BE IT ORDAIITED BY THE COUNCIL OF THE CITY OF BAtG~RSFIELD,
as follows:
SECTION 1.
That Section 8 of Emergency Ordinance No. 681 New Series of
the City of Bakersfield, be and the same is hereby amended to read
as follows:
SECTION 8. STATEmeNT TO LICENSE COLLECTOR ON GROSS BUSI~,SS:
(a) Every person, firm or corporation required to pay a
license tax as provided by Section 6 above, shall, on the first day
of July of each year, and before any further license is issued,
render to the License Collector, a statement in writing, certifying
that the facts therein set forth are tr. ue, and showing the total gross
receipts during the twelve months immediately prior to the making of
said statements, or the number of tables used in any game, or the
number of chairs· used in any business, if the amount of license is
based upon such number, during the twelve months immediately prior to
the making of such statement, which statement shall determine the
amount due and payable from such person, firm or corporation to the
City of Bakersfield as a license tax for the ensuing year; said
total amount or total yearly license tax due as shown by said state-
ment shall be divided into and paid in two equal semi-annual payments,
the first payment due and payable the first day of July of each year,
and the balance shall be payable on the first day of January each
year. No such statemen~ sh~be conclusive upO~-~h~-~ci~ 'of Baker-s-
field, or upon any officer thereof as to the matters therein set
forth, and the same shall not prejudice the right of the said City

business at each semiannual license renewal date during the first
year such ~ew business is conducted. At the end of the first year
such statement shall be made and a license fee paid as hereinabove
provided for in Subdivision (a) of this section.
(c) Any person required to maker render or sign any state-
ment under the provisions of this ordinance~ who makes any false
or fraudulent statement~ with the intent to defeat or evade the
determination of the amount of license tax due and required to be
paid hereunder~ is ,guilty of a misdemeanor.
I ~[EREBY CERTIFY that the foregoing Ordinance was passed and
adopted by the Council of the City of Bakersfield at a regular meet-
ing thereof held on the 24th day of Nay~ 1948~ by the following vote:

to fix the amount of said license tax at a higher amount, should
there be reason to believe that said business should have a higher
rating than that shown by said statement, nor to recover any amount
that may be ascertained to be due from such person, firm or corpora-
tion~ in addition to the amount shown by such statement if it
should be found to be incorrect; and the License Collect6r shall~
and he is hereby authorized to fix the amount of said license at a
higher rate when he has reason to believe or evidence that said
statement is incorrect. .~ny person, firm or corporation feeling
aggrieved or dissatisfied with such rating by the License Collector~
as aforesaid~ may appear before the Council at the next regular
meeting thereof with proof~ it any~ why said license fee should be
in accordance with their said statement~ and the~finding of the
Council thereon shall be conclusive and they shall direct the License
Collector to issue said license in accordance with such finding.
(b) .Any business, as defined in Section ~, hereinafter
started or commenced~ prior to the passage of this ordinance, or any
business which has not been conducted or operated for the period of
one year and for which a licens~ is required to be paid and a state-
ment of. said business made as set forth in this ordinance by said
person~ firm or corporation so conducting said business~ shall~ if
requested by the License Collector~ semiannually during the first
year said business is being operated or conducted~ render to the
License Collector a statement in writing~ certified to be correct~
showing the total gross income~ receipts or sales of said business~
or the number of tables used for any game in said business, or the
number of rooms in any buiAding being operated in said business,
or fhe numb~ ~f-'V~hicles U:s-e-d in'said bU~iness~ or'th~ number'of
chairs used in'said business~ for the half year immediately prior
to the issuing or renewal of such license, and a like statement shall
be made and filed by the person, firm or corporation conducting such
