitted. Section 415. JAPANNING ~'d~D ENA~'~LING. japanniflg and enameling drying ovens comoust~b!e shall not be placed in contact with wood floors or other '' " material. Heating of ovens shall be done by steam coils, indirect hot air circulation through oven to outside, indirect hot oil circulating pipes, indirect gas burners or electricity. Open flames or fires shall not be in communication with the co~vartments where goods are being treated. PART V RE~UIHEi~,~I~ PERTAINING TO EXPLO~VES. Section pOt. ~.~.~%LL AR}/~S ~UNITION. Nothing in this part, except as specified in Sections 512 and 513, shall be held to mean ~d include any small arms ammunition or signal rockets, or devices or compo~ions used to obtain . e~ect~, which are visible or audible pyrotec~mic ~ ~ covered in this part, nor to include explosives in the forms prescribed in the official United ~,tates Pharmacopeia. Section 502. I~[-~:UFACTURING PROHIBITED. It is prohibited for any person to manufacture any explosives, except that any explosives may be manufact-~ed in the laboratories in colleges ~d similar institutions for the purpose of investigation and instruction. Section 503.. TR}2{SPORTATIOI~ PROHIBITED. It is prohibited for any person to transport or carry ~y explosive in or upon any public conveyance which is carrying passengers for hire. 18. Sect,ign 504.~' ~EXPL6SIVES, QUI~i~TITY ~O.F. i~ is prohibited for shy. p~rson~%o' .J Have, keep, store, sell, offer for sale, give away, use, trgnsport, or man- ufacture any of the following explosives in any quantity: Liquid nitro- ~lycerlne, hioh explosives contafning~over 60 percent of nitroglycerin~e ~ [excerpt gelatin dynamite); high explosives hav[~ an unsatisfactory absorb- ent o~ one that permits leakage of nitroglycerine under any conditions liable to exist during transportation Or storage; mitrocellulose in a dry and uncompressed condition, in ~uantity greater than 10 pom~ds in one exterior package; fulminate of mercury in bulk in a drY condtion, and fulminate of all other metals in any condition, except as a component of manufactured artic!~s not hereinafter forbidden or explosives containing an ammonium salt and a chlorate. Sect~_on 505. WARNING ON VEHICLES. Every vehicle while carrying explosives shall have painted on its front, sides and bgck, in easily legible letters at least four inches high, in contrasting colors, the word "EXPLOSIVES," or in lieu thereof shall display, in such manner that it will be visible from all directions, a red flag with ~he word "DANGER" printed, stamped, or sewn thereon in white letters. Such flag shall be at least twenty-four (24) inches square, and the letters thereof shall be at least six(6) inches high. Section 506. S~OKING ON VEHICLES. It is prohibited for any person in charge of a vehicle containing such explosive to permit smoking in or upon such vehicle or to smoke while unloading or loading such vehicle. Section 507. [~.~.TAL TOOLS. It is prohibited for any person to place or carry in the bed or body, or cause to be placed or ca~ried in 'the bed or body of any vehicle containing such explosives, any metal tool or other piece of metal, or any matches. Section 508. BLASTING DETONATORS ETC. It is prohibited for an~ person to place or carry or cause to be placed or carried, in any vehicle containing explosives, any exploders, detonators, blasting caps or other similar explosive material. Section 509. STO~.~aGE Ow E)CPLOSIVES (a) Ail magazines in which permissible explosives are had, kept or stored, must be located at distances from neighboring buildings, highways and rail- roads in conformity with the ~merican Quantity and Distance Table. Provided that one portable magazine co~taining not more than fifty pounds of explosive may be allowed if placed on wheels and located not more than ten feet from, on the same floor with and directly opposite to the entrance on the floor nearest the street level, and one portable magazine containing not more than five thou- sand blasting caps, may be allowed if placed on wheels and located on the floor nearest the street level. (b) Blasting caps or detonators of any kind shall not be kept in the same magazine with other explosives. (c) Ail magazines must be kept locked except when being inspected or when e~?losives a. ~ being placed therein or being removea there-,-rom. 19. No person shall blast or carry on any blasting operations Without first having obtained a permit from the City Manager. The applicant for such permit must file a bond deemed adequate in each case by the City ~anager,' which bond shall become available in the payment of any damage a~isin~_ s from the neglect of the contractor or his' agents or employees. Section 511. HANDLING OF PYROTECHNICS. No person shall have, keep, store, use, ~ 'c provided[ however~ manufacture, sell, handle or transport any pyrotecnn~ s; (a) That nothing in this ordinance shall be held to apply to the possession or use of signaling devices for current daily consumption by railroads, vessels