AN EMERGENCY ORDINANCE PROHIBITING CER~
TAIN LAND USES WITHIN THE CItY OF BAKERS-
FIELD, AND PRESCRIBING CERTAIN EXCEPTIONS
WHEREAS, the City Planning Commission has undertaken the
preparation of a new land use plan and zoning ordinance for the City
of Bakersfield, and
WHEREAS, owing to the necessity for careful studies and
thorough a~.alyses of the facts in the preparation of said plan and
ordinance, considerable time will necessarily elapse before said
plan and ordinance will be ready for adoption by the City Council,
and
WHEREAS, lamge number? of persons will, unless restrained,
obtain building permits and co~nce construction of buildings and
structures wl~.ch will not conform to the provisions of said plan
and ordinance and which will tend to defeat the operation of the
same, which action will result in a permanent and irreparable injury
to the City of Bakersfield and to the inhabitants of the districts
in which such buildings and structures are erected and will hamper
the future growth of the City and impair the welfare of its citizens
and inhabitants, and
WREP~,AS, this Council hereby finds and detex~aines that an
emergency exists making it necessary to adopt certain regulations for
land uses in the City of Bakersfield .in order to provide for the
immediate preservation of the public h~alth, peace, property and safety.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield, as follows:
........... SECTION 1.
The following uses are hereby prohibited in the City of
Bakersfield except upon the granting of a special permit issued by

the City Council in the manner as provided in Ordinance No. 501
New Series, for the g~anting of adjustments and variances:
1. Ai.rport or aircraft landing fields.
2. Cemeteries, columbariums.., crematories' and mausoleums.
3. Establishments or enterprises involving large assem-
blages of people or automobiles, including: Amusement'
parks, circuses, carnivals, expositions, fairgrounds,.
op. en-air drive-in theatres and/or cinemas, race tracks,
recreational and sports centers.
4. Radio and television transmitters.
5. .Golf courses and country clubs.
SECTION 2.
Any person, firm, or corporation, whether as principal, agent,
employee or otherwise, violating or causing the violation of any of
the provisions of this ordinance shall be guilty of a misdemeanor,
and upon conviction thereof shall be punishable by a fine of not more
than $300~00 or by imprisonment in the County Jail of the County of
Kern for a term not exceeding tb_~ee months, or by both such fine and
impri s onme nt ·
SECTION 3~
This ordinance is hereby declared to be an emergency ordi-
nance within the meaning of Section 24 of the Charter of the City of
Bakersfield, and shall take effect immediately upon its passage.

I PIEREBY CERTIFY that the foregoing Emergency Ordinance
was passed and adopted by the Council of the City of Bakersfield at
