OF ORDINANCE NO. 716 NEW SERIES OF THE
CITY OF BAEERSFI~D~ C.ALIFORNIA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAEERSF~D,
as fellows:
SECTION 1.
That Section 2 of Ordinance No. 716 New Series be and the
same is hereby amended to read as follows:
Section 2. The tax hereby levied, except as otherwise
herein provided, is levied in the same manner, to the same extent
and. under the same co~itions as sales taxes are levied pursuant
to Part 1 of Division 2 of the California Revenue am~ Taxation Code,
known as the =Sales and Use Tax Law," as amended in force and. effect
on October 1, 1949.
SECTION 2.
That Section 13 of 'Ordinance No. 716 New Series be and
the same is hereby amended to read as follows:
Section 13. Ail the provisions of the ,Sales and Use Tax
Law"~ Part 1, Division 2 of the Revenue and Taxation Code of the
State of California, as amended and in force on October 1, 1949~
except the provisions thereof pertaining solely to the Use Tax and
'sections 6051, 6052, 6053, 6066, 6067, 6o68, 6o69, 6o70, 6071, 6451,'
· 6¢59, 6591, 6901 to 693~. inclusive, 6981, ?052, ?056, ?O57, ~101,
7102, y103, 7151, 7152 ;and 7153, applicable to sales of pr.eperty at
- retail, are hereby adopted and made a part of this ordinance as
.though fully set forth herein, and 'all provisions of ar~v other ordi-
-~a~nc~-~n"~-0nflict therewith 'are- inapplicable t'o this ordinance and
the tax hereby imposed. Ail of the provisions of the California
"Sales and i~se Tax Law" hereby adopted, providim~ for the performance
of official action on the part of the State Board of Equalization,
sB~11 be performed by the TreasUrer of the City of Bakersfield°
The City of Bakersfield shall be deemed substituted for the State
of California whenever the State iS referred to in said provisions.
All taxe-~ hereby levied shall be payable to the Treasurer of the City
Of Bakersfield and any civil suit for the collection thereof .may be
filed in any court of competent Jurisdiction in the State of Cali-
fornia, a_~d the City Attorney of Said City shall prosecute the action.
I ~Y ~ERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof'held on the 3rd day of October, 1949, by the fol-
lowing vote:
