WHEREAS, the City Council hereby declares that an emergency
exists for the immediate preservation of the public peace, property,
safety and welfare, which requires the passage of an emergency, ordi-
nance regulating traffic upon public streets of the City of Bakers.field;
NOW, TP~m~EFORE, BE IT ORD. AINED BY THE COUNCIL OF THE CITY OF
RAKERSFIE~.D, as follows:
SECTION 1.
That Ordinance No. 658 New Series of the City of Bakersfield,
be aD~ the same is hereby amended by adding thereto a new section to
be numbered ?0, said section to read as follows:
Section 70. CERTAIN VEHICLES PROHIBITED ON NILES STREET
BETWEEN BA/~R STBW. W..T AND THE EASTERLY CITY LIMITS. (a) No person
shall operate a vehicle with three or more axles upon or over NLles
Street between the east side of Baker Street and 'the easterly limits
of the City of Bakersfield.
(b) This section shmll not be construed to prohibit any
vehicle from crossing Niles Street; nor shall-it be construed to
prohibit any vehicle from usiD~ or traveling over or upon NLles Street
when necessary to reach a destination on Niles Street between the east
line of Baker Street and the easterly limits of the City of Bakersfield
for the purpose of delivering, unloadim~ or loading for transportation,
goods, wares or merchandise, providing such use of Niles Street be
made only to or from the cross street nearest the destination of such
v chi cl e.
(c) The City Manager shali cause to be posted at all
entrances to N~les Street between the east side of Baker Stree{ and
the easterly limits of the City of Bakersfield, appropriate signs
giving notice of the provisions of this ordinance.
(d) This section shall have no application to any vehicle
which is subject to the provisions of Section %0~ of the Public Utilities
Act of the State of California; or to vehicles operated by the federal
government or the State of California, or any agency, department,
political subdivision or municipal corporation thereof; or to vehicles
of any public utility, while actually engaged in the' performance of
emergency duties customarily performed by said public utilities.
SECTION 2.
This ordinance is hereby declared to be an emergency measure
within the meaning of Section 24 of the Charter of the City of Bakers-
field~ State 'of California, and necessary for the immediate preserva-
tisn of the public peace~ property, safety and welfare and shall take
effect immediately upon its passage by the Council of the City of.
Bakersfield and approval in writing by the Department of Public Works
of the State of California, pursuant to the provisions of Section 4%9
of the Vehicle Code of the State of California.
