AN ORDINANCE OF THE CITY OF BAKERSFIELD ADOPT-
ING BY REFERENCE A COMPREHENSIVE ORDINANCE CODE
TO BE KNOWN AND DESIGNATED AS THE "BAKERSFIELD
MUNICIPAL CODE" AND REPEALING ALL OTHER ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT WITH SAID CODE.
BE IT ORDAINED by the Council of the City of Bakersfield,
as follows:
SECTION 1o
_AppROVA~_L~0F CODE. The City Council does hereby find and
determine, as a result of study and. investigation by the City and
its City Attorney, ~that the Bakersfield Municipal Code is an approved
Code for adoption by reference within the meaning of Section 50022.1
of the Government Code of the State of California.
SECTION 2.
ADOPTION_ OF..CODE. That the codification of the City
Charter and the Ordinances of the City of Bakersfield of a general,
public or pernanent nature, or imposing a fine, penalty or forfeiture,
as contained and set forth in a printed copy thereof on file in the
office of the City Clerk entitled "MUNICIPAL CODE, CITY OF BAKERSFIELD"
be, and is hereby adopted as the official Code of the Charter and
Ordinances of the City of Bakersfield, as provided in Sections 50022.1
through 50022.9 of the Government Code of the State of California.
SECTION 3.
PUBLIC NEARING AND ,NOTICE. After the first reading of
the title of this Ordinance and the title of the Code to be adopted
hereby, there shall be a public hearing thereon on the 19th day of
September, 1960, and notice thereof shall be given in accordance with
Section 6066 of the Government Code of the State of California by
publication of a notice in The Bakersfield Californian, a newspaper
of general circulation printed, published and circulated within the

City of Bakersfield. Said notice shall be published in accordance
with Section 6066 of the Government Code and shall state the time
and place of the hearing and shall state that copies of said Bakers-
field Municipal Code, being considered for adoption, are on file with
the City Clerk of the City of Bakersfield and are open to public
inspection. Said notice shall contain a description sufficient to
give notice to interested persons of the purpose of the Code to be
adopted by reference and the subject matter thereof. The City
Council does hereby find and determine that the following is a
sufficient description to be incorporated in said notice to interested
persons of the purpose of the Code and the subject matter:
"A Municipal Code entitled ,Municipal Code, City
of Bakersfield', comprising the City Charter
and all general ordinances of the City of Bakers-
field."
SECTION 4-
AMENDMENTS. That in accordance with Section ~0022.?
of the Government Code of the State of California, the City Council
of the City of Bakersfield may propose and adopt amendments to the
Bakersfield Municipal Code and, in the discretion of the City Council,
such amendments may be adopted by reference as provided in Sec-
tion ~0022.7 of the Government Code of the State of California, or
an ordinance may be enacted in the regular manner, setting forth the
entire text of such amendment.
SECTION 5.
VIOLATIONS OF CODE - PENALTY That Title 10, Chapter

10.0?, Section 10.07.010 of the proposed Code entitled "Violation
of Code - General Penalty" be amended to read as follows:
10o07.010 Violation of .co.d_.e--G?neral ~e_nalt~. Unless

otherwise expressly provided herein, any person violating any of the
provisions or failing to comply with any of the mandatory requirements
of this Code, shall be guilty of a misdemeanor° Any person convicted
of a misdemeanor under this Code where punishment is not otherwise
provided for herein, shall be punished by a fine of not more than
Five Hundred Dollars, or by imprisonment in the County Jail for a
period not to exceed six months, or by both such fine and imprisonment.
Each such person shall be guilty of a separate offense for each and
every day during any portions of which any violation of any provisions
of this Code is committed, continued or permitted by any such person
and shall be punished accordingly.
In addStion to the penalties hehetn provided, any con-
dition caused or permitted to exist in violation of any of the pro-
visions of this Code shall be deemed a public nuisance and may be,
by the City, summarily abated as such, and each day each condition
continues shall be deemed as a new and separate offense.
SECTION 6.
REPEALER. All other ordinances or parts of ordinances
in conflict with this Code, are hereby repealed.
SECTION ?o
ADOP~ION. BY. REFERENCE. That said Bakersfield Municipal
Code be and the same is hereby adopted by reference and need not be
published.

regular meeting thereof held on the 19th day of September, 1960, by
