HomeMy WebLinkAboutORD NO 1342 CRDINANCE NO o 1342 (NEW SERIES ) AN ORDINANCE OF THE CITY OF BAKERSFIELD, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELEC- TION TO BE HELD IN THE CITY OF BAKERSFIELD ON THE 28th DAY OF FEBRUARY, 1961, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CER- TAIN MUNICIPAL IMPROVEMENT, AND CONSOLIDAT- ING SAID ELECTION WITH THE NOMINATING ELEC- TION TO BE HELD IN SAID CITY ON SAID DATE. WHEREAS, the Council of the City of Bakersfield, California, did on the '2?th day of December , 1960, by a vote of more than two-thirds of the members of said Council, adopt Resolution No. 12d-60 , entitled "Resolution of the Council of the City of Bakersfield, California, deter- mining that the public interest and necessity demand the acquisition and construction of a certain municipal improve- ment, and making findings relating thereto," which said resolu- tion was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; NOW, THEREFGRE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Bakers- field, California, on the 28th day of February, 1961, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinafter set forth, and for the object and purposes set forth in said resolution and hereinafter stated. Section 2. That the object and purpose for which said indebtedness is to be incurred and the bonds issued therefor is as follows: The acquisition and construction by said city of a certain municipal improvement, to wit: additions to the municipal auditorium and public assembly build- ing including an ice rink refrigeration system, an ice rink floor system, a pit hoist, carpeting, fixed seating, kitchen equipment and kitchenettes, stage draperies and a counterweight system, stage dimmers and control panels including portable lighting, sound equipment, ceramic tile wainscots, exterior painting, asphaltic tile flooring, acoustical tile on plaster, communica- tion equipment over the arena, together with paving of parking areas, ornamental shrubbery and curbs, gutters and sidewalks, and including all furniture, furnishings, apparatus, equipment and other property necessary therefor. Section 3. That the estimated cost of said municipal improvement is the sum of $850,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $850,000. The estimated cost of said municipal improvement includes any or all of the follow- ing: (a) legal or other fees incidental to or connected with the authorization, issuance and sale of the bonds, and (b) the costs of printing the bonds and other costs and expenses incidental to or connected with the issuance and sale of the bonds. Section 4. That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually the first year and semiannually thereafter, the actual rate or rates of interest on said 'bonds to be determined at or prior to the time of the sale or sales thereof. Section 5. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit: two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city, in not exceeding the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. Section 6. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said time until seven o'clock P.M., of the same day, when said polls shall be closed, except as provided in Section 5?34 of the Elections Code of the State of California. Section ?. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MAR WKED WITH PEN AND INK OR PENCIL.')" INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the word "NO". All marks, except the cross (+) are forbidden. All.distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in~favor of the adoption of the question or proposition° A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 9. That said special election hereby called to be held in the City of Bakersfield on the 28th day of February, 1961, shall be and is hereby ordered consolidated with the City of Bakersfield nominating election to be held in said city on said date, and such election shall be held in all respects as if there were only one election, and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for this special election shall be the same as those provided for said nominating election, and said precincts, polling places and officers of election are set forth in the resolution providing for said nominating election, to wit, Resolution No. 4-61 adopted by this Council on the 3rd day of January , 19 61. That the Clerk shall certify to the passage and adoption of this ordinance by a vote of at least two-thirds of all of the members of the Council of said city, and shall cause said ordinance to be published once a day for at least seven days prior to said elections in THE BAKERSFIELD CALIFORNIAN, a newspaper of general circulation in said city, printed and published six days a week in said city. Section 12. This ordinance shall constitute the proclamation of the election hereby called and no other proclamation of said election need be made. Section 13. The Clerk shall cause a copy of this ordinance to be posted as provided in Section i of Ordinance No. 527 N.S. of said city. Section 14. This ordinance shall take effect upon the expiration of thirty (30) days from the time of its passage. ADOPTED, SIGNED AND APPROVED this 3rd day of January , 19_~kl__.
