WB~.~S, the City Council hereby declares that an emergency
exists for the immediate preservation of 'the public peace, safety
and welfare, which requires the passage of' an emergency ordinance
prohibitin~ intoxication and the drinking of alcoholic beverages in
.public streets and places in the City of Bakersfield,
NOW, TB-~..REFOHE~ BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD, as follows:
SECTION 1.
No person shall be or become intoxicated upon any public street,
sidewalk, highway or alley or in any public place, or in any place
open to public view~ or in any place open to the patronage of the public.
SECTION 2.
No person shall be on any private premises or in any private h6use
in a state of drunA~enness or intoxication to the annoyance of any other
person. ·
SECTION 3.
No person shall drink any malt, spirituous or vinous liquor con-
raining mere than 6ne-half of one percent of alcohol by volume, upon
any public street', sidewalk, highway or alley, or in a~y public place,
or in any place open to public view, or in any place open to the patron-
age of the publlc~ except premises of the holder of an on-sale license,
as the same is defined in the Alcoholic Beverage Control .Act ~f the
State of California.
SECTION 4.
Any person violating any of the provisions of this ordinance
shall be guilty of a misdemeanor, and upon conviction thereof shall
be pum_l~hed by a fine not to exceed Fifty Dollars ($%0.00), or by
imprisonment in the County Jail for a period not exceeding thirty
(30) days~ or by both such fine and imprisonment.
SECTION 5.
Ordinance No. 42% Ilew Series of the City of Bakersfield, is
hereby repealed.
SECTION 6. .
This ordinance is hereby declared to be an emergency measure
within the meaning of Section 24 of the Charter of the City of
Bakersfield, State of California, and necessary £or the immediate
preservation of the public peace, safety and welfare, and shall take
effect immediately upon its passage.

passed and adopted by the Council of the City of Bakersfield at a
