AN ORDINANCE PRovIDING FOR THE c.ARE~ RESTITUTION~
SA~E AND.DESTRUCTION OF LOST. OR UNCLAIMED. PROP-
ERTY IN THE POSSESSION OF THE POLICE DEPARTMENT
OF THE CITY OF BAEERSFI~D ~ CA~ IFORNIA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAEERSFIE~D~ as
follows:
SECTION 1
Ail unclaimed personal 'property in the possession of the Police
Department of the City of Bakersfield shall be stored in a safe place
for a period of m~t less than six (6) months. The Chief of Police
._shall restore such property to its legal owner upon satisfactory
proof of ownership and payment of reasonably necessary costs incurred
in the care and protection thereof, unless such property is held by
the Police Department as evidence in a pending case, in which event
it shall be disposed of only on order of the .proper court.
SECTION 2'
At any time after the expiration of said six (6) months period
the Chief of Police shall sell all such unclaimed personal property~
other than that held as evidence in a pending case, at public auction
to the highest bidder. At least five (5) days prior to ·such sale he
shall c.ause to be published in the Official NewsPaper, a notice of
the time and place thereof'
SECTION 3-
The expenses connected with said sale shall be a proper charge
against the funds of the Police Department and all proceeds received
from said sale shall be delivered to the City Treasurer, who shall'
deposit the same in the. general fund.
SECTION
The Chief of .police may retain any property remaining unsold
after such public auction until the next auction com~ucted pursuant

to the provisions of this ordinance, or may make such other dispo-
sition thereof as he shall see fit in the public interest.

The provisions of this ordinance shall not apply to property
subject to confiscation under State or Federal lawA
