AN ORDINANC~ APPROVINC ANNEXATION OF A PARCEL OF
UN'rNHAB'rTED TERRITORY TO TIIE CITY OF BAI~RSF~,
CALIFORNIA, DESIgNATeD AS 'B~.NTON PARK NO. 7," AND
PROVIDING FOR THE TAXATION OF SAID TERRITORY TO
PAY TH~- BONDED INDEBTEDI~SS OF SAID CIT~.
~IE~S, a petition was filed with ~he Council. of the
City .of Bakersfield on ~he 31st day of May, 1962, requesting ~haC
certain uninhabited territory ~herein described be annexed to and
incorporated within the City of Bakersfield, and
WHEREAS, said petition vas si~ned by ~he owners of all'
of the territory to be annexed, and
WHE~S, the territory described in said petition is
conti~uous territory to be annexed, and
WHARF, S, the said territory does not form a part of any
o~her, city, and
WHEREAS, on the .3lst day of May, 1962, there was filed
in the office of the City Clerk of the City of Bakersfield, a
written consent, si~ned by all the owners of property included in
said territory, that said territory be subjected to taxation after
~he completion of such an~exation equally with the property in the
City of Bakersfield to pay ~he bonded indebtedness of said City
therein described, as provided for in Ordinance No. 893, New Series,
in Ordinance No. 950, New Series, in Ordinance No. 1112, New Series,
and in Ordinance No. 1229, New Series, all of ~he City of Bakers-
field, and any and all other indebtedness or liability of the City
outs~anding or au~horized on and after the date of completion of
said annexation, and this Council hereby determines t~st said con-
~erritory, and complies in every respect with the provisions of
Section 35319 of the Government Code of the State of California,
and
b'HEREAS, ~e Council of the City of Bakersfield did, on
the ;+th day o£ June, 1962, pass a Baoolution being Ho. 36-62, in
compliance w~.th the provisions of the Annexation of Uninhabited
Territory Act of 1939, ~_d amendments thereto, being' Title 4, Division
2, Part 2, Chapter 1, Article $ of ~he Goverm~ent Code of the S~ate
of California, specifically describins the boundaries of the
territory so proposed to be annexed to the City of Bakersfield, and
desis~ating such territory by an appropriate name, and setting
N~nday, ~he 16~h day of July, 1962, at the hour of eight o'clock
P.M., in ~he Council Chambers of the City Hall, 1501 Truxtun
Avenue, Bakersfield, California, as the day, hour and place when
and where the City Council would hear protests made by any parson
owning real property w~hin ~he aforesaid ~erritory, and
~KREAS, said Resolution was published at least t~lce,
but not oftener than once a week in The Bakersfield Californian, a
newspaper of general circulation published in ~he City of Bakers-
field, and also in The Olldala News, a newspaper of general
circulation published outside of the City of Bakersfield, but in
~he county where said territory is located, said publications
having been completed at least ~wenty days prior ~o ~he date set
for said hearing, in compliance wi~h Section 35311 of ~he Covern-
ment Code, and
~EREAS, the City Clerk of ~he City of Bakersfield has
caused writZen notice of such proposed annexation to be given by
mail at least t~enty days before the public hearing on said pro-
posed annexation to the persons entitled thereto, in compliance
w~th subdivisions (a) and (b) of Section 35311 of said ~overmnent
Code,
~HEREAS, at ~he time set for hearing protests, no written
protests were filed asainst ~he proposed annexation by any owner
of property within ~he ~erritory proposed to be annexed.
NO~, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield, as followS:

SECTION 1.
That the Council o£ the City o£ Bakersfield hereby
approves the annexation to and .inclusion ~r~thin the incorporated
li~Lts o£ the City of Bakersfield, of that certain uninhabited
territory desi~nated as "BENTON PARK NO. 7"; and it is hereby
further ordained that said territory be and the same is hereby
_A_~exed to the City; that said territory is described as £ollo~s:
-A parcel of land situate in the County of Kern,_ State of California,
and being a portion of the southeast quarter os Section 12, Township
30 South, Range 27 East,
Beginning at the southeast corner of Lot 71, Tract 2520, as per
map thereof recorded July 28, 1961, in Book 12 of Maps at page
in the office of the County Recorder of said Kern county, a point
on the current corporate boundary of the City of Bakersfield:
THENCE (1) S. 0° 0~' 38" ~7., ~long the southerly prolon~ation of

per Tract 2520, and departing from the corporate _
boundary of the City of Bakersfield, a distance o~

30", a distance of 143.37 feet to point, from which

Said territory, and the proper~y located ~herein, shall,
upon the completion of the annexation of ~ s~m~_ to ~he City
Bakersfield, be subjected ~o ~axatton equally vi~h other property
in the City of Bakersfield to pay the bonded indebtedness
City of Bakersfield, described in ~he aforementioned consent of the
ovners of property, located therein, the issuance of bonds
represent said indebtedness being provided for in Ordinance No. 893,
New Series, tn Ordinance No. 950, New Series, in Ordinance No. 1112,
New Series, and in Ordinance No. 1229, New Series, all of said
City, and any and all ocher indebtedness or liability of the City
outs~anding or authorized on and after the date of completion of
said anne~tion.