and others requiring them. (b) The Fire Chief may, upon due application, issue a permit to a properly qualified person for giving a pyrotechnic display of fireworks in the public parks or other open places. Such permits shall impose such ~estrictions as in the opinion of the ~hief of the Fire Department may be necessary to properly safeguard life and property in each case. (c) That nothing in this ordinance shall ]se held to apply to the possession. sale or use of normal stocks of flashlight compositions by photographers or dealers in photographic supplies. Section 512. STORAGE OF SIiu~LL AR~ A~:~iUNITION AN]) PERi, IT REQUIRED. No person shall store for sale, sell or offer for sale any small arm ammunition without a permit. , Section 513. HANDLING OF S~ALL AR[~S A~,.&~UNITION. No person shall manufacture within the limits of the City of Bakersfield any small arms ammunition. This shall not be construed as prohibiting the hand-loading of small a_ms ammunition for private use and not for resale. REQUIi~£~.~.NTS PERTAIN!t~!G TO NITRO-CELLULOSE MOTION PICTURE FIL~ Section 601. SELLING OF. It shall be a misdemeanor for any person, to sell any toy or miniature motion picture ~machine containing nitro-cellulose motion ~icture' film, or to sell, lease or otherwise.dispose of any nitro-cellulose motion picture films to any person not having a permit to hsmdie, use or display such film. Section 602. PERmafIT FOR STORAGE. A permit shall be required for the storage of nitro-cellulose motion picture film in quantit~ies greater than five reels or aggregating more than 25 pounds in weight. No permit shall be issued for any building unless the rooms in which film is handled or stored are protected ~by automatic sprinklers; provided that this does not include projection booths covered in Section 605. Section 603. ~,TOR~-~GE OF. Nitrocellulose motion picture film in other than the original shipping cases conforming to Interstate Commerce Commission regulatiom in amounts in excess of 25 pounds but not in excess of 1,000 pounds shall be kept in approved cabinets if not in vaults; amounts in excess of 1,000 pounds shall be kept in vaults. Note: The standard roll of film 1-3/8" (35~mm) wide ?md 1,000 feet long weighs about 5pounds. Section 604.-FIL~ CABINETS AND VAULTS. (a) Cabinets shall be of approved construction and Shall not have a capacity in excess of 375 pounds of film. (b) Cabinets having a capacity of 50 pounds of film shall be provided with a vent £rom each 'compartment to the outside of the building. The vent shall have a minimum e£fective sectional area of 14 square inches per 100 pounds of film capacity. (c) Cabinets holding over 75 pounds of film shall be provided with at least one automatic sprinkler; provided that a cabinet constructed so that each roll is in a separate compartment~ and will burn out without communciating, fire to film in anyyother compartment, need not be provided with an automatic sprinkler. (d) Film vaults shall be constructed, vented and sprinklered in accordance with the requirements for standard film vaults and in a manner satisfactory to the Bureau of Fire Prevention. Section 605. ~OTION PICTURE MACHINES. Every motion picture machine using nitrocellulose film shall be installed or operated within a booth in accord- ance with pertinent chapters and sections of the Uniform Building Code. REQUIREI~,F, NTS PERT~INI~IG TO Pi!OTOGRAPttIC AND X-RAY NITRO-CELLULOSE FIL~'~ Section 701. STORAGE OF PHOTOGRAPtl!C & X-RAY FIiA~ FOR HOSPITALS, DOCTORS OFFICE[ ETC. In[,,.hospitals and similar institutions, doctors' offices and x-ray labor- atories, all unexposed nitrocellulose photographic and x-ray film, .unless in unopened I.C.C. shipping containers, shall ,be stored in cabinets or vaults, as outlined below; all exposed nitrocellulose photographic and x-ray film shall be kept in outside storage houses, except~ that not more than 500 pounds may be kept in approved cabinets 'witt~in the building, constructed as outlined below. Section 702. STORAGE OF PHOTOGRAPHIC & X-RAY FIL~ IN STUDIOS. In portrait and commercial studios, all exposed nitrocellulose photographi, c and x-ray film shall be stored in cabinets, vaults or outside storage house~, as outlined below2~ §torage of unexposed film in excess of 50 cubic feet, unless in un- Opened I.C.C. shipping containers, shall be in a room equipped with automatic sprinklers. Section 703. CABINETS. (a) Cabinets shall be of approved insulated construct ion and shall not exceed 10 cubic feet capacity. (b) Cabinets shall'~be equipped with at least one automatic sprinkler.in · each compartment unless' speci£ica'lly approved for use without automatic sprinklers. (c) Each cabinet shall be provided with a vent to the outside of the build- ing. The vent shall be so constructed or protected by a substantial metal grid as to prevent stoppage of vent in case of combustion or decomposition of film contents. For a cabinet having 10 cubic feet inside volume the area shall be not less than 56 