The appeal must be filed in writing within 10 days from date of the Board’s hearing with the City Council, c/o City Clerk; 1501 Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those within the public notice area, must include a $675 non-refundable filing fee with the appeal. If all appeals are withdrawn before the City Council’s meeting, they will not hear the item and the Board’s decision will become final. The City will not issue any permit, license or other approval for a use involved in an application until after the appeal period has closed. If the City Clerk does not receive an appeal within the 10-day period, the Board’s decision will become final. 2. PUBLIC STATEMENTS This portion of the meeting is reserved for persons wanting to address the Board on any not on matter this agenda and over which the Board has jurisdiction. CONDITIONAL USE PERMITS 1) File No. 06- 0305 – A Conditional Use Permit to allow the (Ward 2) construct two new 1,025 sq. ft. dwellings to replace two deteriorated substandard residences and retain an existing dwelling on a 17,250 sq. ft. lot located in a C-1 (Neighborhood Commercial) zone located at 1122 Kentucky Street. Staff Recommendation: Approve 2) File No. 06-0350 - A Conditional Use Permit to allow a 1,800 sq. ft. (Ward 2) billiards parlor that includes the on-site consumption of alcohol within an existing mixed-use commercial center in a C-1 (Neighborhood Commercial) zone district located at 1800 Brundage Lane #A. Staff Recommendation: Approve billiards parlor Deny on-site sales & consumption of alcohol 3) File No. 06-0365 – A Conditional Use Permit to allow a to allow a (Ward 6) 672 sq. ft. sales facility for a 2 year period of time for Tract 6290 in an R-1 (One Family Dwelling) zone district located at 4903 Switch Grass Way. Staff Recommendation: Approve 4) File No. 06-0369 – A Conditional Use Permit to allow a to allow a (Ward 4) 384 sq. ft. sales facility for a 2 year period of time for Tract 6448 in an R-1 (One Family Dwelling) zone district located at 14506 Coneflower Drive. Staff Recommendation: Approve 5) File No. 06-0432 -- A Conditional Use Permit to allow an existing (Ward 2) private university (University of Phoenix) to increase student population from 350 to 450 in a C-O (Professional and Administrative) zone located at 4900 California Avenue.
