AN ORDINANCE DETERMINING A 'PRIMA FACIE

· W~REAS, the CoUncil of. the Cit~ of Bakersfield, pursuant $0.
the provisions of Section 511.3 (a) of the Vehicl0 Oode of the
of 0alifornia, has determined, upon the basis .of an engineering
:. 'knd traffic survey, that a speed greater ~han 25 miles .per hour,
to wit: 35 miles per hcur, would facilitate the orderly movement of
vehicula~'traffic and would be reasonable and ·safe upon that
of Union Avenue between Niles Street .and Bernard Street, which' said
portion is otherwise subject to a prima facie limit of. .'25 ·miles per
hour.
NOW, THEKEP-0RE, BE IT oRDAINED by the Oouncil of the 0ity of
Bakersfield, as follows: ...
SECTION 1. -'
That a. prima facie speed of 35 miles per hour be and the'same ..
is hereby determined and declared to' be the prima facie speed a~
· "i"~: which vehicles may travel on Union Avenue between the northerly
line of Niles Street and the southerly line of Bernard Street,.
SECTION 2.
This Oodncil..finds that an emergency exists requiring the
regulation of traffic upon the. above-mentione~ :street, and, therefore,'
hereby declares this' ordinance to be an emergency measure within the
meaning of Secti6n 24 of the Charter: o.f the City of Bakersfield, .'
State of California, and necessary fer the ..immediate preservation
of the ·public peace·, property and safety, and shall take effect
immediately upon its passage.
