HomeMy WebLinkAboutORD NO 1367 ORDINANCE NO..~L~d}/__, NEW SERIES AN ORDINANCE AMENDING CHAPTER 8.64 (SEWERS-- USE AND CONNECTIONS) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD. BE IT ORDAINED by the Council of the City of Bakersfield that Chapter 8.64 of the Bakersfield Municipal Code enacted on the 4th day of June, 1913, entitled Sewers--Use and Connections, be and the same is hereby amended to read as follows: CHAPTER 8.64 SEWERS--USE AND CONNECTIONS Sections: 8.64.010 Definitions. 8.64.020 Requirements for Sewage Disposed into Sewage System. 8.64.030 Discharge of Industrial Wastes. 8.64.040 Discharge of Industrial Wastes--Permit Required. 8.64.050 Discharge of Cooling System Water into Sewage System. 8.64.060 Discharge of Sw~ ..... ~ng Pools into Sewage System. 8.64.070 Maintenance of Sewer Connections. 8.64.080 Limits and Prohibition for Protecting the Sewage Treatment Plant and Municipal Farm. 8.64.090 Payment of Damages Resulting from Violation of this Chapter. 8.64.100 Authority to Shut Off Connections to Premises Violating this Chapter. 8.64. 110 Penalty for Violation. 8.64.010 Definitions. (a) "City" shall mean the City of Bakersfield, a municipal corporation of the State of California. (b) "City Engineer" shall mean the City Engineer of the City of Bakersfield or his authorized representative. (c) "Person" shall mean any individual, firm, company, association, society, corporation or other legal entity. (d) Normal Sanitary Sewage. (e) "Industrial Wastes" shall mean the liquid wastes from industrial processes as distinct from normal sanitary sewage. Any sewage exceeding maximum limits of normal sanitary sewage shall be classified as industrial waste. (~ "Bio-chemical Oxygen Demand" shall mean the quantity of oxygen utilized in the bio-chemical oxidation of organic matter under standard laboratory procedure in five days at 20° Centigrade, expressed in milligrams per liter. (g) "Standard Methods" or "Standard Laboratory Procedure" shall mean the procedures outlined in the latest edition of the book, "Standard Methods for ~he Examination of Water and Sewage", published by the American Public Health Association. (h) "Suspended Solids" shall mean the solids in industrial wastes which are removable by filtering as prescribed by Standard Methods of the American Public Health Association. (i) "pH" shall mean a measure of hydrogen-ion concentration or acidity in which the neutral point of ?.0 and decreasing number indicate '~reater acidity as prescribed by Standard Methods. (3) "Sanitary Sewer System" or "Sewer System" shall mean all facilities for collecting, pumping and transporting domestic or industrial wastes of any nature, including all such facilities both inside and outside of the city limits of Bakersfield owned, operated and controlled by City. 8.64.020 Requirements for Sewage Disposed into Sewage Syst~-m. No person shall discharge or cause to be discharged into the sanitary sewer system of the City any of the following materials, wastes or waters: (a) Any liquid or vapor having a temperature higher than 150°F. or 65°C. (b) Any waters or wastes which contain grease or oil or other substance which will become discernibly viscous at temperatures be~ween 32° and 150OF. (c) Any waters or wastes containing emulsified oil and grease exceeding an average of 50.parts per m~ llion of ether soluble matter. The maximum admissible concentration shall be not more than 100 ppm for a period not to exceed 15 minutes in any one hour. (d) Any gasoline, benzine, naptha, fuel oil, mineral oil or other flaam~ble or explosive liquid, solid or gas. (e) Any noxious or malodorous gas such as hydrogen sulphide, sulphur dioxide, or nitrous oxide or other substance while either singly or by interaction with other wastes, is capable of creating a public nuisance or hazard to life or of preventing entry into sewers for their maintenance and repair. (f) Any household garbage that has not been properly comm~nuted or triturated. Ail ground garbage shall be capable of passing through a 1/2" mesh screen before being introduced in the sewer system. (g) Any ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar, plastics, wood, paunch manure, hair and fleshings, entrails, lime slurry, lime residues, beer or distillery slops, chemical residues, paint residues, unscreened cannery waste, bulk solids, or any ot/~er solid or viscous substance capable Of causing an obstruction to flow in sewers, or other interference with the proper operation of the sewer system. (h) Any waters or wastes, acid or alkaline in reaction, having corrosive properties capable of causing damage or hazard to structures, equipment, or personnel. Free acids and alkalies must be neutralized at all times to within a permissible pH range of 5.5 to 8.5. (i) Any cyanides in excess of 5 ppm by weight as CN. (]) Any radioactive isotopes having a half life of more than 100 days except by special perm~ t. (k) Any waters or wastes that for a duration of more than 15 minutes in any 3-hour period has a concentration greater than 5 times that of "normal" sewage as measured by suspended solids, B.O.D. or conductivity. (1) Any waters of non-sewage or non-industrial waste origin, such as waters from water well developments, storm water, etc., except by special pe;%ait issued by the City Engineer. Each case shall be examined on its own merits. 8.64.030 Discharge of Industrial Wastes. No person shall place, deposit or discharge into the sanitary sewer system of the City any of the following: (a) Any industrial or other waste, water, liquid or other substance in which the suspended solids exceed 2,000 parts per million, determined by weight. (b) Any waste with a Bio-chemical oxygen demand of more than 5,000 parts per million. Ail industrial wastes shall meet the applicable specifications of Sections 8.64.020 and 8.64.080. Ail industrial wastes shall be pretreated before entering the sanitary sewer system in such a way that they will be further treatable and disposable by the system available to the City of Bakersfield. Pretrea~nent shall be approved by the City Engineer. 