The meeting was called to order by Mayor Payne, followed by the Pledge of Allegiance and Invocation by Reverend Steve Kaay of the First Assembly of God Church. The City Clerk called the roll as follows: Present: Mayor Payne. Absent: None Councilmembers Childs, Christensen, Smith, Ratty, Moore, Dickerson, Salvaggio HEARINGS This is the time set for public hearing regarding amendment to the Redevelopment Element and associated Rezoning of the Bakersfield Metropolitan Area General Plan and Proposed Environmental Documents concerning the following areas: SEGMENT I: The City of Bakersfield Economic Development Department has applied to amend the Circulation Component of the Redevelopment Element of the Bakersfield Metropolitan Area General Plan by deleting the major collector designation of "M" Street south of Truxtun Avenue, and sub- sequent street closing of "M" Street between Truxtun Avenue and the A.T.& S.F. railroad tracks. Mayor Payne declared the hearing open for pub- lic participation on Segment I. Dennis Fox, 918 Blossom, expressed concern regarding issues which were left out and some which are inconsistent with the Redevelopment Element. No further protests or objections being received and no one wishing to speak in favor, Mayor Payne closed the public por- tion of the hearing for Council deliberation and action. Upon a motion by Councilmember Ratty, Resolution No. 174-87 of the Council of the City of Bakersfield making findings, adopting negative declaration and approving proposed amendment to the Circulation Component of the Redevelopment Element of the Bakersfield Metropolitan Area General Plan was adopted by the fol- lowing vote: Ayes: Noes: Absent: Councilmembers Childs, Christensen, Smith, Dickerson, $alvaggio None None Ratty, Moore, This is the time set for a public hearing concerning an Amendment to the Casa Loma Specific Plan of the Bakersfield Metropolitan Area General Plan covering the following location: Bakersfield, California, September 16, 1987 - Page 2 The Kern County Department of Planning and Development Services has received a request to amend the Casa Loma Specific Plan at 835 East Brundage from General Commercial (6.2) to Light Industrial (7.1) for the purpose of retaining an existing auto impound yard. The proposed amendment is forwarded to the City for review, public hearing and recommendation from the City Council. Mayor Payne declared the hearing open for public partic- ipation. No protests or objections being received, and no one wishing to speak in favor, Mayor Payne closed the public portion of the hearing for Council deliberation and action. Upon a motion by Councilmember Ratty, the Mayor was authorized to transmit a letter to the Board of Supervisors suggesting denial of the proposed amendment by the following vote: Ayes: Councilmembers Childs, Christensen, Dickerson, Salvaggio Noes: None Absent: None Smith, Ratty, Moore, REPORTS Assistant City Manager Strenn read Report No. l from the Miscellaneous Civil Service Board regarding Nepotism as follows: Recently the Miscellaneous Civil Service Board was made aware of several situations involving nepotism. During our discussion ot these situations, the Board was informed that there is a discrepancy between the Civil Service Rules and the Municipal Code. Under the Municipal Code (2.72.130), the Civil Service Boards may make a determination on nepotism only if the person is married or living in the same household. However, there are instances where a relative may be con- sidered for a position in a sensitive area, and yet not reside in the same household. The Board believes that the Civil Service Rules and the Municipal Code should be consistent, and therefore we are proposing the attached revision, which is more inclu- sive and allows the Civil Service Boards to make a deter- mination, on an individual basis as to whether a conflict does or will exist, irrespective of whether the individuals live in the same household. The Police and Fire Civil Service Boards, and all bargaining units have reviewed and endorse this Board's recommended changes. The Miscellaneous Civil Service Board requests the City Council's adoption of this revised nepotism ruling. Councilmember Childs requested the Civil Service Board address the problem of temporary employees and consider the possi- bility of treating them as a regular employee, i.e., if there is a question, let the Civil Service Board make a determination. Councilmember Childs stated, for the record, that he thinks it is an injustice and its treating two types of employees in a different manner. Councilmember Salvaggio made a motion to approve the report. Bakersfield, California, September 16, 1987 Page 3 179 Mayor Payne restated Councilmember Salvaggio's motion to accept the report. This motion was approved by the following vote: Ayes: Noes: Absent: Councilmembers Christensen, Smith, Ratty, Moore, Dickerson, $alvaggio Councilmember Childs None Upon a motion by Councilmember $alvaggio, an Ordinance of the Council of the City of Bakersfield amending Section 2.92.130 Of the Bakersfield Municipal Code relating to Nepotism - Apointment of spouse or relatives, was given first reading by the following vote: Ayes: Noes: Absent: Councilmembers