AN ORDINANCE GRANTING SOUTHERN PACIFIC COMPANY A
~ltANCHISE TO CONSTRUCT AND RELOCATE RAILROAD
TRACKS ACROSS 30TH STREET, IN THE CITY OF
BAKERSFIELD, COUNTY OF KERN.
WHEREAS, 'the Southern Pacific Company,. a corporation, did on
the 18th day of September, 1961, present its petition and application
to this Council wherein it prayed that permission be granted to it
and to its successors and assigns, a permit to lay down, construct,
maintain and operate additional railroad track of standard gauge,
across 30th Street in the City of Bakersfield, the center line and
location of said track being particularly set forth in said petition
and application, and
WHEREAS, it appearing to the satisfaction of this Council
that the said railroad track, as prayed for, is necessary in order
that said Southern Pacific Company r,,y properly conduct and carry on
its business in said City of Bakersfield,
NOW, THEREFORE, BE IT ORDAINED that there be and there is
hereby granted to the Southern Pacific Company, a corporation, its
successors and assigns, a franchise with the right and privilege and
permission to lay down, construct, mRintain and operate a railroad
track of standard gauge across a Street in the City of Bakersfield
described as follows:
Description of Center Line of Track to be Constructed
Across 30th Street, P.U.C. Crossin~ B-311.5
Beginning at a point on the northerly line of 30th
Street 300 feet, more or less, westerly from the inter-
section of the westerly line of Jewett Avenue in the City
of Bakersfield, County of Kern, State of California; thence
southeasterly 137 feet, more or less, to a point on the
southerly line of 30th Street 197 feet, more or less,
from the intersection of the westerly line of said Jewett
Avenue.
That this franchise to lay down~ construct~ maintain and
operate said railroad track is granted subject:
1. To such regulations and conditions as may be prescribed
from time to time by the Council of the City of Bakersfield.
2. To the use of said railroad track for the transportation
of freight for hire.
3. That said Railroad track must be laid to conform to the
grade of the Street over which it passes·
4. That it must be operated under such restrictions as not
to interfere wit/~ the use of said Street by the public, and
5. That this franchise shall be revocable at the pleasure of
the Council of the City of Bakersfield.
I HEREBY CERTIFY that the foregoing Ordinance was passed and
adopted by the Council of the City of Bakersfield at a regular meeting
thereof held on the 3§th day of No~ehbe~1961, by the following vote:
