HomeMy WebLinkAboutORD NO 782 AN ORDINANCE APPROVING ANNEXATION OF A PARCE~ OF UNINHABITED TERRITORY TO THE CITY OF BAEERSFIELD~ CALIFORNIA. WHEREAS, a petition was filed wi'th the ~ouncil of the City of Bakersfield on the 10th day of May, 1948, requesting that certain uninhabited territory therein described be annexed and included within the incorporated limits of the City of Bakersfield, and WHEREAS, said petition was signed by the owners of not less than one-fourth (1/4) of the area of the land in such territory, and representing not less than one-fourth (1/4) of the assessed value of such territory according to the last preceding equalized assess- ment roll of the County of Kern, and V~EAS, the territory described in said petition is con- tiguous to the City of Bakersfield~ am~ WHEREAS, the Council of the city of Bakersfield did on the 10th day of May, 1948, pass a resolution in compliance with the provisions of the Annexation of Uninhabited Territory Act of 19S9, Statutes of 19B9, Chapter 29?, as amended, specifically describing the boundaries of the territory so proposed to be annexed to the City of Bakersfield, and designating such territory by an appro- priate id'entification,, and setting Monday, the 7th day of June, 1948~ at the hour of 8 o'clock P.M., at the Council Chambers in the Ci6y Hall in the City of Bakersfield, State of California, as the day, hour and place when and where any person owning real property within such territory so proposed to be annexed am~ having any objections to the proposed annexation may appear before the legis- ..... _l_a.t.i.v.e_body._.and show cause why such territory shoul_d_._no.t._be.. SO annexed; and WBEBEAS, said resolution was published for at least once a week for two successive weeks prior to said heari~ in the Bakersfield 0 Californian, a newspaper of general circulation published in the City of Bakersfield~ the municipal corporation to which it is pro- posed to annex such territory, and WHEREAS, no written protests were filed against the proposed annexation by any owner of property within the territory proposed to be annexed. NOW~ THEREFORE~ BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAICERSFIEr. D~ as follows.' . SECTION 1. That the Council of the City of Bakersfield hereby approves the annexation and inclusion within the incorporated limits of the ~ity of Bakersfield, of that certain uninb~bited territory designated as that portion of the territory in the h~¥ 1/4 of Sec. 20~ T. 29 R. 28 E.~ M. D. B. & M.~ lying north of the south line of Bernard Street and in general bounded on the north, the south, the east and the west by the corporate limits of the City of Bakersfield, being more fully described as.' Beginning on the southerly line of Bernard Street at the southwesterly corner of that certain territory annexed to the City of Bakersfield by virtue of City Ordinance No. 69?, New Series, thence along_the corporation limits of said City due north a distance of ~0 feet; thence north 0° 00' 1%" east 60.99 feet to the beginning of a curve whence whose radius center bears south 89° 59' 4%" east a distance of 230.00 feet; thence along said curve 20?.05 feet to the r,, of same. whence said radius center bears south 38° 2%' east 235.00 feet; thence north %1o 3%' 00" east a distance of 107.03 feet to the southern corner of that certain territory annexed to said City by virtue of City Ordinance No. ?%9, New Series; thence continuing along said City Corporation limits north 38° 50' 40" west a distance of 150.00 feet to the southerly line of the alley in Tract No. 1258, said southerl, y line being a southern boundary of a ~orti, on ,o,f said City, thence along said .boundary south %1o 35, 00~,, wSst a distance of _413.45 feet., thence south 71 10, 4~,, west a distance of ~5.90 feet, t. hence south 89° 59, 4%,, west a distance of 103%.92 fe.et, thence south .'. .. ~4~ 00, 1~ west a-~.-istance .of~ 14..14.. fee_t.!, the. r~c_e south 0 O0 1% west a distance of 130.00 feet~ thence north 89O %9' 4%" west a distance of 20.00 feet; thence south O0° 00'15" east a distance of 80.00 feet across Bernard Street to the southerly line thereof~ same being a northerly boundary of a portion of the City of Bakersfield; thence south 89° 59f 45" east along said southerly line and D~rtherly boundary to the point of beginning~ containim~ 9.83 acres of land~ more or less.
