AN EME1fGENCY ORDINANCE OF THE CITY OF

ING.-
AND/OR PRESENTING COMPLAINTS AGAINST .
MEMBERS OF THE POLICE••DEPARTMENT BY-PERSONS
OTHER THAN THE APPOINTiVE POWER.
M,REAS, �thsre is no provision :in the 'Charter of the
-City of�Bakersfield, which prescribes. the 'method' of'filing 'or
-presenting; compl-aints against members of the. Police Department;
and : . Th4 •Coin.cil of' the City 'of Bakersfield -believes.. it
necessary for the proper conduct- and function-of a :municipal •
-de partmen't# .that certain rule s and regulations be formul ate d
for the orderly and. proper .presehtation.:of complaints or charges
against: members of the Police -Department; and-
This' Council finds that it is. necessary and proper to
.: .provide for the investigation of charges when presented. or filed
by:persons other than- the, appointive power, before ' a formal
complaint is ..filed with the- Civil Service Commission for"..the
Bakersfield Police Department; 'and
WHEREAS, an- emergency exists .making. it ' necessary to
Provide for the daily ope.ration.'of a.municipal department-,. and
for the' preservation. of -the .public . peace and safety.
NOW THEREFORE BE. IT ORDAINED by the Council of the
City of Eakersfield -as follows:
SECTION le
(a)'. Any person, other .than- the -authority having the:
appointive power, believing'.that he •has a grievance against any
-- `member of the�l�olice Department, shall, .before any formal complaint
- is filed- with the Civil Service- Commission' for.. the Police Depart-
me ht.,j present a, verbal or-written statement- of such grievance to

causing. such 'grievance,,. Upon' 'receipt :of .such statements the
appointive power shall 'at. once investigate or cause to be invests-

grounds to: subs tantiate.•'the..charges; shall file°. or permit to. be
:.filed.-by the...aggrieved, a:"formal::complai' t° against. the 'ac"c' se
with -said Civil -Service..Commissi'6n,
.. Should the appointive power find, upon;111ve stigation, that
the charges . against the:. accused are.-:unfourided'.or'� untrue, or, not
within the jurisdiction .of the. Civil Service Commission, no.. formal
complaint shall "be filed with said .Cori"ission and-:the appointive
power. shall inform the person di.Limi'.g- to" .be aggrieved' of the.. .

(b) .in all other' cases, complaints' .shall be filed by the

SECTION. 2..
This'':ordinance 'is hereby .declared' to• be an- emergency
measure.. within -the'.meaning of Section 24 'of .the :Charter of the
City :of -Bakersfield, State of: California, and necessary -to -provide
for -the dai•ly operation of A municipal department and. shall take'.
