HomeMy WebLinkAboutORD NO 1198 0RDINA CE NO. lle (NEW SE I S) AN 0~qDINANCE OF THE CITY OF BAKERSFIELD CALIFORNIA, ORDERING, CALLING, 'PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELEC- TION TO BE HELD IN THE CITY OF BAKERS- FIELD ON THE 4TH DAY OF NOVEMBER, 1958, FOR THE PURPOSE OF SUBMITTING TO THE QUALI- FIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT, AND CON- SOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE. WHEREAS, the Council of the City of Bakersfield, · California, did on the 18th day of August , 1958, by a vote of more than two--thirds of the members of said Council, adopt Resolution No. 53-58 , entitled "Resolution of the Council of the City of Bakersfield, California, determining that the public interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relating thereto," which said resolution was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; NOW, TH?/SEFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Bakers- field, California, on the 4th day of November, 1958, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinaft~ S~b"~r~-h, and for th~ object and purpose set forth in said resolution and hereinafter stated. Section 2. That the object and purpose for which said indebtedness is to be incurred and the bonds issued therefor is as follows: The acquisition and construction by the City of Bakersfield of a certain municipal improvement, to wit: a municipal auditorium and public assembly building suitable for conventions, trade shows~ sports and athletic eventsj exhibitions, musical and dramatical presentations and group meetings~ together with land- scaping and off-street parking facilities therefor and including the acquisition of all land, furniture~ furnishings~ apparatus~ equipment and other property necessary therefor. Section 3. That the estimated cost of said municipal improvement is the sum of $~750,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $~750,000. The estimated cost of said municipal improvement includes any or all of the following: (a) legal or' other fees incidental to or connected with the authorization~ issuance and sale of the bonds, and (b) the costs of printing the bonds and other costs and expenses incidental to or connected with the issuance and sale of the bonds. Section 4. That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law~ to wit, six per cent (6%) per annum~ payabl~.~nnuall~ the first year and semiannually thereafterj the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 5. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit: two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city, in not exceeding the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. Section 6. That the polls for said election shall be opened at seven o'clock A.M., of the day of said'election and shall remain open continuously from said time until seven o'clock P.M., of the same day, when said polls shall be closed, except as provided in Section 57~ of the Elections Code of the State of California. Section ?. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED. WITH PEN AND INK OR ~N~IL. ) INSTRUCTIONS TO VOTERS To vote o~ any measure, stamp a cross (+) in the voting square after the ~Ord "YES" or after the word "NO". All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. A cross (+) placed in the voting square after the. word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 9. That said special election hereby called to be held in the City of Bakersfield on the 4th day of November, 1958, shall be and is hereby ordered consolidated with the statewide general election to be held on said date, and within the City of Bakersfield the precincts, polling places and office~s of election for the .special election hereby called shall be 'the same as those provided for said general election. The Board of Supervisors of the County of Kern is hereby requested to order the consolidation of the special election hereby called with said statewide general election, and said Board of 'Supervisors is authorized hereby to canvass the returns of the special election hereby called~ and the elections shall be held in all respects'as if there were only one election, and only one form of ballot~ namely the ballots used at such general election, shall be used. Said Board of Supervisors shall certify the result of the canvass of the returns of such special election to the Council of the City of Bakersfield who shall thereupon declare the result thereof. Said proposition shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Section 38~1 of the Elections Code of the State of California. Section 10. That, except as otherwise provided in this ordinance, said special elections hereby called shall be conducted as provided by law for other municipal elections in said city. Section ll. That the Clerk shall certify to the passage and adoption of this ordinance by a vote'of at least two-thirds of all of the members of the Council of said city~ and shall cause said ordinance to be published once a day for at least seven days prior to said elections in THE BAKERSFIELD .......... This ordinance shall constitute the proclamation of the elections hereby called and mo other proclamation of said elections need be made. Section lB. The Clerk shall cause a copy of this ordi- nance to be posted as provided in Section i of Ordinance No. 527 N.S. of said city. Section lt. This ordinance shall take effect upon the expiration of.thirty (30) days from the time of its passage. ADOPTED, SIGNED AND APPROVED this 19th day of August, 1958.
