AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE CITY
OF BAKERSFIELD AMENDING SECTIONS 6.20.040, 6.20.340
AND 6.20.351 (a} (BUSINESS LICENSE TAX) OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD.
This is an emergency ordinance necessary for the i,:.:.ediate
preservation of the public health, peace, property or safety. The
emergency necessitating the passage of this ordinance is as follows:
the ordinance prohibits the tax collector from issuing a business
license, other than a renewal license, to any fixed place of business
within the city, until such time as it is shown that the building has
met the requirements of the Zoning, Building, Fire and Health Codes of
the City. The ordinance further prov.ides for an adjustment in the
rates charged for business licenses for ice cream wagons and carts and
retail milk trucks not operated from an established place of business
within the City of Bakersfield. It is necessary and desirable that
the aforementioned rate adjustments become effective on July 1, 1962,
thus coinciding with the first day of the fiscal year.
BE IT ORDAINED by the Council of the City of Bakersfield as
follows:
SECTION I.
That Section 6.20.040 of Che Municipal Code of the City of ,...
Bakersfield be and the same is hereby amended to read as follows:
6.20.040 Unlawful business not authorized--Penalty. No
business license issued under the provisions of this chapter or
the payment of any tax required under the provisions of this chapter
shall be construed as authorizing the conduct or continuance of any
illegal business or of a legal business in an illegal manner, or to
conduct within the City of Bakersfield the business for 'which a
business license has been issued without strictly complying with all
the provisions of the ordinances of said City, and State and Federal
laws, including but not limited to those requiring a permit from
any board, commission, department or office of the City.
The Tax Collector shall not issue any license, other than a
renewal license, to any fixed plac~ of business within the City
until such time as it is shown that the business has met the re-
quirements of the Zoning, Building, Fire and Health Codes of the City
of Bakersfield. For the purpose of providing t/~e requisite evidence
of such compliance, the Tax Collector will provide the forms for
signature of the appropriate offices.
Any failure to comply with the aforesaid shall constitute
grounds for suspension or revocation of the registration certificate.
SECTION 2.
That Section 6.20.340 of the Municipal Code of the City of
Bakersfield be and the same is hereby amended to read as follows:
6.20.340 Ice cream wagons ~nd carts. For peddling, vending,
selling or offering for sale ice cream or iced confections, either
from horse-drawn or motor vehicles, or from carts or bicycles
propelled 'by manual power, the license tax shall be $20.00 for a
six-month period dating from the first day of the month in which issued.
SECTION 3.
That Section 6.20.351 (a) of the Municipal code of the City
of Bakersfield be and the s-me is hereby amended to read as follows:
6.20.351 Milk routes. (a) Retail milk trucks not operated
from an established place of business within the City of Bakersfield
for home delivery of milk, buttermilk, cottage cheese, etc., ~wenty
dollars ($20.00) semi-annually for each vehicle.
SECTION 4.
Effective Date. This ordinance is hereby declared to be an
emergency measure within the meaning of Section 24 of the Charter of
the City of Bakersfield, State of California, and necessary to provide
'for the daily operation of municipal departments, and shall be
effective on and after July 1, 1962.
