HomeMy WebLinkAboutORD NO 1402 EMERGENCY ORDINANCE NO. 1402 NEW SERIES AN EMERGENCY ORDINANCE OF THE CTTY OF BAKERSFIELD TRANSFERRING THE ASSESSMENT AND TAX COLLECTING DUTIES AND THE COLLECTION OF ASSESSMENTS LEVIED FOR MUNICIPAL PURPOSES NOW PERFORMED BY. THE CTTY ASSESSOR AND THE CITY TAX COLLECTOR TO THE ASSESSOR AND TAX COLLECTOR OF THE COUNTY OF KERN AND REPEALING ~T~T~ ORDINANCES OR PARTS OF ORDT- NANCES IN CONFLICT HEREWITH. WHEREAS, the City of Bakersfield, a municipal corporation desires to transfer the assessment and tax collection duties performed by the City Assessor and City Tax Collector to the Assessor and Tax Collector of the County of Kern pursuant to Section 50 of the Charter of the City of Bakersfield and Sections 51500 to 51519 of ~he Government Code of the State of California; and WHEREAS, Section 51502 of the Government Code provides that a copy of the ordinance transferring the functions of the assessor*s office to the county must be filed with the county auditor on or before the first Monday in February following the adoption of the ordinance; and WHEREAS, in order for the transfer to be effective during 1962 it is necessary to enact an emergency ordinance; and WHEREAS, the City Charter provides that emergency ordinances may be enacted whenever the operation of a municipal depart~nent is affected. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: Section 1. PLACE IN CODE. This ordinance shall be Chapter 6.30, Sections 6.30.010 to 6.30.080, inclusive, of Title 6 of the Municipal Code of the City of Bakersfield. 'Section 2. DEFINITIONS. Th~. following words and expressions when used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them as follows: (a) CITY. The word "City" as used in this ordinance shall mean the City of Bakersfield, a municipal corporation, situated in the County of Kern, State of California. (b) COUNTY. The word ."County" shall mean the County of Kern, a political subdivision of the State of California. Section 3. TKANSFEK OF DUTIES. The duties of the City Council, Assessor, Tax Collector, Auditor and City Clerk of the City of Bakersfield with respect to the assessment of property in said City for the purpose of ad valorem taxation thereof to the equalization and correction for such assessments, to the collection, payment and enforcement of such taxes hereafter becoming a lien, to the sale of property for non-payment of such taxes levied for municipal purposes, and to the redemption of such property from sale or other penalties for non-payment of the municipal taxes of said City, shall be per- formed by the officers of the County'of Kern charged respectively with the performance of duties of the same character as the officers of said City whose duties are to be performed by such County officers. Ail duties .now being perfo~-~ed By the above mentioned City officers which are not specifically transferred by the provisions of this ordinance shall continue to be performed in accordance with the applicable laws of the City. Section 4. TAXES LEVIED P~IOR TO DATE OF ORDINANCE. Ail taxes of said City that shall have Been levied prior to the effective date of this ordinance, including delinquent taxes, shall be collected, the payment thereof enforced in the s~m~_ manner and upon the same penalties, and property sold for .:the.. non-payment thereof and redeemed from such sale in the same manner and under the same conditions as. provided by laws in force in said City at the time of the taking effect of this ordinance, and .the officers of said Ci2y.as now provided under the Charter and any ordinance thereof, shall collect and enforce the payment of such taxes, including delinquent taxes and do any and all things that may be necessary in the sale of property for -the non-payment of such taxes and in the redemption thereof from such sale.. .Section 5. CDMPENSATION. The amount of compensation to be charged by and paid to County for the performance of services herein contemplated shall be fixed by agreement between City and County pursuant to Section 51514 of the Government Code of the State of California. 'Section 6. FILING OF CERTIFIED COPY. The City Clerk shall cause a certified copy of this ordinance to be filed with the. County Auditor, County Tax' Collector and County Treasurer prior to the first day of February, 1962. Section 7.. MONEY WITHDRAWN FROM COUNTY TREASURER. The money collected by the County for the City, shall be drawn from the City Funds in the hands of the County Treasurer by County Auditor~'s Warrant. Section 8. REPEALING. Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 9. EFFECTIVE DATE. This ordinance is hereby declared to be an emergency measure within the meaning of Section 24 of the Charter of the City of Bakersfield, 'State of California, and necessary to provide for the daily operation of municipal departments, and shall be effective on and after February 1, 1962. o0o 3.
