AN EMERGENCY ORDINANCE .&~ENDING ORDINANCE

BE KNOWN AS SECTION 71.
WBERE&S, the City CouncLl hereby declares that an emergency
exists for the .immediate preservation of the public peace, property~
safety and welfare, which requires the passage of an emergency 'ordi-
nan'ce regulating traffic upon public streets of the City of Bakersfield;
N0¥~, THEREFORE~ BE IT ORDAINED BY THE COUNCIL OF .THE CITY OF
BAKERSFIELD, as follows:
SECTION 1.
That Ordinance No. 6~8 New Series of the C'ity of Bakersfield,
be and the same is hereby amended by adding thereto a new section to
be numbered 71, said section to read as follows:
Section 71. CERTAIN VEHI~ES PROHIBITED ON NILES STREET
BET%~EEN UNION AVENUE &ND BAKER STREET. (a) No person shal'l operate a
motor vehicle with three or more axles upon or over Niles Street between
the east side of Union .Avenue and the west side of Baker Street.
(b) This Section shall not be construed to prohibit any
vehicle from crossing Niles Street; nor shall it be construed to prohibit
any vehicle from usi~ or traveling over or upon Niles Street when
necessary to reach a destination on Niles Street between the east
side of Union Avenue and the west side of Baker Street for the purpose
of delivering, unloading or loading for transportation, goods, wares
or merchandise, providing such use of Niles Street be made only to or
from the cross street nearest the desti~mtion of such vehicle.
(c) .The City Manager shall cause to be posted at all
entrances to Niles Street between the east side of Union Avenue and
the West side of Baker Street, appropriate signs giving notice of the
provisions of this ordinance.
(d) This section shall have ~m application to any vehicle

which is subject to the provisions of section %0~ of the Public
Utilities .Act of the .State of California; or to vehicles operated
by the federal government or the State of Oel ifornia~ or any agency~
department~ political subdivision or municipal corporation thereof;
or to vehicles of any public utility while actually engaged in the
performance of emergency duties customarily performed, by said public
utilities.
SECTION 2.
· This ordinance is hereby declared to be an emergency measure
within the meanim~ of Section 24 of the~Charter of the City of B'akers-.
field~ State of CalifQrni.'a~ and necessary for the immediate preserva-
tion of t'he public' peace~ property~ safety and welfare and shall take
effect immediately upon its passage by the Council of the City of
Bakersfield. "'"

passed and adopted by the Council of the City of Bakersfield~ at a
