AN ORDINANCE APPROVIN~ ~TION OF A PARCEL OF
UN~ITED TERRITORY TO TH~ CITY OF BAI~RSFIELD,
CALIFORNIA, DESI~'~ATED AS "BRITE NO. 5," AND
PROVIDII~ FOR ~ TAXATION OF SAID TERRITORY TO
PAY THE BOIqDED rSI~l~B~l~l~SS OF SAIl)' CITY.
~REAS, a petition was filed ~lth the Council
City of Bakersfield on the 26th day of 3uly, 1962, requesting that
certain uninhabited territory therein described be a,~exed to and
incorporated vithin the City of Bakersfield, and
~EREAS, said petition was si~ned by the o~ners of one-
fourth of the Land, by area, and by asses8ed value as shorn on the
last equalized assessment roll of the County of Xern, and
~I~REAS, the territory described in said petition is
conti~uous territory to be annexed, and
I~IEREAS, the said territory does not form a part of any
other city, and
~t~REAS, on the 26th day of July, 1962, there vas filed
in the office of the City Clerk of the City of Bakersfield,
~rritten consent, si~ned by the' o~ners of more than t~o-thirds of
the value of the territory, chat said territory be subjected to
ta]mtion after the completion of such annexation equally ~-lth the
property in the City of Bakersfield to pay the bonded indebtedness
of said City therein described, as provided for in Ordinance No.
$95, New Series, in Ordinance No. 950, New Series, in Ordinance
No. 1112, Ne~ Series, and in Ordinance No. 1229, New Series, all
of the City of Bakersfield, and any and all other indebtedness or
liability of the City outstanding or authorized on and after the
- date of co~pletion o£ said annexation., and..this C.otu!.cil .hereby.
determines ~at said consant is si~ned by the ovners of more than
cwo-thirds of the value of ~he-territory, and complies in every'
respect w~th the provisions of Section 35319 of the Governs-ut
Code of the State of California, and
~dEREAS, the Council of the City of Bakersfield did, on
Cite 6~h day o£ August, 1962, pass a Resolution being No. 51-62, in
compliance w~Ch the provisions of the Annexation of Uninhabited
Territory AcC o£ 1939, and amendments there~o, being Title 40
Division 2, Part 2, Chapter 1, Article 5 of the Government Code of
the State of California, specifically describing the boundaries of
the territory so proposed Co be annexed to ~ city of Bakersfield,
and desii~ating such territory by an appropria~e ~_~m~_, and setting
Monday, the 17th day of September, 1962, at the hour of eight ,*clock
P.M. in ~he Council Chambers of the City Hall, 1501 Truxtun Avenue,
Bakersfield, California, as the day, hour and place when and where
the City Council would hear protests made by any person owning
real property within the aforesaid ~erritory, and
~REAS, said Resolution was published at least twice,

newspaper of general circulation published in the City of Bakers-
field, and also in The Oildale News, a newspaper of ~eneral
circulation published outside of the City of Bakersfield, buC in
the county where said ~erriCory is located, said publications having
been completed at least t~enty days prior to the date set for said
b~aring, in compliance with Section 35311 of the Government Code,
and
WHKRKAS, the City Clerk of the City of Bakersfield has
caused written notice of such proposed annexation Co be given by
mail 'a~:-le~c txeenty-day8 before ~h~ public hearing' on' said -
proposed annexation Co the persons entitled thereto, in compliance
wi~h subdivisions (a) and (b) of Section 35311 of said GoverrmenC
Code, and

owner of property within ~he ~erritory proposed to be annexed.

CtCy of Bakersfield, as follows:
SECTION 1.
Thac ~he ClOy Council of ~e CtCy of Bakersfield hereby
approves the annexation to and inclusion w~hin the incorpora~ed
limits o£ ~e CtCy of Bakersfield, of Chat certain uninhabited
territory designated as "BRITE NO. 5"; and lC ts hereby further
ordained ~haC sald ~errlCory be and the same ts hereby annexed Co
said City; ~hat said territory is described as follows:
A parcel of Land slCuaCe tn the County of Kern, S~a~e of California,
and being a portion of LoC 33, la Section 1, Township 30 South,
Range 27 Ease, H.D.H;, as said LoC 33 is shown on the '~ern County
Sales ~ap No. 1 of Lands of J. B. Hasgin," filed for record Hay 3,
1889, in the of£1ce of ~he County Recorder of said Kern County.
Beginning at the nor~heas~ corner of said LoC 33, sald point of
beginn~ng also belng the ln~ersecCion of the southerly llne of
Belle Terrace, of 60 feeC in width, and ~he uescerly line of Sou~h
'~". Street, also known as Kern Island Road, of 60 feeC in width,
a point on the current corporate boundary of ~he City of Bakersfield;
THENCE (1) southerly along ~he easterly line of said. LoC 33, on
and alon§ ~he current corporate boundary as same is
defined by ~haC Annexation designa~ed "El Cmslao
District,' as arm~xed by a special election held
June 13, 1950, and which was approved June 19, 1950,
by Ordinance No. 876, New Serles, Co ~he north line of
Shamrock Way, as shown on ~he -~p of Trace No. 1380,
recorded in Book 6 of Haps aC page ~0, in the office
o~ the said County Recorder;
THENCE (2) westerly along
~he said northerly line of Sb-~ock Way,
departing
corporate boundary of the CtCy of
Bakersfield, a distance of 125 feeC Co the westerly
line of ChaC certain grant deed recorded Hay 22, 1959,
.. in 'Book 3136 at page 85 o£ the Of£1cial Records of
said Kern County;
THENGE (3) northerly along said westerly l~ne of said grant deed
to intersect a line parallel ~o and distant 13~ feet
northerly of as measured perpendicular to ~e north
line of Shamrock l~ay;
THENCE (~) westerly 166.33 feet along last named parallel line to
intersect a llne parallel to and distant lO0 feet
easterly of the ~est line of that certain ~rant deed
recorded December 20, 1960, in Book 3331 at page
of the official records of said Earn County;
THENCE (5) northerly and parallel w~th the east line of said
Lot 33 to intersect the south line of Belle Terrace;
THENCE (5) easterly along the south line of Belle Terrace to the
northeast corner of said Lot 33, the point of heg~rmiz~,
containing 1.697 acres of land, more or less.
Said territory, ~_nd the property located therein, shall,
upon tB~ completion of the annexation of the same to the City of
Bakersfield, be subjected to taxation equally w~th other property
in the City of Bakersfield to pay the bonded indebtedness of the
City of Bakersfield, described in the aforementioned consent of
the owners of property, located therein, the issuance of bonds to
represent said indebtedness being provided for in Ordinance No.
893, New Series, in Ordinance No. 950, New Series, in Ordinance
Noo 1112, Ne~e Series, and in Ordinance No. 1229, New Series, all
of said City, and any and all other indebtedness or l~ability of
the City outstan~Lng or authorized on and after the date of com-
pletien of said annexation.
SECTION 2.
This ordinance shall become effective thirty days from
and after the date of its passage.

and adopted by the Council of ~he City of Bakersfield at a regular
meeting ~ereof held on ~he 17th day of September, 1962, by ~he
