NEW SERIES .AN EMERGENCY ORDINANCE AZ~ENDING SECTION $ .AND REPEALING SECTION 8 OF EMERGENCY 0RDIN- ANCE NO. 795 NEV~ SERIES OF THE CITY OF BAKERS- FIELD~ .AND REPE.ALING EMERGENCY ORDINANCE NO. 809 NEW SERIES OF THE CITY OF BAKERSFIELD. WHEREAS, the City Council hereby finds and determines that an emergency exists making it necessary' to provide.for the daily operation of municipal departments. NOW~ THEREFORE~ BE IT 0RD.AINED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: SECTION 1. That Section % of Emergency Ordinance No. 79% New Series of the City of Bakersfield~ be and the same is hereby amended to read as follows: Section %. (a) The City Manager shall act as Personnel Director to administer the basic compensation plan herein contained, and he shall be authorized to place any officer or employee of the City of Bakersfield who is a new employee of the city, or who has been promoted or transferred to an employment assigned to a different salary schedule~in any salary step in such schedule within and including'the first three steps. Provided, however~ that if at t'he time of promotion~ the officer or employee is already receiving a rate of compensation equal to or greater than that provided' within the.first three steps, he shall be placed in the lowest step in such schedule as will entitle him to receive a'compensation greater than he was receiving at the time of his promotion. In determining the proper salary step for such employee the Personnel Director shall take into consideration the previous experience and qualifications' of such officer or employ.ee~ both within the service.of the City of Bakersfield and elsewhere and shall receive and consider reports on such employee from the head of the department in which such person is to be employed. Provided that the officer or employee shall be assigned his proper salary step upon the commencement of his service in the position or employment to which the schedule applies, and auch assignment having once been made shall remain in effect until the said officer or employee, by reason of required length of service, shall be 'entitled to advance to the next salary step. (B) When an officer or employee of the city has been demoted to a position assigned to either the same or a different salary schedule, he shall be placed in the highest salary step in such schedule; provided, however, that should the last salary.~tep in such schedule provide for the same or a higher salary than the particular officer or employee was being paid immediately prior to his demotion~ he shall be placed in the highest salary step in such schedule which provides for a salary lower than the such officer or employee was being paid immediately prior to his demotion. This subsection shall apply to all officers and employees of the city who have been demoted since the adoption o~ Emergency Ordinance No. 794 New Series~ and who have not already been placed in a different salary step by the Personnel Director pursuant to the authority vested in him by said ordinance prior to the adoption of.this amend~ merit. SECTION 2. That Section 8 of Emergency Ordinance No. ?94 New Series be and the same is hereby repealed. SECTION 3. That Emergency Ordinance No. 809 New Series of the City of Bakersfield be and.the'same is hereby repealed. SECTION 4;' This ordinance is hereby declared to be an emergency measure within the meaning of.Section 24 of the Charter of the City of Bakers- field~ State of California~ and necessary to provide for the ,daily operation of municipal departments and shall be effective immediately upon its pass~ge.