Christensen, Smith, Ratty, Moore, Dickerson, $alvaggio Councilmember Childs None Councilmember Dickerson stated that Councilmembers who have concerns will have an opportunity to raise them at the time of second reading of the ordinance. Councilmember Childs clarified his vote stating that the report is clear and indicates extensive work by the Civil Service Board. He indicated that he voted no because the report in English, and he did understand it. Councilmember $alvaggio clarified his vote stating that the main reason for supporting this report is because it makes sense, and that the management staff endeavored to involve the Police, Fire, Miscellaneous Civil Service Boards and all the bargaining units, and tried to improve the system. Councilmember Childs, Chairman of the Budget and Finance Committee, read Report No. 35-87 regarding the acceptance of Rental Rehabilitation Program Funds for FY 87/88 and the approval of the Memorandum of Understanding between the City and the Kern County Housing Authority as follows: On September 9, 1987, the Budget & Finance Committee considered the acceptance of the Rental Rehabilitation Program funds for the improvement of investor owned multi-family housing units. The U.S. Department of Housing and Urban Development has designated $113,000 to be used for the rehabilita- tion of rental units primarily occupied by low and moderate income families. These funds will provide loans to make health and safety improvements on existing units. This program is designed to utilize Section 8 Certificates/Vouchers to maintain affor- dability of these units once completed. The Rental Assistance portion of the program must work in con- junction with the Kern County Housing Authority. The Memorandum of Understanding is a requirement of the acceptance of the Rental Rehabilitation Program Funds. Staff is further directed to investigate methods to ensure safe and decent rental units for the City of Bakersfield. Therefore, it is recommended that the Memorandum of Understanding be approved; that the funds be appro- priated and the Mayor be authorized to execute the fL80 Bakersfield, California, September 16, 1987 Page 4 agreement; and authorize staff to accept the Rental Rehabilitation Funds and implement the program. Upon a motion by Councilmember Childs, Report No. 35-87 from the Budget and Finance Committee was accepted. Upon a motion by Councilmember Childs, the recommenda- tions contained within Report No. 35-87 from the Budget and Finance Committee were implemented by the following vote: Ayes: Councilmembers Childs, Christensen, Dickerson, Salvaggio Noes: None Absent: None Smith, Ratty, Moore, Councilmember Salvaggio requested that Councilmembers be given copies of the revised Report. ACTION ON BIDS Upon a motion by Councilmember Moore, low bid from Boise Cascade in the amount of $12,078.76, for annual contract for office supplies was accepted, the other bids rejected, and the Mayor was authorized to execute the Contract. Upon a motion by Councilmember Moore, low bid from Industrial Electric Manufacturing, Inc. in the amount of $6,948.00, to furnish manufactured electrical panelboard for Ashe Water Pumping Station No. 19 was accepted, all other bids were rejected, and the Mayor was authorized to execute the Contract. Upon a motion by Councilmember Christensen, low bid from Bakersfield Sandstone Equipment in the amount of $12,447.33 (3 items), Abate-A-Weed in the amount of $2,905.57 (1 item) and Bakersfield Tractor in the amount of $707.01 (l item) for miscellaneous lawn equipment for parks was accepted and all other bids rejected. DEFERRED BUSINESS Adoption of Ordinance No. 3119 New Series of the Council of the City of Bakersfield amending Title Seventeen of the Bakersfield Municipal Code by changing the Land Use Zoning of those certain pro- perties in the City of Bakersfield located on the south side of Stockdale Highway between Chapala Drive and South Jenkins Road from an R-1 (One Family Dwelling) Zone to a C-1 (Limited Commercial) Zone. This Ordinance was given first reading at the meeting of September 9, 1987. Councilmember Ratty made a motion to adopt Ordinance No. 3119 New Series. After further discussion, Councilmember Childs called for a vote on the item. Councilmember Ratty's motion to adopt Ordinance No. 3119 New Series of the Council of the City of Bakersfield was approved by the following vote: Ayes: Councilmembers Childs, Christensen, Dickerson, $alvaggio Noes: None Absent: None Smith, Ratty, Moore, Bakersfield, California, September 16, 1987 - Page 5 NEW BUSINESS First Reading of an Ordinance of the Council of the City of Bakersfield amending Sections 2.92.010, 2.92.090, 2.92.330, repealing Section 2.92.170, and amending and repealing Section 2.92.100 of the Bakersfield Municipal Code relat- ing to the Fire Department Relief and Pension Fund. Adoption of Resolution No. 175-87 of the Council of the City of Bakersfield Initiating Proceedings for the Annexation of Territory to the City of Bakersfield identified as Proceeding No. 935, Annexation No. 312, in accordance with LAFCO Resolution Making Determination (Mt. Vernon No. 4). This Resolution initiates the proceedings for the annexation of Mt. Vernon No. 4 and sets the date for the Protest Hearing for October 21, 1987.
