AN ORDINANCE AMENDING SECTION 17.12.020 (ZONING
MAP) OF THE MUNICIPAL CODE OF THE CITY OF
BAKERSFIELD BY CHANGING THE LAND USE ZONING OF
~6AT CERTAIN PROPER~f IN THE CITY OF BAKERSFIELD
LOCATED ON THE EASTERLY SIDE OF 0SWELL STREET
BETWEEN UNIVERSITY AVENUE AND THE EXTENSION OF
CHRISTMAS TREE LANE.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Co-,.-ission and City Council have held
hearings respectively, on a petition to change the land use zoning
of that certain property located on the easterly side of Oswell
Street between University Avenue and the extension of Christmas
Tree Lane within said City, and
WHEREAS, the City Council has determined after due
consideration of said petition and the recon~nendations of the
Planning Co~,ission herein on file, together with the reasons
advanced at the hearings for a change of zoning of said property,
that said Zoning change should be authorized.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield, as follows:
SECTION 1.
That Section 17.12.020 (Zoning Map) of the Municipal Code
of the City of Bakersfield, be and the same is hereby amended by
changing the land use zoning of certain property in said City, the
boundaries of which property are shown on the map hereto attached
and made a part hereof, as follows:
Changing the zoning boundarie.s from an R-1 (One-Family
Dwelling) Zone to an R-3-D (Limited Multiple-Family Dwelling --
Architectural Design) Zone on that certain property located
on the Easterly side of Oswell Street between University
Avenue and the extension of Christmas Tree Lane, being more
particularly described as being a certain parcel of land
situated in a portion of the Southwest one-quarter of the
Northwest o~e-quarter of Section 14, Township 29 South,
Range 28 East, M.D.B.M. and described more particularly
as follows: Co~,,,.mncing at the center line intersection
of Oswell S~reet and Christmas Tree Lane as said point
is shown on Map of Tract No. 2598 recorded December 21,
1961 in Map Book 12, Page 111 in the Office of the
County Recozder, County of Kern; thence S 29° 31'53" W,
along the center line of said Oswell Street 60.00 feet;
thence S 6~° 28' 07" E~ 55.00 feet to the tr.u.e point of
beginning; thenc~ S 29° 31'53" W, parallel w~th said center
line 550.57 feet to a point a.t the beginning of a curve,
concave to the Northwest, having a central angle of 04°
53' 36" at a radius of 855.00 feet; thence along said
curve in a Southwesterly direction an arc distance of
73.02 feet to a point of reverse curve, concave to the :
Southeast and having a radius of 745.00 feet; thence
along said curve in a Southwesterly direction through a
delta angle of 16° 22' 36" an arc distance of 212.94
feet; thence deDartinz from said curve nonradially S
74° 01' 49" E, ~93.08~feet to a point on a curve (also ·
being in the Westerly boundary line of Tract No. 2615
Map Book 12, Page 157 and 158) concave to the Southeast
and from which point the center of Said curve bears S
74° 01' 49" E, 545.00 feet distance thereon; thence in
a Northeasterly direction along sai.d curve through a
delta angle of 13° 33' 42" an arc distance of 129.00
feet to a point of tangency; thence N 29° 31' 53" E,
686.98 feet to a point on a curve, concave to the North-
east, from which point the center of said curve bears N
21° 36' 10" E, 490.00 feet distance thereon; thence
along said curve in a Northwesterly direction through a
delta angle of 07° 55' 43" an arc distance of 67.81 feet
to a point of tangency; thence N 60° 28' 07" W, 94°00
feet to a point at the beginning of a curve concave to
the Southeast having a central angle of 90° at a radius
of 20.00 feet; thence along said curve in a Southwesterly
direction an. arc distance of. 31.42 feet to the true point
of beginning.
Changing the zoning boundaries from an R-1 (One-Family
Dwelling) Zone to an R-3-D (Limited Multiple-Family
Dwelling -- Architectural Design) Zone on that certain
property located on the Easterly side of Oswell Street
between University Avenue and the extension of Christmas
Tree Lane, being more particularly described as being a .:.
certain parcel of land situated in a portion of the South-
west one-quarter of the Northwest one-quarter of Section 14, '"'

of beginning, said place of beginning being a point at the
beginning of a curve, concave to the Southeast and having a
radius of 545.00 feet; thence along said curve (being the
Westerly boundary line of said Tract No. 2615) in a North-
easterly direction through a delta angle of 16° 36' 38" an
arc distance of 158.00 feet; thence departing from said curve
radially N ?4° 01' 49" W, 193.08 feet to a point on a curve,
concave to the Southeast, from which point the center of said
curve bears S 71° 57~ 07" E 745 feet distance thereon; thence
Southerly along said curve through a delta angle of 14° 54'
52" an arc distance of 193.93 feet to a point of compound
curvature, concave to the Northeast having a central angle of
93° 46' 28" and a radius of 20.00 feet; thence' along last
said curve in a Southeasterly direction an arc distance of
32.73 feet to a point of tangency, last said point also
being in the Northerly right-of-way line of above said Uni-
versity Avenue; thence 89° 21' 33" E along said Northerly
right-of-way line 180.00 feet to the true point of beginning.

T HEREBY CERTIFY that the foregoing Ordinance was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 1st day of October, 1962,