square inches. For smaller cabinets the vent area shall be proportional except that no cabinets shall have a vent area of less than 14 squar'e inches. (d) Vent flues inside the building shall be of a construction equivalent , to No. 18 U.S. guage metal covered with 1 inch of heat insulating material. Section 704. lfAUL'rS AND STORAGE HOUSES. Vaults and outside storage houses shall be sprinklered and vented and in strict accordance with the standard requirements for vaults or for outside storage house~, and satisfgctory to the Bureau of Fire ~revention; provided, however, that outside storage houses which are not within 100 feet of any other building are not required to have automatic sprinkler Rro_~tection. ~ C Section 705. ELECTRI WIRING. Ail wiring and electrical equipment in rooms or vaults where film is stored shall conform to the National Electrical Code; only incandescent electric lights shall be permitted and in vaults these shall be protected by wire guards, vaporproof globes or both. Portable or extension cords shall not be used in any storage vault. Section 706~. ~S~OK~ING. Smoking shall be ~prohibite~in rooms wb_er~ fil~ is .sto~ed~'o~ in developing or similar~work~ rooms. Conspicuous "NO SI~i0KING'' sfgns shall be posted in prominent plo~ces. Section 707.~ ~' ~ ~ REorRI~TIO~S ON STORAGE. No film shall be sto~ed within ~ feet. of steam pipes, radiators, chimneys or other source of heat. Section 708. EXTINGUISHER~. EQUIP[~¢£NT. Fire pails or extinguishers shall~ be provided as required by the Oh~ef~of the Fire Department. P~RT ViII REQUIREmeNTS PERTAINING TO PYROXYLIN PLASTICS Section 801. PERi, ITS. Ail retailers, jobbers and wholesalers storing or hand- ling more than 100 pounds of pyroxylin plastic shall obtain a permit; a permit shall also be required for the manufacturing of articles of pyroxylin plastics which shall 'include the use o~ pyroxylin plastic in the manufacture or assembling of other articles. Section 802. DI6PLAYS. AIl displays of pyroxylin plastic articles in stores shall be in show cases or show windows except as permitted below. (a) Articies may be placed on tables but no tables shall be over 3 feet wide and 10 feet long, and tables shall ~e spaced at least 3 feet apart. Where articles are displayed on counters, they shall be arranged in a like manner. (b) Spaces underneath tab les shall be kept free of storage of any kind and of accumulations of paper, refuse and other combustible material. (c) Sales or.~display tables shall be so loca'ted that in the. event of a fire at that table, the table will not interfere with free exit from the room, in at least one direction. (d) Electric or gas mantle light shall not be directly above any pyroxylin plastic material, unless provided with a suitable guard to prevent heated particles falling. Section 803. AUTOCRATIC SPRINKLERS. Section 804. STORAGE. Section 901. PERMIT. No person shall store or keep calcium carbide in excess of ,on_'e.:hund. r~e~ pounds, nor operate an acetylene generator having a carbide cap- acity ~xceeding 5 pounds, without a permit. Acetylene generators shall be of approved type. Section 902. STORAGE. (a) Calcium carbide in excess of 600 pounds but not in excess.'of 5,000 pounds, may be stored in a separate room or compartment inside a one-story building containing other occupancy, provided such room or compart- ment is separated by a fire-resistive partition from other parts of the building and without cellar or basement underneath such carbide storage section. This room or compartment may also be used for storage of fuel gas cylinders. Adequate ~entilation shall be provided. (b) Not to exceed 5,000 pounds of calcium carbide may also be stored within an inside generator room or compartment of construction as above mentioned when such generato? room or compartment is located in a one-story building without cellar or basement underneath 'the generator section. Such generator room or compartment may also be used for the storage of fuel gas cylinders. , (c) Calcimm carbide in excess of 5,000 pounds shall be-stored above ground in one-story buildings without cellar or basement and used for no?~other purpose, except the storage of fuel gas cylinders, or an outside generator house. Location of such storage buildings shall be outside congested mercantile and manufacturing' districts. Construction used shall be such as to ensure a dry, waterproof building and adequate ventilation shall be provided. If storage building is of incombustible construction, it may adjoin other one-story buildings ~if separated therefrom by unpierced fire walls. If detached less than 10 feet from such building or buildings, there shall be no opening'~n ,'my of the mutually exposing sides of suc~h buildings within said distance. II~ the. storage building is of combustible construction it shall not be with- in twenty(20) feet of any other one or two-story building, nor within thirty (30~) feet of any other building exceeding two 2tories. ~Section 903. -STATIONERY