HomeMy WebLinkAboutORD NO 1099 a "� 1 ORDINANCE NO. 1099 NEW SERIES AN ORDINANCE APPROVING ANNEXATION OF A PARCEL OF UNINHABITED TERRITORY TO THE CITE OF BAKERS- FIELDa CALIF'ORNIA, AND PROVIDING FOR THE TAXA- TION OF SAID TERRITORY TO PAY THE BONDED IN- DEBTEDNESS OF SAID CITY. WHEREAS, a petition was filed with the Council of the City of Bakersfield on the 13th day of July, 1956, requesting that certain uninhabited territory therein described be annexed to and included within the incorporated limits of the City of Bakersfield,, and WHEREAS, said petition was signed by the owners of one-fottr•tih of the land, by area, and by assessed value as shown on the last equalised assessment roll of the County of Kern., and WHEREASq the territory described in said petition is contiguous to the City of Bakersf ield9 and WHEREASO said territory does not form a part of any other eity, and WHEREAS, on the lath day of July., 1956., there was filed in the office of the City Clerk of the City of Bakersfield, a written consents signed by all the owners of property included in said territory, that said territory be subjected to taxation after the completion of such annexation equally with property in the City of Bakersfield to pay the bonded indebtedness of said City therein described, as provided for in Ordinance No. 893, New Series of the City of Bakersfield, and in Ordinance Mo. 950 p New Series of the City of Bakersfield, and any and all other indebtedness or liability of the City which may accrue from and after the date thereof, and this Council hereby determines that said consent is signed by all the o"I'Mers of property included in said territory, and complies in every respect with the provisions - of section-•35.31:9• -of the Goverment rode -of.-the State--of-Cali.fGvmiava and WHEREASg the Council, of the City of Bakersfield dial„ on the 30th day of J9:il.yD 1956, pass a Resolution being No. 46-56, in compIxence with the provisions of the Annexation of Uninhabited. Territory Act of 1939, and amendments thereto, being Title 4, Division 29 Part 2, Chapter la Article 5 of the Government Code of the State of California, 1, . specifically describing the boundaries of the territory so proposed to be annexed to the City of Bakersfield, and designating such terri- tory by an appropriate name, and setting Tuesdays Saptember 4, 1956, at the hour of eight oeclock P.M.s in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the day, hour and place when and where the City Council would hear protests made by any person owning real property within the aforesaid territory, and WHEREAS, said Resolution was published at least twice, but not oftener than once a week in The Bakersfield Californian, a newspaper of general circulation published in the City of Bakersfield, and also in The Oildale News, a newspaper of general circulation published outside of the City of Bakersfielde but in the county where said territory is located, said publications having been completed at least twenty days prior to the date set for said hearings In compliance with Section 35311 of the Government Code, and WHEREAS, the City Clerk of the City of Bakersfield has caused written notice of such proposed annexation to be given by mail at least twenty days before the public hearing on said proposed annexa- tion in compliance with Subdivisions (a) and (b) of Section 35311 of the Government Code of the State of California, and WHEREAS, at the time set for hearing protests$ no written protests were filed against the proposed annexation. by any owner of property within the territory proposed to be annexed. NOW's THEREPORED BE IT ORDAINED by the Council of,the City of Bakersfield$ as follows SECTION 1. That the Council of the City of Bakersfield hereby approves the annexation and inclusion within the incorporated limits of the City of Bakersfielde of that certain uninhabited territory designated as COLLEGE CREST SUBDIVISION, the boundaries of which are described as follows A portion of the North-half of Section Fifteen (15� Town- ship Twenty-nine (29) South, Range Twenty-eight (2 ) East, Mount Diablo Base and Meridian, together with a portion of 2. " . x. the East fifty-five (55) feet of the Northeast Quarter of Section Sixteen (16) $ Township Twenty-nine (29) South, Range Twenty-eight (28) East, Mount Diablo Base and Meridians -all being rdore particularly described as follows: Beginning at the Southeast corner of the Norticr.rest- quarter of Section 152 Township 29 South, Range 28 East, Mount Diablo Base and Meridian, said point being a corner on the boundary of the corporate limits of the City of Bakersfield; thence Jest along said corporate limits and along the south line of the Northwest quarter- of Section 15g To,=ship 29 Southt Range 28 East., Mount ]Diablo Base and Meridian and the South lane of the Northeast quarter of Section 16$ to a point distant fifty- five (55) feet Nest as measured at right angles from the East line of: said Section 16; thence North and parallel to said East line of Section 16 a distance of three-eighth (3/8) of a mile, more or less$ to a point in the Sot?therly line of the North-half of the Northeast quarter of the Northeast quarter of said Section 16; thence, leaving said cor orate boundaries and running East a distance of fifty-five M) feet, more or less, to the Southwest corner of the North-half of the North- west quarter of the NortIniest quarter of said Section 150 thence continuing East a distance of one-fourth (1/4) of a mile to the Southeast corner of the North-half of the North- west quarter of the Northwest quarter of said Sectian 159 thence North one-eighth (1/8) of a mile to the Northeast corner of the Northwest quarter of the Northwest quarter of said' Section 15$ thence East along the North line of said Section 15 a distance of one-half ( 2) mile to the Northwest corner of the Northeast quarter of the Northeast quarter of said Section 15; thence South along the West line of the Northeast quarter .of the Northeast quarter of said Section 15 to a point distant three hundred sixty (360) feet as measured at right angles from the North :Line of said Section 15; thence East and parallel to said North line of Section 15 a distance of one-fourth (1/4) mile to a point in the East line of said Section 15; thence South along said East line of said Section' 15 to the Southeast corner of the Northeast quarter of said Section -15; thence West along the South line of the Northeast quarter of said Section 15 a distance of one-half (1/2) mile to the Southeast corner of the Northwest quarter of Section 15s mld corner being the place of beginning of this description. SECTION 2. Said territory, and the property located therein, shall, upon the completion of the annexation of the same to the City of Bakers- field,, be subjected to taxation equally with other property in thn City of Bakersfield to pay the bonded indebtedness of the City of Bakersfield, described In the aforementioned consent of the otaners of property located therein, the issuance of bonds to represent said indebtedness being provided for In Ordinance No. 893, New Series of the City of Bakersfield, and 3n Ordinance No. 950, New Series of .said City, and any and all other indebtedness or liability of the City which may accrue from and after the date thereof. 3. SECTION 3 0 This ordinance shall become effective thirty days from and after the date of its passage. .
