AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING CHAPTER 5.09 TO THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD,
ENTITLED SPECIAL DEPOSITS FUND.
WHEREAS, Section 60 of the Charter of the City of
Bakersfield provides that "Every officer collecting or receiving
any funds belonging to or for the use of the City shall settle
for the same immediately .... ," and
WHEREAS, it is necessary and convenient that a "Special
Deposits Fund" be created in order to provide an efficient method
of receiving and disbursing miscellaneous funds deposited with
various departments of the City.
NOW, THEREFORE, BE IT ORDAINED by .the Council of the
City of Bakersfield as follows:
Section 5.09.010 Special Deposits Fund Created. There
is hereby created a fund to be known as the Special Deposits Fund
to be used for the purpose of accounting for monies received by
the City of Bakersfield, including monies received by the City as
trustee or custodian, or in its capacity as agent, for individuals,
corporations or other governmental agencies.
Section 5.09.020 Duties of Director of Finance. The
Director of Finance of the City shall administer the Special
Deposits Fund and shall require that adequate records be maintained
to account for all monies deposited in or disbursed from said Fund.
(a) Whenever it shall be determined that any monies or
portion thereof deposited in the Special Deposits Fund legally
belong to any of the several funds of the City the Director of
Finance shall immediately cause such monies to be transferred
immediately to the proper fund or funds.
(b) Disbursement of monies for the purposes for which
they were deposited in the Special Deposits Fund may be .made upon
the approval of the Director o~ Finance or his authorized Deputy.