GENRATORS. Station~ry generators shall be installed either in an outdoor, underground pit, or in a well ventilated fire-resistive outbuilding, the size of which shall not exceed that required to allow free operation of the apparatus and the storage of the necessary carbide; provided that such generators may be installed inside buildings if within a well ventilat- ed~ fire. resistive enclosure either in a 1-story building or on the top floor or roof of a multi-storied building. Section 904. PORT~J~LE 'GENERATORS. Portable generators shall not be used inside buildings except in rooms of total volume .at least 35 times the nominal aggregate gas-generating capacity of the unit or units used therein. ~ p'~R.T X~ ~ REQUI~I~NTS OF S~FETY CODE FOR ~CHANICAL REFRIGERATION, AIR CO~DITIOflI~G & BLOWER EXHAUST SYSTEMS. ~ '~ ' ~ Section 1001. SCOPE. These regulations apply to the safe ' ~ ' lnstai_~atlon, operation, and inspection of every refrigerating system hereinafter installed employing a fluid which is expanded, vaporized, liquefied and/or compressed in its refrig-. erating cycle. Section 1002. PURPOSE. These regulations are intended to provide reasonable safety for life, limb, health and property. section 10o3. PER~ITS. A permit shall be required for the installation and operation of. any refrigerating system. Section 1004. CODE. The installation and maintensnce of mechanical refrigerat- ing shall be in accordance with the Safety Code for ~echanical Refrigeration as promulgated by the American Society of Refrigerating Engineers and as required by pertinent chapters and/or.section of the Building Code. Provided however that all re£rigerating plants using 100 pounds of Ammonia or over in the system may be equipped with a device or devices for discharging the refrigerant under pressure in case of emergency, into sufficient water to absorb all discharged gas and carry it off to the sewer. Section 1005. INSTALLATION. (a) The installation of ducts, fans, blowers, dampers, or other appurtenances of air conditioning and ventilating systems shall be in accordance with the Standards of the National Board-of Fire Underwriters for the Installation of Air Conditioning, Yarm air heating, Air Cooling and ventilating systems, edition of August 1942 and all subsequent editions and amendments. (b) The installation of motors, £ans, blowers, duct, dampers or other appurtenances of blower and exhaust systems for dust, stock and vapor removal shall be in accordance with the Standards of the National Board of Fire Under- writers edition of 1937 and all subsequent editions or amendments thereto. P~RT XI REQUIRE~ZNTS REGULATING' SPECInL HAZARDS Section 1101. TIRE RECAPPING. A permit shall be required for any tire retread- ing or rebuilding plant. Tire retreading shops shall have all floor openings such as stairs and elevator shafts enclosed in a standard manner, and with exposed windows protected by wired glass in metal sash and frames. Section 1102. BUFFING i~CHINES. Buffing machines, except in shoe repair shops, shall be located in a separate room and used for no other purpose. Each machine shall be connected to all. pie blower or dust collecting system. Dust shall be collected in suitable containers. Sweepings or deposits from buffing machines, blowers~ or any part of the system shall be removed daily from the building and safely disposed of. ~ Section ll03..RE~ OF FLA~A~LE V~PORS. ~ch room where wubbe¥ cement is ~ ~u$~door'mixed, or flammable solvents are applied, shall ~e equipped w~h an effective system of mechanical or natural ventilation. Section il04.~SPRIN~.ER SYSTE~. There~sh~ll be installed one sprinkle~ head co~uected to the City water system for each buffing machine, except in shoe repair shops. Section ll05. TIRE P~TREADING SHOPS. Tire retreading shops in buildings of wooden construction or in buildings used in whole or in part for human habitation or in connection with stores shall be suitably cut'off by fire partition~ or fire walls from other portions.of the building, and sh~ll be equipped with an auto- matic sprinkler system. Section ll06. PREVENTION OF NUST EXPLOSIONS. The Chief of the Fire Department is hereby authorized to prohibit further operation in an~ grain elevator, flour, starch or feed mill or plant pulverizing cocoa, sugar, spices, coal, or other material producing flammable dusts where: (a) Elevator legs, spouts, hoppers and other conveyors are not dust tight. (b) Accumulations of dust are permitted in the interior of the building and a suitable dust removal system is not maintained. (c) Open flame or spark producing equipment is permitted in rooms containing dust atmospheres. (d) Pneumatic or ma£netic separator~ are not maintained ~head of all grinding or oulverizing machines. (e)-Operation is not under competent supervision. (f) ~achinery and parts of the crushing, drying, pulverizing and conveying systems are not adequately grounded. Section ll07. LOOSE CO~!~USTIBLEFIBRES. Loose fibres, whether housed or in the open, shall not be stored within 100 feet of any building e~cept as hereinafter specified. Not to exceed 100 cubic feet of looee combustible fibre may be kept in any building provided storage is in a metal~lined wooden bin, equipped with a self-closing metal-lined cover. ~uantities exceeding 100 cubic feet of loose combustible fibre, but not exceeding 500 cubic feet, may be stored in rooms or compartments having floor, w~lls and ceiling constructed of m~terial possessing sufficient fire resistance to withstand a standard one-hour fire test. Openings into such rooms or compartments shall be cut off from other parts of the building by spproved fire doors. Quantities exceeding 500 cubic feet cf loose combustible fibre may be stored in ~pproved v~ults, constructed as follows: (a) Sto~age vaults shall preferably be located outside of buildi~gs. If located inside, saSety vents to outside ~ir shall be provided. (b) Walls, floors, and ceilings shall be constructed of brick or other ~pprov- ed non-combustible material. Sisal and other fibres in bales bound with combustible tie ropes, also jute and other fibres liable to swell when wet, shall be stored to allow for expansion to the extent of 20 percent of their bulk in any direction with- out endangering building walls, ceilings or columns. Not less than 3 feet clearance shall be maintained between sprinkler pipes and tops of piles. Not less than 3 feet clearance shall be left between walls and sides of piles, except that if storage compartment is not more th~n 30 feet in width, one foot' clearance at side. walls will be sufficient, provided a center aisle not less than 5'feet wide is maintained. Unlimited quantities of hay, straw, and other agricultural products may be stored in or near storage buildings located outside closely-built areas. Section ll08. HAZARDOUS CHEN11C~LS. The Fire Ch,ief shall be empowered to re- strict the storage, handling and sale of chemicals and chemical compounds which are of a corrosive or poiso, nous nature, or which materially increase the fire hazard. %%l~ere kept in containers or packages usual to the retail trade', no' general restriction shall apply other than shelving shall be substantial and storage shall be neat and orderly. For storage of hazardous chemicals in warehouses, factories and whole- sale stores, material of an oxidizing nature, such as nitrates, nitrites, chlorates, etc., shall be stored in dry places, and the Chief of the Fire Department may require a separate room or building when the quantity stored constitutes a material hazard. ~ Bulk storage or storage of two or :aore carboys of acid shall be out- side in a yard or an enclosure, or properly protected on the roof of the building or in a special room provided with a suitable container for the character of acid in case of breakage or leak,.' The Chief of the Fire Department may require a separation or isolation of any chemical which is of a nature which combination with other chemical or with organic matter may bring about a fire or explosion or may liberate a hazardous or poisonous gas. (b) REPAIR WORK. Carbon and lead burning, welding and ether processes in- volving direct application of fl~e shall not be carried on in any garage housing more than twenty (20) automobiles on any floor unless the garage is provided with adequate ventilation as required by the building code, or such process are carried on in a room enclosed by walls having a fire resistance rating' of not less than two hours, with openings therein protected by approved fire deers or fire windows, and with ne opening from such room to any upper story. No repairs of any kind shall be made in any basement or sub-basement gara~i~~ C~.F. ANING WITH FLA~¢~B~.~. LIQUIDS. Ne flammable liquid with a flash point below 100 degrees F. shall be· used in any garage for washing parts er removing grease or dirt, unless in a special closed machine approved for the purpose, or in a separate room enclosed by walls having a fire resistance rating of net less than two hours, with openings therein protected by approved fir& deers er fire windows, and with ne opening from such room to any upper er lower story. (d) H~DLING OF GASOLINE ~G~D OILS. The reservoirs of motor vehicles shall be filled directly through hose from pump.s attached to approved portable tanks or drawing from underground storage tanks. No transfer of gasoline in any garage shall be made in any open container. There shall be ne facilities· for gasoline handling or filling in any basement or sub-basement garage and no such filling or handling operations shall be carried on therein. Ne gasoline or other volatile flammable liquid shall be allowed to run °~ipen the floor or to fall or pass into the drainage system of ~he premises. Self-closing metal cans shall be used for all oily waste er wasted oils. Contents of oil separators' or traps of floor drainage systems shall be collect- ed at frequent intervals and removed from the premises. PART XII REQUIREMENTS FOR FIRE EXTINGUISHING APPARATUS AND FIRE DOORS Section 1201. WHERE REQUIRED. 'The Chief 'of the Fire Department shall survey all ~ercantile, ~,%anufacturing, Public garages, Auto filling stations, Battery service stations, Tire vulcanizing, Paint shops, Schools, Places of public assemblage, tlospitals, ~36E~ntion homes, Apartments, Hotel buildings and shall designate suitable fire appliances in or near boiler rooms, kitchens of restuarants, Clubs and like establishments, storage rooms involving considerable combustible material, rooms in which hazardous manufacturing processes ~.re in- volved, garage sections and other places of a generally hazardous nature. , etlon- 1201 Cont.. ~ . o ~ = Such appli'-mnces may consist of' automatic alarm systems, automatic sprinklers, standpipes sd hose, fixed, wheeled or portable chemical extinguishers of a type suitable for the pro~.able class ~f fire, or suitable asbestos bl~gnket~, manual or automatic covers or the introduction of an inert gas. In specially hazardous processes or in thegn% of excessive storage, appliances of more than one type may be required or special systems to be installed. Section 1202. DISTRIBUTION. The distribution and maintenance of first aid appliances shall be in accordance with the Standards of the National Board of Fire Underwriters, Edition of August 1938 and all subsequent Editions or Amendments thereto and in compliance with pertinent sections and parts of the Building Co.de. Section 1203. FIRE RESISTIVE DOORS. Fire Resistive doors shall be construct~t and installed as required by pertinent sections of the building, code. Fire doors bearing the label of the National Board of Fire Underwriters and in- stalled in accordance with "'Regulations for the Protection of openings in Walls and Partitions against Fire" as promulgated by said National Board and as .~recommended by the National Fire Protection Association, Edition of January 1939 and all subsequent editions and amendments shall be considered in full compliance with the provisions of this section. PART XIII REQUI-REMENTS FOR GAS APPLI~JICES l~D CON~CTIONS Section 1301. GAS ~PPLIANCES. ~ere gas outlets are provided in the room in which a gas appliance is to be placed, said appliance may be connected to outlets by other than registered plumbers (water heaters excepted). Every appliance shall be rigidly connected to house gas pipingby means of rigid metal pipe or by solid copper or brass tubing. No flexible gas tub- ing shall be used. Section 1302. SHUT OFF VALVES. An outside valve shall be installed on every gas service pipe regardless of size that supplies large stores or industrial establishments or places of public assembly such as churches, theatres, motion picture theatres, schools~ and hospitals, and on every service pipe 2~ inches or larger in dimmeter. Shut off cocks and valves shall be placed in suitable stop or valve boxes, manholes or vaults, the covers of which shall bear the name of the company to which it belongs and the valves if necessary tagged to properly identify their purpose. Section 1303. INSTALLATIONS OF CAS ~-~ATERS, STOVES AND RANGES. Installation of gas heaters, stoves~: and ranges, shall be in accordance with the Uniform Building Code Edition of 1940 m~d all subsequent editions and amen&ments there- to. PART INTERFERENCE WITH FIRE ALARM SYSTEM Section l~O1. INSURY TO FIRE AI~RM EQUIPMH~T. It shall be unlawful for any person to brea~, remove or injure any of the wires, parts, apparatus, or appurtenances of the fire alarm system of the City of Bakersfield, or to dist- urb or in any manner interfere with any such wires, parts, apparatus or appurtenances; provided, however, that nothing shall be so construed as to make punishable the doing of any of the above mentioned acts with the permissio of the Chief of the Fire Department. Section 1402. KEYS FOR ALAR~ SYSTE~. It shall be unlawful for any person to make or cause to be made, any key or keys that will lock or unlock any box of the fire alarm, system, except under the order and .regulations of the Fire Department~Jhief. Section 1403. PLACING OF WIRES BY AI~.l SYST.EM. It shall be unlawful for any person, to place any wire or wires within six (6) feet of any wires used for or confiected with the fire alarm system of the City of Bakersfield, unless a written permit therefor be given by the Chief f of the Fire Departmsnt. Section 140~. REMOVAL OF ALARM SYSTE~ WIRES. ~t~en it shall be necessary for any person, in the pursuit of a lawful object to remove, interfere with or disturb any portion of the wires'of the Fire Alarm System, he shal,1 file, or cause to be given to the Chief of the Fire Department of the City of Bakers- field a notice thereof; which notice shall be given at least five (5) hours before it shall be necessary to remove, interfere with or disturb any portion of the wires of said Fire Alarm System and shall state the locality at which, and the manner in which it shall be necessary to remove, interfere with or disturb the same. Section 1~05J REP.