EMERGENCY ORDINANCE NO. I _ NEW SERIES . '
AN EMERGENCY ORDINANCE AMENDING SECTION 6. ,
OF ORDINANCE NO. 8?9, NEW SERIES, :.:-AND REPEAL-
._ING EMERGENCY ORDINANCE NO. 892, NEW SERIES,
BOTH OF THE CITY OF .BAKERSFIELD, CALIFORNIA.
WHEREAS, at times it becomes necessary -for available•
personnel in the employ of the City of Bakersfield- to work additional
. .:hours and shifts over and above their regular weekly or'monthLy
work schedule and to pay such personnel. fov such additional hours '
or shifts 'ab worked, and
.-WHEREAS,- because of such facts, this Council hereby finds.
'that an emergency- exists making it necessary to provide for the .
immediate .preservation of the public peace, property and safety
andfor the daily operation of municipal departments.
NOW; THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield,' -as follows:
-SECTION 1.
- That Section 6. of -Ordinance. No. '879, New Series .of . the City
of Bakersfield, .be and the same is hereby amended to read as follows:
Section 6. (a) In the- event it becomes necessary 'for' any
..: .off3c7er--:or. Employee -of -thee. City of Bakersfield to work-, additional
hours or:-. sh3 f t s over and above his. regular- weekly- or .monthly work
schedule; -oompensatory time off equivalent to the additional hours
-.or- shifts- so .worked shall be allowed, or compensation shall be- paid
at an hour-ly rate based upon such employee' s regular monthly .salary
when divided by the number of days ..in the particular month in which
such additional work was performed and prorated to the" number of
additional -hours actually worked by such employee, except .that in
the ' case of,.members of the Fire Department such additional compensa-
tion- shall -be. paid only -for full .shifts worked over and above the
regular monthly or weekly schedule: . Such- additional compensation
. 7 . ,to be paid.to each member of the Fire Department working - such- ad-

diti•onal shift or shifts; shall be computed by dividing the monthly
rate assigned to . such member by. fi;tom. -J.15) and. multiplying. the
resulting quotient by the number,,,;-af` .additional shifts worked .over
and .above the regular monthly or weekly work schedule of such member.
(b) In-no event shall compensation be• allowed for- working
such additional 'time without the pr.iQr,: authorization of the City
Manager. or the Assistant City Manager; -that-'such additional. work
. may be performed.
(c) This. section shell have no application to attendance by
an- officer or employee at meetings of. the ..City.. Counci:l: or any board
or co�mi.ssion of the, City in the'. performance of hid.. regular' duties.
SECTION 2.
Tbat 'Emergency.-Ordinance' No. -892, New Series of the City of
Bakersfield. be and the- same i.s .hereby. repealed.
SECTION 3-
This ordinance is- hereby declared to be an emergency measure
within the .meaning of Section 2!{. of the Charter of the:City .of
Bakers-field,,. State of California,, and necessary to ,provide for the
im�iediate preservation of the .'publid peace, property and safety,
and. for the daily operation 'of municipal departments, and shall take
effect' izinnediately upon its passage.
I HEREBY CERTIFY that the�' foregoing-Emergency Ordinance
was passed and adopted by -the Council- of the Cit y of Bakersfield
at a regular meeting thereof held on -the 25th day' of July, 1955,