8.64.040 Discharge of Industrial Wastes--Permit Required. (a) No person shall discharge industrial wastes into the sanitary sewage system of the City without first obtaining a permit so to do 4. from the City Engineer. Such permit shall be known as an 'Industrial Water Pea-mit". Application for such permit shall be made in writing to the City Engineer and shall contain the following information: (1) NAme and address of applicant. (2) Location of connection or proposed connection urith sanitary sewer system. (3) Estimated gallonage of wastes proposed to be discharged and statement as to approximate time of discharging same, together with information as to peak loads, and such other sim~ 1ar data as the City Engineer may require. · (4) Statement of the character of the waste proposed to Be discharged, including such detail in connection therewith as the City Engineer may require. (B) Bond Retuirement. T~e City Engineer may in his discretion require that an applicant 'for an Industrial Waste Permit shall file a Bond in an .amount deemed adequate By the City Engineer to indemnify the City and any other person a~ainst all loss, expense, or damage which may result from or arise out of the granting of the permit and the discharge of Industrial wastes into the Sanitary Sewer System of ~he City. The City Engineer may require the Bond as a condition precedent to the issuance of an industrial waste permit or at any time after a permit is granted. 8.64.050 Dischar~e of Coolin~ System Water into Sanitary Sewer Sys tern. (a) Water which has Been used as a cooling medium in any cool, r, appliance, device or other apparatus, shall not in any ~Anner Be discharged directly or indirectly into the sanitary sewer system of the City,'. provided, however, that Bleed-off water from cooling towers, not in excess of 15% of intake water, may Be discharged into the sanitary sewer .system. (B) No person shall Be permitted to maintain or use any connection in violation of Section 8.64.050 (a) and any such connection in existence at the tim of the effective date of this Code shall be disconnected from the Sanitary Sewer System of the City. 8.64.060 Dischar~e of Sw4~mtn~ Pools into Sanitary Sewer System. (a) Ail swi,,-,,;ng pools in the City of Bakersfield shall be equipped with a filtration system which will pe.-~uit the reuse of the water in said swi,-,,,~ng pools for a period of not less than one year. (b) The discharge pipe from said swimming pools shall not be larger than one inch and the water in said pools shall not be discharged into the sanitary sewer system of said City more often than once a year and not until a permit has been obtained from the City Engineer who shall designate the time for the discharge of such water. In no event shall such discharge of water from swi ..... lng pools be at a time when the climatic temperature is higher than seventy degrees F. (c) All swi~uu,ing pools existing at the effective date of this ordinance shal'l be made to conform with the provisions of this ordi- nance · 8.64.070 Maintenance of Sewer Connections. Ail property owners shall be required to maintain the sewer connection from their respective property line to the City sewer. 8.64.080 Limits and Prohibition for Protectin~ the SewaKe Treatment Plant and Municipal Farm. No person shall discharge or cause to be discharged into the sanitary sewage system of the City any waters or wastes containing a toxic or poisonous substance~ a high chlorine demand or suspended solids in sufficient quantity to injure or interfere with any sewage treatment process, constitute a hazard to humans or animals or create any harmful effect or hazard to the Sewage Treatment Plant or the land on which the sewage effluent is disposed. Such toxic substances shall be limited to the average concentration for a 24-hour period, listed hereinafter. At no time shall the hourly concentration exc. eed three times the average concentration. If the concentrations listed are exceeded, individual establishments will be required to pretreat their sewage in an accepted manner, before discharging it into the sewer system. Said pretreatment shall be approved by the City Engineer. Limits of some toxic substances in sewage: Iron, as Fe 20 ppm Chromium (as hexavalent Ct) - - 5 ppm Copper, as Cu 5 ppm Zinc, as Zn 10 ppm Chlorine demand - 120 ppm Phenol 20 ppm Chloride, as C1 -300 ppm As other toxic substances not listed above are required to be discharged into the sewer system, the limiting quantities of these substances shall be set from info~--~tion derived from a responsible source or by actual tests using accepted methods. 8.84.090 Payment of Damages Resultin~ from Violation of this Chapter. In the event that any person deposits any substance in any sewer, sewer'pipe, manhole, septic tank connected with the sanitary sewer system of the City in violation of the provisions of this chapter, in addition to any other penalties provided by this chapter, such person shall pay the City for the damage caused thereby and for the cost of any cleaning of any portion of said sanitary sewage system made necessary by reason thereof. The City Engineer shall determine the amount of such damage and costs and shall mail to the occupant of the premises wherein said substances were placed or deposited in said sewer, sewer pipe, manhole, septic tank connected with the sanitary sewer system a statement of the same. 8.64.100 Authority to Shut Off Connections to Prer~ses Violate-? this Chapter. The City Engineer shall have the authority to shut off any premises from the use of the City sanitary sewer system where the occupant or user of such premises is placing, discharging or conducting any water ?. or wastes into the sanitary sewer system of the City in violation of this chapter. 8.64.110 Penalty for Violation. Any person, firm or corporation violating any provision of this chapter shall be deemed guilty of a misdemeanor and each such person shall be deemed ~uilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions thereof is committed, continued or 'permitted and upon conviction of any such violation such person shall be punishable by a fine of not more than ~500.00 or by imprisonment of not more than 30 days or by both such fine and imprisonment. All ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed. It is the intention of the City Council that this ordinance, and every provision thereof, shall be considered separable; and the invalidity of any section, clause, provision, or part or portion of any section, clause or provision of this ordinance shall not affect the validity of any other portion of this ordinance. o0o I HEREBY CERTIFY that the foregoing Ordinance was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 26th day of June, 1961, by the following vote: Council of the City of Bakersfield.