~ING OF .ALA~ SYSTEM WIRES. It,shall be the duty of any person, taking dom~, disturbing, interfering with or removing any portion of the wires of said Fire Alarm System under the pro.visions of the preceding section, forthwith to replace or ..repair any such wire' or wires so taken down, disturbed, interfered with or removed, and to place the same in as good cond- ition as the same was before being so taken down or removed, and thereupon report to the Chief .of the Fire Department that said work has been done. Section 1406. DISCONTINUANCE OF TELEPHONE SERVICE. It shall be the duty of. any person, maintaining a telephone system within the City of Bakersfield, for the purposeoSf furnishing telephone service to the inhabitants of said city, Whenever the said telephone service extends to and is connected with the fire houses of the City of Bakersfield, and the said telephone service to any one o£ said fire houses is cut off, interfered with or for any reason whatever if temporarily discontinued, to notify the Chief of the Fire Department of the City of Bakersfield as well as all other fire houses belonging to said city, of said cutoff, int°erferza, cewith and discontinued telephone service to said f. ire hoase, and to thereupon proceed to restore 'sa,id °se.r,vice~wit~f~as little delay a~ possibI~' and wheH '~ · " .sa~d-.telephone zervm~e is again restored to n~t~f%'said Fire Chief to that effect.' ~ Section 1407. POt~ERS OF FIRE CBIEF-DURING FIP~S. During the continuance of a fire the Chief oi' the Fire Department ~all have police power, and in the blocks in which the fire is established the various police and peace officers of the City of Bmkersfield shall execute all orders received from said Chief of the Fire Department, relating to said fire and the extinguishment thereof. Section 1502. BLOCKING OF STB~ETS DURING FIRES. The Chief of the Fire De- partment, whenever in his judgment it is deemed necessary for the handling of the fire apparatus or the management and control of a fire, shall have the power to place or cause to be placed, ropes or guards across the streets, alleys and public ways on wh~dh shall be situated any buildings on fire, or to otherwise obstruct or block the streets in the immediate vicinity of said fire, and at such other points as he may deem expedient and necessary, and shall'have power to prevent any mud all persons not necessary to the handling of said fire apparatus or in the managing and controlling 'of said fire, except owners or occup~mts and employes of buildings endangered by the existing fire, from entering within the lines designated by ropes or guards, and excepting also members of the Fire and Police Departments of the City of Bakersfield, and such o~er persons as said Fire Chief may call to assist in handling said fire apparatus, or to aid in managing and controling said fire; any person entering wihhin the line or lines designated by ropes and guards and refusing to go outside such lines when directed to do so by s~id Fire Chief, or any fireman or police officer, shall be guilty of a misdemean- or and upon conviction thereo~ shall be punished as provided in this Ord- inance. Section 1503. BARRIERS OR OBSTRUCTIONS ON STREETS. It shall be the duty of any person, opening or disturbing the surface of any public street within the City of Bakersfield or causing same to be opesed or disturbed, or who for any reason places or causes to be placed mxy barrier ~ obstruction thereon, which would in anyway impede or endanger the speed or progress of any fire apparatus on its way,to respond to an alarm of fire, to at once notify the Chief of the Fire Department of such opening or disturbance of such street or of any barrier Shereon, giving the exact location of same, the F~re Chief shall thereupon cause notice to be conspicuously posted in each fire house for the information of the drivers of all such fire apparatus. It shall be the further duty of said person, firm or corporation to notify the Fire Chief when the surface of said street is again restored to its former condition and any barrier thereon has be~n removed. SI ~1 '~ ~ P~RT XVI ° WATER SUPPLY Section 1601 FIRE HYDRANTS, ?Y~PAIR OF. 'I.t shall be th~ duty of any person, supplying water to the City of Bakersfield and its inhabitants through hydrants located upon streets, alleys or public places within the City of Bakersfield, whenever by reasbn of repairs or work, or from any cause the wa~er is turned off from any such hydrants, to notify the Fire Chief of said City thereof, before the water is turned off, and the length of time such hydrant will remain with- out water, and in case of an alarm of fire in the City, it shall be the duty of such person, firm or corporation to turn into all the mains and hydrants all the water necessary or available if possible. Section 1602. WATER ~AINS, REPAIR OF. In case such person be engaged in work upon any line of pipe necessitating the turning off of' water, no such line of pipe shall be left open or empty during the night, or when work is not actually .going on therein, and if any line of pipe be open at the time of quitting work, or when an alarm of fire is given a cap or thimble shall immediately be placed closely over-.the mout~ of such pipe and the water left in as far as possible for the use of the Fire Department. ~my person,~.h.avi~gl.ch&~g~,o?::cantrol of any pipe or hydrants, in doing or ordering work done in or upon the same who shall violate any provision of this section shall be guilty of a misdemeanor. Section 1603..