HomeMy WebLinkAboutORD NO 962 ORDINANCE NO. q6,2- NEW SERIES AN ORDINANCE PRESCRIBING TIME. WITHIN WHICH TO RECEIVE BALLOTS OF ABSENT VOTERS. WBEREAS, the Elections Code of the State of California was amended by Statutes at the Third Extra Session of 1950, permitting the receiving of ballots of wa~ voters up to sixteen days after the day of election, and WHEREAS, under the provisions of Section 67 of the Charter of the City o'f Bakersfield, there would be insufficient time to declare the results of the nominating~election and~to print and prepare .the necessary ballots for the general municipal election if a period of sixteen days were allowed after the hominating election, within which to receive b~llots of absent voters, and WHEREAS, under the provisions of said El~ction Code there is insufficient 'time elapsing between the time prescribed for the receiv- ing of ballots of absent voters after the general election and the time set for newly elected councilm~n to assume the duties of their office, 'as prescribed By Section 19 of the Charter of the City of Bakersfield, and WHEREAS, this Council deems it advisable, convenient and neces- sary to reduce the number of days allowed for the receiving of such ballots to coincide with the time permitted for municipal elections in fifth and sixth class cities. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield' as follows: SECTION 1. All bal'lots cast as prescribed in the Elections Code of the State of California regulating absent voting and pursuant to the Charter of the City of Bakersfield regulating nominating and general 1. elections, shall be received by the Clerk of the City' of Bakersfield, from whom they were received, within six (6) days after the date of the election. SECTION 2, This ordinance shall have no application to consolidated or. special elections. SECTION 3. This ordinance shall become effective thirty days after the date of its passage. .... --o0o ......
