GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY · ON TUESDAY, NOVEMBER 2, 1948, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN· MUNICIPAL IMPROVEMENT, AND CON- SOLIDATING SAID ELECTION WITH THE GENERAL STATE ELECTION TO BE HELD ON NOVEMBER 2! 1948. WHEREAS, the Council of the City of Bakersfield, · California, did on the ~th day of August, 1948, by a vote of more than two-thirds of the members of said Council, adopt Resolution No. 81 entitled "Resolution of the Council of the City of Bakersfield, California, determining that the public interest and necessity demand the acquisi- tion and construction, of a certain municipal improvement and making findings relating thereto," which said resolution was duly signed and approved by the Mayor of said city and attested and certified by the Clerk of said city; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Bakersfield, California, on the 2nd day of November', 1948, for the purpose of s.ubmitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinafter set forth, and for the objects and purposes set forth in 'said resolution and hereinafter stated. Section 2. That the objects, and purposes for which said indebtedness is proposed to be incurred and bonds issued therefor are as follows: The acquisition and construction of a certain municipal improvement, to wit: an. overpass for ve~icle and-pedestrian traffic over the right of way of the Southern Pacific Railroad Company and connecting Sonora Street with Alta Vista Drive, including the acquisition of all land, rights of way, and other property necessary therefor. SectiOn 3.. That the estimated cost of the pro- posed municipal improvement described in section 2 hereof is the'sum of seven hundred forty-two thousand eight hundred twelve dollars ($742,812.00); that the amount. of the principal of the indebtedness to be incurred' therefor is the sum of six hundred thousand dollars ($600,000.00); and that the maximum ra~e of interest to be paid'on said indebtedness shall not exceed four and one-half per cent (4-1/2%) per annum,. Payable semiannually. That if the proposition for the incurring of bonded indebtedness so submitted recei·ves the requisite Lnumbe.r ~ .¥o~.~, tq_w~t,.~.t~9~t~i~ds 9f .the votes of the qualified voters voting on said proposition, bonds of said City., in not exceeding the principal amount stated in such proposition, shall be issued and sold for'the objects and purposes set forth in said proposition. Section 4. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously'from said time until seven o,clock P.M. of the Same day, when said polls shall be closed, except as 'provided in SeOtion §734 of the Elections Code of the State of california. 'That on the ballots, to be used at said special' election,.in addition to any other matters required by' law, there shall be printed substantially the 'following: Mark crosses (X) on ballot'ONLY WITH RUBBER STAMP; never with pen .or pencil. (ABSENTEE BALLOTS may be marked with PEN AND INK OR PENCIL. ) INSTRUCTION TO VOTERS To vote on. any measure, stamp a cross (X) in the voting square'after the word "YES" or after the word "NO". All marks, except the cross (X) are forbidden. All distinguishing marks or e~asures .are forbidden and make the ballot void. If you wrongly stamp, tear, or deface· this ballot, return it·to .the inspector of election and obtain another. A cross (X) stamped in the voting Square after the word "YES" shall be counted in favor of the adoption of the question or proposition. A cross (X) stamped in the voting square after the word "No" shall be counted against the adoption of the question or proposition. On absent voters ballots a cross (X) marked as provided in said Elections Code in the voting square after the word "YES" shall be counted in favor of the adoption of the qUestion or proposition, and a cross (X) marked as provided in said Elections Code in the voting square after theword "NO" Shall be counted against the adoption of the question or proposition. Section'5. That the special election hereby Called shall be and is hereby ordered consolidated with the general state election to be held within the City of Bakersfield on Tuesday, November 2, 1948, and said elections shall be held in all respects as if there were only one election and only one for~u of ballot shall be used. Within the City of Bakersfield the precinCts, polling places, voting booths, and officers of election for the special municipal election hereby called shall be the same as · those prOvided for said general state election within said city. The'said precincts, polling places, and names of the elections officers will be set forth in a notice entitled "Election Officers appointed and Polling Places designated by the Board of Supervisors for the General Election to be held November 2,. 19~8",.which notice is to be published by the CoUnty Clerk of Kern County in THE BAKERSFIELD CALIFORNIAN on October i6 and .October 23, 1948, and reference is hereby made to said' notice for said precincts, polling places, and names of election officers. The Board of Supervisors of Kern County is hereby authorized to canvass the returns of'the special municipal election hereby called. Said Board of Supervisors shall certify the result of the canvass of the returns of said election to.the Council of the ~ity of Bakersfield who shall thereupon declare the results thereof. Section 6. That in all particulars not recited in this.ordinance, said special municipal election shall "be held and conducted as provided by law for holding the · general state election in said city.. Section 7. That the Clerk shall certify to the passage and adoption of this ordinance by a vote of ~..~O~e_~.~..~9~.~ds..of all. of the members of the Council Of said city at a regular meeting of said Council, and its approval by the Mayor of said city, and shall cause said ordinance to be published once a day for seven (7) days in THE BAKERSFIELD CALIFORNIAN, a newspaper of general 'circulation 'in said city, printed and published six (6) days a week .in said city. No other notice of such election need be given. Section S. This ordinance shall constitute the proclamation of the election hereby called and no other proclamation of said election need be made. Section '9. The Clerk shall c~Ase a copy of' this ordinance to be posted as provided in. Section I of Ordinance .No. §27 N.S. of said city. Section 10.
