TO PAY ~ BONDED ~N~EBTR~NESS OF SAID C~. t~EREAS, a petition ~as filed wilh the Co,mci1 of the City of Bakersfield on 'the 22nd day of September, 1950, ?equesting '~hat certain uninhabited ~er~itory therein described be annexed ~o and incorporated within the City of Bakersfield, and ~{EREAS~ said petition was signed by the owners of all of the territory to be annexed, and WHEREAS, the territory described in said petition is contiguous to the City ~f Bakersfield, and WHEREAS, the said territory does not form a .part o~ any other cit~ ~nd ~REAS, on lhe 22nd day o~ September, 1960~ there was file~ in the o££ice o~ tlae City Clerk of the City of Bakersfield, a written consent~ aigned by all the o~aiera o£ property included in said territory, thai said territory be sub}ec~ed to taxation a£1er the comple~i~n o~ such annexation equally with ~he p~operty in the City of Bakersfield to pay the bonded indebtedness o~ said Cit~ therein d~scribed,, aa provided for in'Ordinance No. 893, Me~ Series, in'Ordinance No. 950, New Series, in Ordinance No. ll~2, New Series, and in Ordinanc~ Ne. 1229, New Series, all of the City of Bakersfield~ and any and' all other indebtedn'e§a' or liability of the City o~tmtanding or authorized on. and after the dale of completion o£ said annexa~ion, and this Council hereby determines thai said consent is signed by all the owners of property inci. uded in said territory, and complies in every respect wi'~h the provisions of Section 35319 of the Governmen~ Code of the State cf Californla, and 1. }~rIEREAS~, the Council of the City of Bakersfield did, on the 26th day of September, 1960, pass a Resolution being No. 102-60, in compliance with the provisions of the Annexation of Uninhabited Territory Acl of 1939~ and amendments thereto, being Tit1e i, Division 2, Part 2, Chapter l, Article 5 of the Government Code of the State of California, speci£ically describing the boundaries of the territory so proposed to be annexed to the City of B~cersfield, and designating such territory by an appropriate name, and setting Monday, the 31st day of October, 19600 at the hour of ri§hr o'clock P.M.~ in the Council Chambers of the City Hall, 1501 Truxtun Av.~nue, Bakersfield, California~ as the day, hour and place when and where the City Council would hear protests made by any person ovming real property within the aforesaid territory, and I%~EREAS~. said ~esolution was pub!ished at least twice, but not oftener than once a week in The Bakersfield Califo:nian~ a newspaper of ~eneral circulation publ!she, d in the City of Ba~iers£ield, said publication having been completed at least' twenty days prior to the date set for said hearing, in compliance with Section 35311 of the Government Code, and ~tEREAS, at the time set for hearing protests, no ~itten protests were filed against the proposed annexation by any ollier of property within the territory proposed to be annexed. NOW, Bakersfield~ a~ follows: SECTION That the Council o£ the City o£ B~:ers£teld hereby approves the annexation to and inclusion ~ithin the incorporated limits o£ the City of Bakersfield, of'that certain uninhabited territory desi~nate~ as v'Castro No. be and lhe same is hereby annexed to said City; that said territory is described as A parcel of land situate in the County off Mern, State of California, and ~eing a portion.of Section 12, Township 30 South, Range 27 East, M, D. M.; Commencing at the northwest (N, W.) corner of the south-' west quarter (S. W. 1/4),'of said Section 12; ~hence easterly along the northerly boundary of the said south- west quarter (S. Wo 1/4) of Section 12, a distance of 220.00 feet, and to the true poimt of beginning off this description; thence southerly and parallel, with the westerly boundary off the said southwest quarter (S. W. of Section 12, to inta~sect a line parallel wi~h, dlstant 30 fleet southerly as m~s~red perpendicular to the northerly boundary off the sou'~hwest quarter off said Section 12; thence easterly along last named parallel line t~ intersect ~he westerly boundary line of the east halff ('f. 1/2), of ~he northeast quarter (No E.'I/d), of the northwes~ quarter (N. I~. 1./4), of the southwest quarter (S. W. 1/4), ofl said Section 12, a point on the current corporate boundary of the City of Bakersfield; thence continuina easeerly aion~ last named parallel line, on and along said corporate boundary and as same is defined by that certain Annexation designated as Benton Park No. d~ as adopted February 1, 1960, by Ordinance No. 1276, N~v Series, and which was certi£i~d March 4, 1960, by the Secretary ~fl State, Si:ate o~ California, to intersect the southerly prolongation of l:he westerly boundary line of the northeast q~arter (N. E. Said territory, and the property located therein~ shall, upon the completion of the annexation of the same to i:he City of Bakersfield, be subjected to taxation equally with o~her property in the City of Bakersfield to pay the bonded indebtedness of the City of Bakersfield, described in the aforementioned consent of the o.~ners of proper~y, located therein~ the issuance of bonds ~o represen~ said indebtedness bein~ provided for in Ordinance No. 893~ New Series, in Ordinance Noo 950, New Series, in Ordinance No. 1t!2, New .e~xes,S ~' and in Ordinance No. 1229, New Series, all of said City, and any and all other indebt- edness or liability of the City outstanding or authorized on and after the date of completion of said annexation. SECTION 2. This ordinance shall become effective thirty days from and afte~ the date of its passage.
