HomeMy WebLinkAboutRES NO 100-06 RESOLUTION NO. 1 0 0 - 0 6 A RESOLUTION OF THE CITY OF BAKERSFIELD AGREEING TO THE FORMATION OF THE DOWNTOWN BUSINESS IMPROVEMENT DISTRICT AND AUTHORIZING THE MAYOR TO SIGN THE PETITION AGREEING TO BE INCLUDED THEREIN. WHEREAS, California law permits property owners to form Business Improvement Districts (BID) whereby the owners are assessed a certain amount each year to be used for safety, security, maintenance, landscaping, etc.; and WHEREAS, the BIDs are administered by private organizations; and WHEREAS, in order for such a BID to be formed, a majority of the property owners in the proposed district must vote in favor of the BID; and WHEREAS, if a BID is formed, all property owners within the BID are assessed - even property owners who are exempt from real property taxes, such as governmental entities; and WHEREAS, the Downtown Business and Property Owners Association (DBA) desires to form a BID (the Downtown Business Improvement District) which will be bounded by Garces Circle to the north, the Burlington Northern Santa Fe railroad tracks to the south, "F" Street to the west and "V" Street to the east; and WHEREAS, that proposed BID consists of 900 parcels owned by 523 different owners; and WHEREAS, the City owns seventeen parcels within the proposed BID and, thus, must vote whether or not the BID should be established; and WHEREAS, the City will benefit from the formation of the BID by receiving day and night security patrols, 5 day-a-week trash pickup, graffiti removal within 24 hours of reporting, 6 day-a-week sidewalk sweeping and other maintenance benefits; and WHEREAS, the proposed annual assessment for the City parcels would be $47,988.23 and can be increased no more than five percent (5%) per year; and WHEREAS, if approved, the BID would exist for five years, at which time the property owners can vote to renew the BID up to ten more years. \\,"f S:\Agreement\2006 Resos\dbidpetition.doc March 22. 2006 Page 1 of 3 >- I- ~Ó ...^ .""- nr.:""·'·" ;. NOW, THEREFORE, BE IT RESOLVED, by the Council ofthe City of Bakersfield as follows: 1. herein. The above recitals are true and correct and incorporated by reference 2. The City of Bakersfield supports the formation of a Downtown Business Improvement District and desires to be a part of it. 3. The Mayor is authorized to sign the petition which is attached hereto as Exhibit "A" agreeing to the formation of the Downtown Business Improvement District and to forward the signed petition to the Downtown Bakersfield PBID Steering Committee. ----------000---------- Page 2 of 3 .