__.~.M~)WING WATER TO RUN DURING FIRE. It shall be unlawful for any person, having under their control any~.lot or premises to permit o.r allow water to flow upon said lot o.r premises Trom any hose, hydrant or pipe connected with any water system supplying water to the City of Bakersfield and the in- habitants thereof, during the prevalence of any fire, after an alarm shall have been given.or they have knowledge of said fire, except where such water is used to extinguish said fire. Section 1604. FIRE HYDRANTS, U~AWFUL TO OPEN. It shall be unlawful for any person to open or use or cause to be opened and use. ~my fire hydrants within the City of Bakersfield except such person _or persons as may be thereunto autho~-zed and directed by the Chief of the Fire Department of said City of Bakersfield. Section 1605. DRIVING OVER FIRE HOSE. It shall be unlawful for any person to wilfully or negligently injure any engine house, hose, engine, automobile or other vehicl._e or any apparatus of the Fire Department of the City of Bakersfield. UNOCCUPIED BUILDIN.GS. %..~en any unoccupied building or st. ructure in the ~ity of Bakersfield is not properly secured, locked or closed, the Fire Chief shall notify and order in ~Titing the owner or person having control of such building or structure to secure or close the same fo~hwith so as to prevent unauthorized entry thereto. .Section 1707. BURNING IN FIRE. DISTRICTS. It shall be unlawful for any person to hum straw, lumber, trash, rubbish, leaves or other combustible material in any street, alley, vacant lot or premises within the Fire Limits numbers I and 2 of the City of Bakersfield, unless it is in an approved incinerator.. Section 1708. HOURS OF B~I{NING. It shall be unlawful for any person to burn straw, lumber, trash, rubbish, leaves or other combustible material, in any public street or alley in the City of Bakersfield at any time. Strav~ lumber, trash, rubbish, leaves or other combustible material may be burned on any lot or premises outside the prescribed fire :limits Number I and 2 of the City of Bakersfield, between the hours of 6:00 A.~. and 6:00 P.~. B~ovided that no such combustible material shall be burned within 25 feet of any combustible material, fence or building.; exdep.~ in:.ku approved incinerator and no such combustible material shall be burned except when reasonable precautions shall be taken to prevemt the spread of such fire; provided however the Fire Chief of the City of Bakersfield..may, in his discretion, issue permits for the burn- ing of such straw, lu. mber, trash, rubbish, leaves or other combustible materials at hours other than those above stated when requested to so do. Section 1709. INCINERATORS. (a)"Class one" incinerator shall be constructed under the supervision of the Building Inspector after approval as to location has been given by the Chief of the Fire Department. (b)"Class 2"Incinerator, shall be deemed to mean or include an~ concrete or masgnrY incinerator of a type approved by the Fire"}~arshal in which all · smoke exits are guarded by adequate spark screen~, .,~...a'll openings for intakes or clean-outs mus~.i~e protedcted either by doors or spark arrestors. No class two incinera~o~ shall be located within 5 feet of any building or with- in l0 feet of any opening therein,, except that the same may be located within i foot of any type 1,2 or 3 building. Every incinerator shall be equipped with a chimney or metal stack that ~hall extend 2 feet above the roof of any structure within l0 feet thereof (c) Barbecue pits - outdoor f,irep~aces: Not withstanding any other prov- :-.'i~,sions of this section, it shall'be l'~wful for any person to set fire to, ignite or burn any combustible material in any permanent outside fireplace, grill or barbecue pit that"~.has been approved in writing as to construction and location by the Fire Chief, provided that such fire ~.s kept under competent and continuous supervision. No barbecue pit shall be 'used as an incinerator. ~' ' PART ~(VIII - '~' Section 1801. SIDE~';ALK OPENINGS. In all cases where there are gratings or slatted openings in the sidewalk, or over any opening leading into the basement of a building, a wire netting of not over one-half (4) inch mesh shall be placed beneath such grating' or slats so as to prevent rubbish from falling through. Section 1802. SHOW WINDOW LIGHTS. All arc lights or incandescent lights in show windows shall be covered with globes or reflectors.
