. AN ORDINANCE PERTAINING TO THE
ERECTION AND MAINTENANCE OF .MUSEUMS
AND ART GALLERIES "ON- PUBLICLY OWNED
PROPERTIES IN THE CITY OF BAKERSFIELD.
WHEREAS, Sections .5135 to- 'and. including 5138 of the Public
Resources' Code of the State of California, being Division 5, Chap-
ter 2, Article 2.5 .of "aid Code, provides that every : city and every
. c.ounty may accept title to real property for museum or art gallery
purposes, or permit the erection. of.'buil.dings and improvements for
such purposes - on lands owned by the city or' county, and .
It is the desire of the. Council of the City of Bakersfield
.'t.o make available to the ,citizens of Bakersfield the opportunities
afforded by -.the provisions of the above-mentioned sections of said
Public-Rb-s'ources Code.
..NOW, THEREFORE, BE _IT ORDAINED by the -Council of the City of
Bakersfield as' follows*. .
SECTION 1.
The' City' of Bakersfield may accept . title to real property
for museum or, art gallery purposes, -or may .permit. the erection of
buildings: anc. improvements for such purposes on' lands owned by said
city.
SECTION 2.
Whenever any donation of real property has been made to the
;City of Bakersfield for museum or art gallery purposes,' or any.
building or improvements therefor have been erected upon public lands _
by an individ.ual 'or corporation without cost to the city, the City
Council",.may .delegate the management, operation, maintenance and
regulation thereof to, the donor or his successors, or to boards of
trustees or.- directors nominated by the donor and appointed by the
CC- AP
-City. -Council; ..upon; such terms and- conditions as 'the City Counc. l
may prescribe.
SECT ION 3..

of-. the City ,• f Bakersfield hereby'. require's "as follows:
` (a). '.. T:zat' a].1 members ;of the. public- shall be- admitted to the
Sallery or .rwaseum at, reasonable. times', which times shall 'be specifi=
cally approv,3d by the City Council.
lb) That no charges- for' admission: to the gallery or museum
shall be 'made other than such charges as may .be determined by this .
Council to be necessary. to• defray .,the - cost of operation -and mainten
ance of .the .gallery or. miis-eum;- and that all •accounts and financial
records 'of the donor or tkie'.board of directors or managers nominated
-relating to the operation, 'management, or •maintenance' of the•
gallery' or -museum shall be -subject to 'such ,insPection and .audit as .
may `be •directed by thin Council.
..(c)' That all questions involving...'the determiriation of- policy
..or :-t1a6-.6xe'rc:L.3e of discretion 'in the management;, operation, main=
t-eniii ce, or regulation of the. ga•1lery - or museum shall be-.referr.ed
to-'.the..-Council . of the City of •Bakersfield,. .together with the recom-
mendat'ions .'of• the ' 'donor. or' 'the. board- of directors' or managers 'thereon,

SECTION 4.
The: C.oxmcil of the 'City" of -'Bakersfield 'may appropriate and
expend-funds for the improvement, operation, expansion and s.upp.ort

the -powers• here.in set forth, ..any. other- power necessary ' and proper. .
