HomeMy WebLinkAboutORD NO 787 ORDINANCE NO. ~ NE~'~ SERIES &N ORDINANCE APPROVING ANNEX&TION OF A PARCEL OF UNINHABITED TERRITORY TO THE CITY OF BAKERSFIELD, CALIFORNI&. ¥~REAS, a petition was filed with the Council of the City of Bakersfield on the 10th day of June, 1948~ requesting that certain uninhabited territory therein described be annexed and in- cluded within the incorporated limits of the City of Bakersfield, and . .WHEREAS, said petition was signed by the owners of not less than one-fourth (1/4) of the area of the lam~l in such territory, and representing not less than one-fourth (1/4) of the assessed value of such territory according to the last preceding equalized assess- ment roll of the County of Kern, and WHEREAS, the territory described in said petition is contigu- ous to the City of Bakersfield, and WHEREAS, the Council of the City of Bakersfield did, on the 14th day of June, 1948, pass a resolution in compliance with the provisions of the Annexation of Uninhabited Territory Act of 1939, Statutes of 1939, Chapter 297, as amended, specifically describing the boundaries of the territory so proposed to be annexed to the City of Bakersfield, and designati'ng such territory by an appro- priate identification, and setting Tuesday, July 6, 1948, at the hour of 8 o 'clock P.M., at the Council Chambers in the City Hall in the City of Bakersfield, State of California, as the day, hour and place when and where any person owning real property within such territory so proposed to be annexed a~ having any objections to the proposed annexation may appear before the legislative body and show cause why such territory should not be so annexed; and ................ ~JtE.AS, said re~61~t~'n w~s published for at least once a week for two successive weeks prior to said hearing in t~e Bakersfield Californian, a newspaper of general circulation published in the City of Bakersfield, the municipal corporation to which it is pro- posed to annex such territory, and ~WHEREAS, no written protests were filed against the proposed annexation by any owner of property within the territory proposed to be annexed. NOW, TF~.W~EFORE~ BE IT ORDAINED BY THE COUNCIL OF THE CITY OF B.AKERSFIt~D, as follows: SECTION 1. That the Council of the City of Bakersfield hereby approves the annexation and inclusion within the incorporated limits of the City of Bakersfield, of that certain uninhabited territory designated as that portion of uninhabited territory in the Northwest Quarter Of Sec. 20, T. 29 S., R. 28 E., M. D. B. & M., that is bounded on the east by Tract No. 1088, Tract No. 1260 and Tract No. 1173; on the south, the west and the north by portions of the corporate limits of the City of Bakersfield; and is a portion of the "Ardizzi-Olcese Company Annex to Kern City" in the County of Kern, State of California, as per map of same recorded July 16, 1907, on page 102 in Book 1 of Maps in the Official Records of Kern County, California, being more particularly described as follows: Begi~nning at the most northerly corner of Lot No. 18 in Tract No. 12%~ as said lot is shown on map of said Tract recorded on page 192 of Book % of Maps in the Official Records of Kern County, California; thence along the northerly boundary of said 2tact, said boundary · bei~ a ~rtherly bo~_dary of a portion of the City. of.B. aker.sf.i.e.ld, as follows: South 51u 3%' 00" west a distance of 642.65 feet, thence south 64° %8' %7" west a distance of 205.26 feet; thence north 89° 59' 4%" west a distance of 624.~9 feet; to a point on said northerly boundary that is distan2~· easterly 100 feet from the easterly line of Union .Avenue as said Avenue. is shown on the hereinbefore mentioned Ardizzi-Olcese Company Annex; 'thence north 0° 13' 1%" east parallel with said easterly line along hn easterly boundary of a portion of said City to the southerly boundary of Tract No. 1278 as same is .......... s. hown..on map of same-recorded on page 195 .of Book % of Maps in the Official Records of Kern County, California; said southerly bound- ary being a part of the southerly boum~lary of a portion of said City; thence south 89° %9' 4%" east along said southerly bound- ary a distance of 920.79 feet; thence south 14° 06' 23" west a distance of 9.14 feet; thence south 75° 53' 37" east a distance of 130.88 feet to the beginning of a circular curve in the southerly line of said Tract NS. 1278, whence whose radial center bears north 14° 06' 23" east a distance of 214.12 feet; thence easterly along said curve a distance of 29.21 feet to a point whence said radial center bears north 6° 17' 20" east a distance of 214.12 feet; thence al. ong an easterly boundary .fAa portion of said City north 14° 06' 23" east a distance of 29~.17 feet; thence m~rth 0° 11' 18" ea.st-a distance of 26%.82 feeS; thence alo.~g bo..un~.ary of said portion of said City, south 89u %9' 4%" easu a ais~ance of 15.00 feet to.a point on the easterly line of the Northwest Quarte_r of Sec. 20.
