CODE.
~E~S, the City of Ba~rsfield has enacted a plan for
the protecti~ of the public aEainst the spread of rabies, and
~E~AS, since the enact~nt of this provision in the
Municipal Co~ by Ordinance No. 851, Section 4, on December 12,
1949, certain advances ~ve been ~de in the field of veterinary
science, and
~ER~S, it is desirable to ~fve does, within the city,
an additional t~ ~nths of protection a~afnst the fatal disease
of rabies, and
~E~S, it is desirable to standardize the aec limit
requ~re~nt for rabies vaccination and to ~ that aec limit re-
quirement confo~ with the aec limit require~nt in other parts
of the state.
N~, ~E~FO~, BE IT O~AINED by the Co~cfl of the
City of Ba~rsfield t~t Section 9.08.040 of the M~icfpal Code
(also ~o~ as Ordinance No. 851, Section 4; December 12, 1949) be
a~nded to read as follows:
9.08.040 DoK license required--Vaccination. (a) It
shall be ~lawful for any person o~nEi harborinE, or hav~nE the
care, custody or possession of any doe to keep or ~intain any such
doE in any place in the City of. Ba~rsfield, ~less such doe is
licensed as provided in Section 9.08.050 hereof. ~is section shall
~ve no application to does ~der the aEe of four m~ths fastened
securely by a chain, rope or leash, or confined ~thin the private
property of their o~ers.
(b) ~e license collector shall not license any doe
until it has been vaccinated with canine rabies vaccine by injection
or other method approved by the Health Officer during the calendar
year for which it is licensed, and the owner or person in possession
of the same shall produce a certificate of such vaccination, unless
the owner or person in possession of the 'same submits a certificate
from a licensed veterinarian issued within the preceding sixty
(60) days stating that in .his opinion the rabies ~accination would
be likely to seriously injure the dog. Any dog so exempted from
rabies vaccination shall be restricted to the enclosed yard of the
owner or person in possession of the same except when held upon a
chain, rope or leash. Any violation thereof by the owner or
person in possession of such dog shall constitute a' violation of
this chapter.
(c) Said vaccination shall be performed by the Health
Officer, or any duly authorized and licensed physician or veter-
inarian. The person vaccinating said dog shall issue to the owner
or person in possession of said dog a certificate of vaccination.
(d) It ~hall be unlawful for any person owning, harboring
or having the care, custody or possession of any dog to keep or
maintain any such dog in any place in the City of Bakersfield, un-
less such dog has been vaccinated as required by this section,
excepting dogs under the age of four months fastened securely by a
chain, rope or leash, or confined within the private property of
their owners, and excepting dogs exempted from the requirement of
vaccination by reason of the likelihood of serious injury as
provided in sub-section (b) of this section.
