AN ORDINANCE AMENDING SECTION 3.12,080
OF THE MUNICIPAL CODE OF THE CITY OF
BAKERSFIELD AND ADDING SECTION 3.12.091,
BE IT ORDAINED by the Council of the City of Bakersfield
as fo llows:
SECTION 1.
That Section 3.12.080 of the Municipal Code of the City
of Bakersfield be and the same is hereby amended to read as
fo llows:
3.12.080 Board of zonin~ adjustment created--Membership--
Terms--Vacancies--Removal. There is hereby created a Board of
Zoning Adjustment of the City of Bakersfield, which shall consist
of three (3) members, which membership shall be selected on the
basis of one member each from the Public Works, Building, and
Legal DeparUaents of the City of Bakersfield, and who shall be
appointed by the City Council. One member shall be appointed to
serve for a term which shall expire December 1, 1960; one member
shall be appointed to serve for a term which shall expire December 1,
1961; and one member shall be appointed to serve for a term which
shall expire December 1, 1962. At the expiration of each of the
terms so provided for, successors shall be appointed for a term of
three (3) years. Vacancies on said Board shall be filled in the
same manner for the unexpired term. Members of ~he Board of
Zoning Adjustment may be removed in the same manner as members of
the Planning Co ...... ission, as provided by law.
SECTION 2o
..... That Section 3.12.091 be and the same is hereby added to
the Municipal Code of the City of Bakersfield to read as follows:
3.12.091 Planning DeparUaent--City of Bakersfield. The
Planning Department of the City of Bakersfield shall act in an
advisory capacity on all ~-tters relating to conditional use
permits~ variances~ and modifications and provide technical and
secretarial services to said Board of Zoning Adjustment.

I HEREBY CERTIFY that the foregoing Ordinance was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 28th day of January, 1963, by
the following vote:
